Proving innocence of violating a double car

The driver will have to convincingly prove his innocence. If you are sure that another car committed the violation, pay attention to the details, prepare visual evidence, present high-quality video and photographs of your car, and point out differences in appearance.

Try to collect information about the location of your car at the time the administrative offense was committed; perhaps it was under cameras in a guarded parking lot or came into view of an office surveillance camera, try to collect all possible information. Testimony of witnesses who can reliably report that the car could not have been at the place where the violation was committed at the time specified in the resolution.

The second option is when a fine is imposed for driving with false license plates.

Driving a vehicle with knowingly false state registration plates entails deprivation of the right to drive vehicles for a period of 6 months to 1 year.

Note: This is a case where a driver was caught driving a car with false license plates while driving it.

Please note that if it turns out that the driver installed and then also drove a car with false signs, then this can be qualified as two offenses (installed and drove). In this case, there will be a fine and deprivation of your driver's license.

In such a situation, there is no need to wait for a printed copy of the resolution; from the moment you find your registration number on someone else’s car in the electronic service, you need to print out a photo of the offender, a photo of your vehicle and make copies of documents for the car.

Having collected a package of documents, go to the nearest police department and write a statement. Save the notification slip that your application has been accepted. Make the same complaint as in case of an erroneous fine and attach a copy of the notification coupon, which will confirm the fact of contacting law enforcement agencies.

If criminal proceedings are initiated, you will be informed of the results. As a result, the fine will be canceled or the complaint will be rejected.

If such fines come regularly, you will have to appeal each one; there is no need to go to the police again. In such a situation, we recommend changing numbers. However, there are alternatives to paying the fine. Since January 2021, the Russian government has made some concessions for drivers who are conscious of their misconduct. When will criminal liability apply?

Please note that it is the person who falsified the license plate - that is, the one who made it - who is punished under criminal liability. The driver driving the car at the moment, even if he is the owner of this car, cannot be automatically recognized as a criminal and punished for fictitious license plates - it is necessary to prove that he was the one who drew on, painted over or otherwise falsified the registration plates. Although, a criminal case may still be opened against him.

There is a separate article for driving with false signs - part 4 of article 12.2 of the Code of Administrative Offenses provides for the deprivation of rights from six months to a year specifically for driving. And part 3 of the same article prescribes a fine of 2,500 rubles for installing false signs on a car.

Thus, we have 3 types of punishments associated with fictitious registration marks:

What are the dangers of driving with false license plates?

When they lose their license plate, some drivers resort to using license plates from other vehicles (they ask them from friends or take them from their other car).

The likelihood of such a vehicle being stopped by police officers is lower, however, if such fraud is discovered, this will lead to serious problems (Article 12.2, paragraphs 3 and 4 of the Administrative Code):

  • fine for an individual – 2500 rubles;
  • an official driving a vehicle with someone else's license plate will pay from 15 to 25 thousand rubles;
  • companies and enterprises will be fined from 400 thousand to half a million rubles.

Additionally, traffic police officers have the right to confiscate the driver’s license from the violator or deprive the right to drive a vehicle for up to a year.

Apart from serious crime, the most common reasons are three:
