Many drivers neglect traffic rules and overtake directly at a pedestrian crossing, thereby endangering not only themselves, but also pedestrians, as well as the vehicle being overtaken; a fine is imposed for such an offense.

All road users, whether drivers or pedestrians, are required to comply with generally accepted traffic rules, which are regulated by law. If the rules are not followed, violators face various fines, the amount of which depends on the severity of the violation.

In this article we will talk about such a problem as overtaking at a pedestrian crossing. Due to the fact that various changes are made to traffic rules every year, the law provides for certain penalties for overtaking at a pedestrian crossing in 2021.

We will tell you further what the size of the fine for overtaking at a pedestrian crossing awaits us in 2021, how to correctly distinguish overtaking from ahead, and how it will be possible to avoid punishment in case of overtaking at a pedestrian crossing in 2019.

Overtaking rules

First of all, when talking about fines for overtaking at a pedestrian crossing in 2019, we need to understand how overtaking differs from ahead, since these concepts mean completely different maneuvers. The ability to distinguish them from each other will undoubtedly help you avoid unpleasant situations in the future.

When driving any vehicle, you must always remember that this is always an increased danger and risk, so you need to control the entire situation happening in your lane, monitor pedestrian crossings and traffic lights, but also do not forget about the oncoming lane.

When overtaking, the driver must ensure that it is completely clear and has sufficient distance to complete the maneuver.

It is also worth remembering the rule that prohibits overtaking multiple vehicles and provides for a fine for overtaking in 2021 in certain situations, which include:

— If a passing vehicle began overtaking before you;

— If the vehicle in front of you intends to turn left (the left turn signal must be on);

— If the car behind you tries to overtake your vehicle.

If such situations do not occur, then the driver is allowed to overtake. The only thing is that the absence of all prohibiting factors does not allow the driver to overtake at a pedestrian crossing. We will tell you below about what this violation threatens the driver with and what fines for overtaking on a pedestrian crossing await us in 2021.

When is it prohibited to perform a maneuver?

In addition to the places where you cannot overtake, there is a list of cases when the maneuver will be dangerous and is also prohibited :

  • When a car that is currently driving in the same lane ahead plans to overtake. At the same time, the driver of that car signals his intention with the left turn signal.
  • The car ahead is already overtaking, or going around some obstacle.
  • If a car that was driving behind in the same lane began to overtake.

The driver should also understand that if, after overtaking, he cannot calmly and safely return to his lane, then overtaking should not be done. This is a direct violation of paragraph 1 of section 11 of the traffic rules, and of course, in addition, it can create an accident, or even more than one, if we are talking about high-speed traffic.

Each motorist must understand that all these rules are not unreasonable, and first of all, when driving, you should take care of the safety of both your own and other drivers.

Fines for overtaking and speeding at a crosswalk in 2021

As we mentioned above, the concepts of overtaking and advancing are different from each other. If you overtake (avoid an obstacle or a stationary vehicle) at a pedestrian crossing, the driver will not be fined, but if he overtakes, then in this situation he will already face a direct fine for overtaking at a pedestrian crossing in 2021.

Just like in other violations of traffic rules, the fine for overtaking at a pedestrian crossing in 2021, recorded by the traffic police inspector on the spot, will be stricter than the one that comes from the cameras.

If an inspector records a violation, the driver risks receiving a fine for overtaking at a pedestrian crossing in 2021 in the form of deprivation of rights for a period of 4 to 6 months. And if the violation is recorded by a camera installed at a pedestrian crossing, the fine will be 5,000 rubles.

If you overtake at a pedestrian crossing again, the driver will be deprived of his license for a whole year. It should also be noted that overtaking at a pedestrian crossing outside a populated area will also be punishable by appropriate fines in 2021.

What exactly is considered a violation?

