Which cars do not require tachographs?

Please note that there is a list of exceptions, i.e. buses and trucks that do not need tachographs:

  • Trolleybuses;
  • Cars carrying out international transportation and equipped with “European standard” tachographs;
  • Military vehicles;
  • Cars of bodies carrying out operational investigative activities (police, FSB, FSIN, etc.);
  • Vehicles registered with state technical supervision (tractors and self-propelled vehicles);
  • Vehicles over 30 years old that are not intended for commercial transportation (for which a recycling fee is not paid);
  • Training vehicles not used for commercial transport;
  • Cars undergoing road tests.

Please note that earlier this list also included buses providing regular urban and suburban services. However, as of November 20, 2021, these vehicles are no longer included in the exemption list.

In addition to the vehicles listed above, there is another list of exceptions (based on the type of work performed):

  • Truck-mounted concrete pumps;
  • Truck mixers;
  • Asphalt distributors;
  • Truck cranes;
  • Ambulances;
  • Tow trucks;
  • Fire trucks;
  • Vehicles for public utilities and road maintenance;
  • Vehicles for servicing oil and gas wells;
  • Collection vehicles (for transporting money and valuable goods);
  • Vehicles equipped with lifts with working platforms;
  • Medical complexes on vehicle chassis;
  • Auto shops;
  • Buses for funeral services;
  • Car-homes;
  • Armored vehicles;
  • Specialized vehicles (specially equipped milk tankers, livestock tankers, vehicles for transporting poultry, eggs, live fish, machines for transporting and applying mineral fertilizers);
  • Category C trucks used by agricultural producers for on-farm transportation (transportation within the boundaries of the municipal district in which the vehicles are registered, as well as municipal districts bordering it);
  • Special vehicles;
  • Mobile laboratories and workshops;
  • Mobile television studios.

This list includes many specialized vehicles. There is no need to install tachographs on them and this will not entail a fine.

How to apply for an international carrier card?

Permission for international transport is issued by Rostransnadzor and its territorial bodies (UGADN). To receive it, legal entities and individual entrepreneurs must meet the following requirements:

  • have vehicles that meet international technical standards and agreements;
  • stable financial position;
  • OSAGO policy;
  • The organization must have a driver/drivers with the required qualifications on staff.

The certificate (issued for each vehicle) is issued for one year upon initial application. After 12 months, you can apply for a new one for a period of 5 years, which, unlike the one issued the first time, can be extended twice.

Tachograph law from 1 January 2021 – who is affected by the changes?
In the departments of Rostransnadzor, the service (in full - consideration of the application, issuance of cards, and their renewal) is provided free of charge. Specialized workshops help with registration for a fee (about 10,000 rubles depending on the validity period of the certificate and the region). Installation of a new tachograph with CIPF, including the cost of the device and its configuration, will cost from 35,000 rubles. Another 25,000 rubles (current price as of January 2021) will need to be paid every three years to replace the cryptographic block. The list of CIPF block models, maps, and licensed workshops is regularly updated on the website of the Federal Budgetary Institution Rosavtotrans.

Do you need a tachograph for a dump truck?

The most popular type of truck used in construction work is the dump truck. Let's consider whether a tachograph is needed for a Kamaz dump truck.

On the one hand, if a dump truck is used by a construction company building residential buildings, then it definitely needs a tachograph.

On the other hand, if Kamaz is used for public utilities, then its owner has reasonable questions. Is it possible not to install a tachograph in this case?

Please note that traffic police officers in many regions interpret the above list of exceptions as follows. Vehicles for public utilities and road maintenance include only vehicles with a specialized purpose. The same applies to vehicles for servicing gas and oil wells.

In accordance with this interpretation, the traffic police does not require the installation of tachographs, for example, on cars equipped with brushes for cleaning roads. However, the traffic police requires tachographs to be installed on dump trucks used in public utilities and imposes fines for their absence.

Which tachograph should be installed on a truck from 2018?

What type of device should be installed on the truck depends on the direction of the flights being carried out. The provisions of Order No. 36 of the Ministry of Transport definitely say:

  • for transportation within the country, a tachograph with cryptographic information protection is required;
  • for international transport - the European equivalent.

The requirement for the mandatory installation of a technical control device with a cryptographic module does not affect vehicles approved for international transportation in accordance with the access card. That is, the presence of this document classifies the vehicle as one of the exceptions to which the directive does not apply. At the same time, admission does not oblige you to travel outside the country and present relevant evidence, but is only evidence of the transport’s readiness to make international flights.

Do you need a tachograph for a personal truck?

Until November 1, 2021, the installation of tachographs was mandatory only for vehicles used by legal entities and individual entrepreneurs. Those. private owners would not need a tachograph.

However, from November 1, 2021, the following paragraph was added to the Law “On Road Traffic Safety”:

Individuals operating trucks whose permissible maximum weight exceeds 3,500 kilograms and buses are obliged to: ... ensure that the vehicles they operate are equipped with tachographs. Requirements for tachographs, as well as the procedure for equipping tachographs, the rules for their use, maintenance and control of their operation are established in the manner determined in accordance with paragraph ten of paragraph 1 of this article;

Thus, from November 1, 2021, a tachograph is needed

including personal trucks of category C and personal buses.

Introduction of tachographs on cars of individuals from November 1, 2019

Why are tachographs needed?

A tachograph is a measuring device whose main function is to record the time spent by the driver behind the wheel. Tachographs are installed on trucks. The 2021 law also requires installation of the device in the cabin of a passenger bus (the exact list of vehicles is contained in Appendix 2 to Order No. 36 of the Ministry of Transport dated February 13, 2013, as amended in 2021).

The use of the device is driven by the need to improve road safety. Statistics say: a significant number of accidents involving heavy trucks occur due to lack of sleep, the driver spending a long time behind the wheel and other reasons that reduce concentration.

They regulate this area (including the question: which vehicles should have tachographs installed from January 1, 2018):

  • Law No. 196-FZ “On Road Safety” dated December 10, 1995 (Article 20 obliges carriers to equip their fleet with tachographs),
  • Decrees of the Government of the Russian Federation No. 720 of September 10, 2009 (approving technical regulations on the safety of wheeled vehicles) and No. 1213 of November 23, 2012 (contains requirements for devices, determines the order of equipment, etc.),
  • Orders of the Ministry of Transport No. 36 of 02/13/2013 and No. 273 of 08/21/2013 (as amended in 2021). The first approved the requirements for devices, rules of use and control, the second approved the installation stages.

The provisions of regulations are mandatory for companies and individual entrepreneurs transporting passengers and cargo. They do not apply to private vehicle owners.

Is a tachograph required for commercial transport in a personal vehicle?

Quite a common question. The driver buys a truck or bus for commercial transportation, but does not intend to register an individual entrepreneur or legal entity. Is a tachograph needed in this case?

Starting from November 1, 2021, the issue can be resolved quite easily, because... tachographs must be installed on all category C trucks and category D buses. That is, it does not matter who the owner is.

In addition, in the situation described above, the driver faces punishment for another violation - carrying out business activities without state registration (Article 14.1 of the Administrative Code):

Carrying out entrepreneurial activities without state registration as an individual entrepreneur or without state registration as a legal entity -

shall entail the imposition of an administrative fine in the amount of five hundred to two thousand rubles.

The size of this fine is comparable to the fine for not having a tachograph.

Traffic police fines

Violation of the tachograph installation procedure will result in administrative penalties. In 2021, traffic police inspectors have every reason to issue a fine:

  • for an AETR tachograph without an access card to international transport,
  • for a digital tachograph not enhanced by a cryptographic information protection unit,
  • for an analogue tachograph (in the vast majority of cases).

Fines for a tachograph in 2021 (for a device that does not meet the requirements, its absence, an attempt to block, correct the operation of the device, etc.), according to Article 11.23 of the Code of Administrative Offenses of the Russian Federation, will be:

  • from 1,000 to 3,000 rubles – for citizens,
  • from 5,000 to 10,000 rubles – for officials.

A driver who violates the work and rest schedule will pay from 1,000 to 3,000 rubles.

What tachographs are required to be installed in 2021?

Recording of continuous and uncorrected information on drivers’ compliance with work and rest schedules - mandatory tachographs must meet this condition from January 1, 2021. Russian Government Decree No. 1213 gave the Ministry of Transport the authority to determine the procedure for equipping with control devices. Requirements for devices and rules for handling them are coordinated with the FSB and the Ministry of Internal Affairs.

Devices capable of reproducing flight details are supplemented with a CIPF cryptographic module for storing encrypted information. One of the requirements for the device, which replaced outdated analog ones and digital ones not equipped with a cryptographic protection system, is that the body of the flight recorder must be sealed. In addition to the CIPF unit, the kit includes:

  • Data processing software;
  • a reading device, a keyboard for entering information and a display for displaying information;
  • tachograph card;
  • Motion Sensor;
  • GLONASS/GPS antenna.

The service life of the CIPF module is three years, but replacement may be necessary earlier:

  • if the device breaks down;
  • when changing the owner or changing the data that needs to be entered for activation (car make, model, VIN number, etc.)
