Appeal

The procedural legislation of the Russian Federation provides for the possibility of car owners protecting their violated rights, including appealing illegally issued fines.
The law allows 10 days to prepare and submit an application to the court. The period is calculated from the moment the person receives notification of administrative liability.

The application shall indicate:

  • full name of the body that is authorized to consider such cases;
  • information about the applicant;
  • table of contents of the document;
  • the content part, in which the applicant reflects the essence of what happened, the circumstances of bringing to administrative responsibility;
  • the motivational part, which contains the normative justification for the illegality of imposing a fine;
  • documentary evidence of your position;
  • the operative part, in which the applicant asks to recognize the administrative materials as illegal and cancel them.

Applying to the court to protect one's interests makes sense in cases where there is indisputable evidence of one's own innocence.

If the applicant relies solely on emotional and oral argumentation, then the court will consider such arguments insignificant and will leave the administrative materials in force.

Who is eligible for free parking?

Disabled people of groups I and II or persons transporting them in their car, car owners transporting disabled children can park for free in Moscow. Benefits also apply to disabled people of group III who have limited ability to move independently, as well as disabled people of group III who received the “Disabled” sign from the bureau of medical and social examination before July 1, 2020.

Separate parking spaces must be provided for cars of disabled people - at least 10% of the total. As a rule, these are the most convenient pockets located at the entrances to buildings.

What are the consequences of non-payment?

It is important to remember that intentional or forced refusal to pay is fraught with penalties, the amount of which does not depend on the region. That is, regardless of where the violation occurred - in Moscow, St. Petersburg or Kazan, the driver will be issued a fine in the amount of 2.5 thousand Russian rubles. If, in addition to everything else, surveillance cameras record his attempt to hide vehicle license plates, then the amount of the penalty will be automatically doubled, amounting to 5 thousand.

It also happens that the owner of the vehicle paid for parking, but for some reason his payment was not recorded (stuck in the application, not included in the report by the parking employee when paying in cash, incorrectly processed by the terminal, etc.) In such situations, the resulting fine can be and needs to be contested, citing receipts for services, which should be kept for 10 days after using the paid parking zone.

The absence of an official cancellation of a fine is grounds for filing a claim with the administrative court at the place of residence.

In such situations, all receipts are attached to the claim, but the filing fee for the contested document is not paid. And in order to avoid such incidents in the future, you should pay carefully, preferring parking meters to paying in cash.

Actions in case of impossibility of paying for parking

If for some technical reason the payment still failed to be made, you should not despair. In this case, you need to call the Unified Contact Center by phone and provide your details: parking lot number (usually it is indicated on the information board) and car number. In this case, the payment attempt will be recorded, and the operator will report the number under which this request was registered. It is generally accepted that in the event of a fine being imposed for non-payment, this number will help to appeal the decision.

Pay for parking using mobile devices

To do this, the driver needs to send an SMS message from a smartphone or any other mobile device to 7757 with a text indicating the number of the parking lot where he is located and the registration number of his car. An asterisk is placed between them as a separator. For example: 1004*006 a 254. This message means that the estimated parking time does not exceed one hour, and fifty rubles will be debited from the driver’s account.

In the case of longer parking, X2 or X3, etc. is added to the text of the SMS message. In this case, the number after the letter X means the expected number of hours of stay where the paid parking sign is installed, and funds will be debited according to this. When fifteen minutes remain until the end of the specified time, the driver receives a message with an offer to extend, if necessary, the duration of the service provided to him.

To do this, he sends a new SMS to the same number with the text: X + a number from 1 to 24, indicating the duration of the stay. The rules also provide for early termination of parking and preservation of funds in the client’s parking account. In this case, the text of the SMS message is limited to one letter S or C, and the saved amount can be used next time.

Difficulties that arise when paying for parking

To avoid problems associated with paying for the time spent in the territory where the “Paid parking” sign is installed (the coverage area of ​​the “Paid services” sign), you should follow simple rules. First of all, since cash payments are not accepted, you must check your mobile phone account in advance and, if necessary, top it up. If you plan to park in a parking lot equipped with a parking meter, it is advisable to purchase a scratch card in advance.

Considering possible interruptions in the operation of the mobile communication system, it is recommended to wait for an SMS message about debiting funds from your account, otherwise misunderstandings may arise. When making a payment, you need to keep in mind that a number of telecom operators charge fees for such services. As a rule, it does not exceed 6.5%, but this should also be taken into account. Finally, some corporate plans do not include advance payments. In this case, if the driver has insufficient funds in his account, he will receive a message that the payment has not been made.
