New rules on tires in winter
The bill came into force on November 11, 2021. It sets the deadlines for changing summer and winter tires. The amendments do not apply to all-season tires, but studded tires are prohibited in the summer season. The main amendments made to the traffic rules:
- Specifications for winter tires have been established, depending on the category and load capacity of the vehicle.
- Tires are supposed to be changed in winter on cars of categories M1 and N1 (passenger cars, minibuses, buses).
- A fine has been introduced for tires that do not correspond to the season.
- Sanctions for the car owner in case of non-compliance with the established technical specifications (according to paragraph 5 of the 8th appendix of the Technical Regulations of the Customs Union).
- A fine is not imposed if the flaws are minor - this is decided by the traffic police inspector. In this case, the driver is only given a reprimand.
- The bill does not provide for a clause regarding all-season tires. When issuing a fine, the inspector will be guided by the markings on the tires and their technical characteristics.
Tires must be changed from December 1st. The use of winter tires is allowed until 1 month of spring, but in some cities the official date for changing tires to winter differs. This happens due to the temperature difference in different parts of Russia.
What the law says
Car owners know that winter tires come in both studded and velcro types. Their main feature and difference from the summer version of tires is the preservation of properties at low temperatures. In addition, winter tires provide better traction on icy roads. And this is not only when driving straight, but also when cornering.
According to the innovations, studded tires are no longer suitable for car owners who like to drive outside the city. However, many drivers even use them within the city. However, if a citizen has such a desire, then there will have to be a sticker on the rear window of the car warning about the use of studded tires. In case of its absence, a fine will be imposed on the driver.
Most drivers are sure that there is no need to rush to change summer tires during the so-called transition period of weather. They insist that the first snow does not last long, and neither do frosts. Everything will melt very quickly, and winter tires on bare asphalt wear out very quickly. Experts still don’t understand why tire wear prevails over the fear of crashing a car on a slippery road.
What does the law on the transition to winter tires in Russia provide?
Authorized persons developed a new document, which began to work successfully on November 11, 2021. It is a regulation on the safety of wheeled vehicles. Thanks to this paper, buses and heavy freight vehicles will be able to travel without changing tires to winter ones for all 12 calendar months.
In Russia, there are recommendations according to which owners of passenger vehicles must change winter tires, but representatives of the road patrol service cannot initiate a fine if the requirements are not met. Representatives of the State Duma have not developed a document according to which there will be financial punishment for vehicle owners who use inappropriate tires in the winter.
The decision of the Council of the Eurasian Commission approved changes to the technical regulations of the Customs Union on the safety of wheeled vehicles. Previously, a car could not be driven without winter tires for 3 winter months. The norm applied to all vehicles observed in the country. The amendments, which came into effect on November 11, provide for the use of winter tires on cars of a certain category - M1 and N1. These include passenger vehicles, as well as buses that can accommodate 8 people.
Previously, the authorities of the constituent entities of the Russian Federation independently established a certain period, according to which vehicle owners changed tires. Clarifications have been made to the regulations, according to which not only regional, but also federal law on the terms of use of winter tires is also taken into account.
Penalty for using summer tires in winter
When it comes to when to change your tires, experts insist that you keep an eye on the weather. It is best to use data from the last 24 hours. If the air temperature has stabilized at +7 degrees, this is that very moment. This year, according to officials, there is no law according to which car owners can be fined if their vehicles do not have winter tires. But we must not forget that tires that are too worn can still be fined. This is the case if the tread is less than 4 mm from the condition of the new tire.
In addition, this fine may also apply to the summer period of the year. If summer tires are badly worn, a fine will be required. Based on all that has been said, it turns out that from December 1, people will be fined for summer tires or heavily worn winter tires. The fine will be 500 rubles.
There is no law on winter tires! Fines for summer tires too
Answer: There is neither a “law on winter tires” nor fines for late switching to them. All these rumors are connected with various initiatives that were introduced at different times by representatives of the deputy corps.
The only document that today regulates the use of winter tires is the rather old (in force since 2015) Technical Regulations of the Customs Union (TR CU 018/2011) “On the safety of wheeled vehicles.” It is in Section 5 of Appendix No. 8 of this document that the requirements for car tires are specified depending on the season. In particular, it is prohibited:
- Drive a car with studded tires in the summer from June to August;
- Drive in winter in a car that is not equipped with winter tires on all axles.
At the same time, regional authorities reserve the right to change the service life of certain tires depending on the climate.
Clause 5.6.2 of the Regulations specifies the requirements for the tread depth of winter tires; you can see them in the screenshot below.
At the same time, the current Code of Administrative Offenses of the Russian Federation does not provide for liability for violation of the requirements of the Customs Union regulations!
Article 12.5 of the Code of Administrative Offenses of the Russian Federation, which punishes violations of requirements for the operation of vehicles (appendix to traffic rules), does not contain references to customs regulations, as well as other conditions or requirements for its compliance.
Regulations with requirements for changing summer and winter tires are not mentioned there!
Innovations from November 11
Starting from November 11 of this year, amendments to the Technical Regulations “On the safety of wheeled vehicles” come into force. From now on, all owners of cars that belong to category “B” will be required to use winter tires from December to February. However, in some regions, due to weather conditions, these dates may differ.
Another requirement for car owners is that tires of the same type must be installed on one axle. In addition, the law now stipulates the exact name of the tire model. This means that if a car has winter tires of the same type, but of a different model name, this will result in a fine. However, as before, there is no law regarding the use of out-of-season tires. The maximum that a driver can face is a fine of 500 rubles for worn tires.
When is it legal to switch to winter tires?
Let's consider paragraph 5.5 of Appendix 8 to the technical regulations of the customs union TR CU 018/2011 “On the safety of wheeled vehicles”:
5.5. It is prohibited to operate vehicles equipped with tires with anti-skid studs in the summer (June, July, August).
During the winter period (December, January, February), the operation of vehicles of categories M1 and N1 that are not equipped with winter tires that meet the requirements of paragraph 5.6.3 of this annex is prohibited. Winter tires are installed on all wheels of these vehicles.
A period different from that specified in paragraph one of this paragraph may be established by the legislation of a member state of the Eurasian Economic Union in connection with climatic and geographical factors characteristic of member states of the Eurasian Economic Union.
So, what can be understood from this paragraph:
- During the summer months (June, July, August) only studded tires are prohibited. This requirement applies to all vehicles.
- During the winter months (December, January, February), only winter tires are permitted. You can put both studded and non-studded tires on your car. The main thing is that they are marked “M+S”, “M&S” or “MS” and the corresponding drawing (in the picture on the left). The requirement applies only to category B (M1 cars and N1 trucks). The restriction does not apply to other vehicles from November 11, 2021.
- The terms of the ban on exploitation can only be increased by the legislative authority of any level (federal, regional) and cannot be reduced. Those. In your region, for example, the use of studded tires may be prohibited from May to September. At the same time, regional authorities cannot reduce the period of the ban, i.e. From June to August, cars in all regions must not use studs.
Thus, there are the following intervals for using car tires:
- Summer tires (without M+S marking, etc.) can be used from March to November.
- Winter studded tires (marked M+S, etc.) can be used from September to May.
- Winter studless tires (marked M+S, etc.) can be used all year round.

