Finally, in our country, the Government of the Russian Federation has made changes to the traffic rules that relate to the transportation of children in cars. Thus, from now on, the transportation of children under 11 years of age is regulated by changes in traffic rules adopted by Decree of the Government of the Russian Federation No. 761 of June 28, 2021.

Thus, new rules now oblige drivers to transport children under 7 years of age only using child restraint systems (car seats) that are appropriate for the child’s weight and height. That is, from now on it is strictly prohibited to transport children using “belt adapters”, frameless devices and other seat belt guides. For violating this traffic rule, the driver faces a fine of 3,000 rubles.

Fine for incorrectly transporting a child

According to the rules for transporting children in 2018-2019, the punishment for non-compliance will be more severe for drivers. How can you transport children under 7 years of age in a car?

Let us remind our dear readers that previously the legislation allowed drivers when transporting children to use, in addition to car seats and boosters, various “other devices” , which include: a book, a frameless device, a seat belt corrector (adapter).

According to changes in the traffic rules, now the words “other devices” are removed from the rules on the basis of Government Decree No. 761 of June 28, 2017.

Accordingly, now transportation of children under 7 years of age is possible only in special car seats, boosters, which take into account the height and weight of the child himself.

Thus, according to the new Decree of the Government of the Russian Federation No. 761, changes are made to the traffic rules in paragraph 22.9, namely:

“Transportation of children under 7 years of age in a passenger car and in the cabin of a truck that is designed with seat belts or seat belts and an ISOFIX* child restraint system must be carried out using child restraint systems (devices) that are appropriate for the weight and height of the child .

It is also worth noting that during tests of frameless child restraint devices, seat belt adapters and other similar devices, it was found that the consequences of an accident for a child are worsened compared to the seat belts themselves, provided for by the design of the vehicle and used to secure the child without any additional devices.

That is, in other words, we can say that seat belt adapters, frameless devices, etc. devices cause more harm than simple seat belts in a car.

Age restrictions

Adults who have babies need to know how to safely transport their child. The traffic rules do not directly indicate what the minimum age of a child should be at which he can ride in front.

However, the rule provides for the transportation of children under 7 years of age in a special child car seat. Accordingly, if you have a child car seat, then the child can ride in the front seat from birth.

Please note that children under 7 years of age can only be carried in the front and rear seats in appropriate car seats.

How to transport children aged 7 to 11 years?

According to the changes that have occurred in the traffic rules of the Russian Federation, on the basis of the Decree of the Government of the Russian Federation No. 761, in paragraph 29.9, changes related to the transportation of children aged 7 to 11 years were also made.

Is it possible to transport children aged 7 to 11 years in the back seat of a car without a car seat?

Yes, according to the Government Decree and the amendments made to clause 29.9 of the Russian Traffic Regulations, transporting a child in the back seat aged 7 to 11 years, both in a car seat and without it, is permitted. But in this case, seat belts must be used .

Accordingly, the use of seat belt adapters and frameless child restraints for transporting children in a vehicle is prohibited.

So, friends, please note that according to the new legislation, the driver now has the right to transport a child in the back seat without using a car seat. In this case, you need to fasten a child between 7 and 11 years old with the standard seat belt of the vehicle.

Types of car seats

Using a car seat for children is not just a clause stated in the rules for transporting children, but also a vital necessity.   • Group 0+ - car seats are intended for children aged 0 to 1.5 years and weighing from 0 to 13 kg. It differs from the previous one only in that here the baby is in a reclining state;
  • Group 1 – car seats for children weighing 9-18 kg and aged from 1 to 4 years. Here, unlike the group 0 seat, five-point seat belts are used;
  • Group 2 – car seats for children from 3 to 7 years old weighing 15-25 kg. These chairs are equipped with an adjustable backrest height. While in such a chair, the child is secured using regular seat belts;
  • Group 3 – car seats designed for children aged 7 to 12 years and weighing 22-36 kg. There are special limiters for the top strap, and it is also possible to unfasten the backrest, which will be necessary when the baby grows out of this chair.

Is it dangerous to transport children aged 7 to 11 years without car seats?

It is also worth noting that the appearance in the traffic rules of a clause allowing the transportation of children from 7 to 11 years old without the use of car seats, on the one hand, simplifies the rules for transporting a child in a car, but on the other hand, it makes many drivers think, since it is not always possible to transport children using Seat belts provide adequate protection during an accident.

Here it’s all about the height and weight of a child aged 7 to 11 years. After all, friends agree with us, children are all different. For example, it often happens when a child aged 7-8 years has the same height and weight as a child 10-11 years old, and vice versa, it often happens when a child aged 11 years has very little weight and the same short height, which is comparable to a child younger age.

What is the point of the changes?

Will you have to shell out money for a car seat?

Isn't this about your child's safety? However, let us draw your attention again: in the new version, the rules allow you to do without a car seat at all if your child is already seven years old and if you do not carry him in the front seat. We would only recommend not to forget documents at home, which, if anything happens, will convince the inspector that the young passenger in your car is already at the age when you can do without a car seat. Your passport with a note about children or a personal birth certificate will do for this. What if the trip is by taxi?

There are no provisions for this in the traffic rules, so taxis will comply with general requirements.
When ordering a taxi, notify the service that you will need a car seat and indicate the age of the child. A sane service will figure it out on its own and send you the car you need. But if for some reason the driver arrives without a seat or hesitates to take it out of the trunk and install it before the trip, our recommendation: send him on his way.

What about sanctions?

Fortunately, the amount of the fine for transporting children without car seats (according to the above rules) has not yet changed.
But even now it is quite significant - 3 thousand rubles (Part 3 of Article 12.23 of the Code of Administrative Offenses of the Russian Federation). Violation of the ban on leaving minors alone in a car will fall under the sanction of Article 12.19 of the Administrative Code and will cost the violator 500 rubles.
Although you can get off with a simple warning. But it is important to keep in mind: when responding to cases of finding a child in a locked car, law enforcement officers very often initiate a criminal case for leaving in danger.