The official website of the traffic police denies the fine for the lack of winter tires
Drivers will not be fined for not having winter tires on their cars. This was reported by the press service of the traffic police. The State Traffic Inspectorate noted that on November 11, changes to the technical regulations of the Customs Union “On the safety of wheeled vehicles” came into force. “The innovations concern the requirements to equip only vehicles of categories M1 and N1 with winter tires in winter (passenger cars and trucks with a gross weight of no more than 3.5 tons), as well as to prevent the installation of tires of different models on the same axle of a vehicle,” - Interfax quotes a traffic police report.
It is noted that administrative liability for operating these vehicles without winter tires in winter is not established in the Russian Code of Administrative Offenses.
Penalties for not having winter tires
Another innovation, which will come into force on November 11, will also affect owners of their own cars. You cannot drive on summer tires in winter in December, January and February.
Motorists are recommended to install studded or non-studded tires marked “M+S” and the corresponding designation – an image of a snowflake located in a geometric figure.
It is also prohibited to install tires of different models or wheels of different sizes on the same vehicle axle. The fine for violation is 500 rubles. If the owner of the car has worn-out winter tires, then the first time he will get off with only a warning.

- studless winter tires - all year round.

Naturally, in Russia there is no way to establish uniform dates for seasonal tire changes. After all, on the same day and hour in one region there can be frost and snow, and in another there can be sunny, almost summer weather. But Russian legislation still provides for something.
The main regulatory document that concerns the technical features of the operation of vehicles is called the Technical Regulations of the Customs Union TR CU 018/2011 “On the safety of wheeled vehicles.” Appendix 8 (clause 5.5) of the technical regulations prohibits the operation of both vehicles equipped with tires with anti-skid studs in the summer (from June to August), and vehicles not equipped with special winter tires in the winter (from December to February).
The terms of the operation ban may be changed upward by regional government bodies of the member states of the Customs Union.

The fine for summer tires was not the last law on November 1, 2021
The new system is scheduled to go into operation in Moscow in November. Initially, tests will be carried out on 1 camera. Now, according to the Traffic Organization Center (TCOC), the databases are being merged, which will help clarify who has insurance and who does not. Decisions on the size of fines and to whom they will be applied are made by the Ministry of Internal Affairs.
To speed up the launch of the system, we came up with a new algorithm for the interaction of various services. For example, RSA generates a database containing information about all valid MTPL policies as of a certain date, then transfers it to the traffic police. The array will include data regarding the car (VIN code, chassis number, etc.), taking into account that you should not be tied to your full name, since one person can take out several policies for himself. The Ministry of Internal Affairs will supplement the database with numbers and transfer it to the Data Center.
The result will be a kind of “search base”. If the camera records a car about which there is no information in the database, the system will signal this as a violation. The traffic police will conduct a second check through the insurers about the availability of a current policy. If there is no valid policy, then a decision is made under Part 2 of Art. 12.37 of the Administrative Code, which provides for a fine of 800 rubles, 10 days after recording.
A resolution is issued for each fact of recording. If the results of the experiment turn out to be positive, the camera park will be expanded, but first a detailed analysis of law enforcement practice and appeals will be carried out.