You can receive a punishment not only when your car, while overtaking another vehicle, entered a zebra crossing. The following situations are also considered a violation:

  • the start of the maneuver less than 5 meters after the zebra crossing;
  • the end of the maneuver is less than 5 meters from the crossing;
  • the beginning or end of a transition maneuver.

Fines

A driver who overtakes a car at a crossing faces a penalty of 5 thousand rubles or deprivation of the right to drive a vehicle for up to six months.

For failure to comply with the rules of advance, the driver will pay a fine from 1,500 rubles to 2,500 rubles. If a driver repeatedly violates this rule within 12 months, he faces a license deprivation of 1 year.

It is worth noting that in practice the court makes the following decision in 98% of cases: deprivation of a driver’s license for such a violation. Getting a fine issued is problematic.

The driver can also be fined for other violations that result from overtaking, such as not allowing a person to cross a crossing - 1,500 rubles;

How to move correctly at a pedestrian crossing

In order not to get into an unpleasant situation and not become the culprit of a violation, and sometimes an accident, you should remember the simple rules of movement at a pedestrian crossing. First of all, always try to slow down before a pedestrian crossing, even if there are no pedestrians planning to start crossing the roadway.

If there are still pedestrians, the vehicle must be completely stopped without entering the pedestrian crossing line. After this, the driver must wait until the pedestrians have completely crossed the roadway and only then slowly start moving. Please note that you need to start driving smoothly, as new people can always suddenly appear on the road.

Failure to comply with the above rules may also result in a fine for the driver. Of course, the fine for such a violation will be several times lower than the fine for overtaking at a pedestrian crossing in 2021, but its cost will still be no less than 1,500 rubles.

Is it possible to appeal

The decision to impose a fine can be challenged by providing the necessary evidence, eyewitness accounts, a detailed description of the road situation and your actions, and DVR camera recordings.

The situation is more complicated with the submission of a protocol on violation to the magistrates for consideration. In this case, you can minimize the punishment by correctly building your argument in court. In this case, it is necessary to rely on the fact that there is no violation, since the recorded violation relates to advancing, not overtaking. However, if the moment of crossing the markings is recorded by recorder cameras or video recordings made by a traffic police officer, the chances of avoiding punishment are extremely small.

Is overtaking allowed under the new rules?

Many motorists might have a question about the fact that since 2017, a change has been made to the traffic rules, which supposedly allows for a maneuver and will relieve drivers of a fine for overtaking at a pedestrian crossing in 2021.

We hasten to disappoint you, but this rule, based on considerations of logic and road safety, simply cannot be canceled. And the change that was made to the overtaking rules applied to drivers of vehicles such as bicycles, mopeds and scooters.

According to the new rules, cyclists and motorcyclists are prohibited from crossing the roadway at a pedestrian crossing directly onto a vehicle. They need to cross the roadway on foot, carrying a bicycle or moped next to them.

Therefore, do not get lost in the wrong assumptions and do not make mistakes, as overtaking at a pedestrian crossing in 2021 can disqualify you for a long time, which is of great value to those who earn money by driving a car.

What is written in the traffic rules?

In the traffic rules, overtaking is given a clear definition, and its difference from ahead. Overtaking is the advance of one or more cars, in which the overtaking person has to move into the lane of oncoming traffic, and then return back to the previously occupied lane.

Overtaking has the following characteristics:

  • When overtaking, the driver must move into the oncoming lane of traffic, which must be free to complete the maneuver.
    This is described in section 11 of the traffic rules, paragraph 1: before overtaking, the driver must make sure that the oncoming lane has sufficient free space, and in the process of performing the maneuver his car will not create any obstacles or dangers for other road users.
  • After passing the overtaken car, the driver immediately returns to his lane, otherwise, instead of overtaking, this will be considered a violation - driving into the oncoming lane.

And it is precisely this approach to oncoming traffic that distinguishes overtaking from ahead.

In fact, overtaking is a special case of getting ahead, because when getting ahead, the driver simply occupies a free lane on the left side of him for some time. And of course, overtaking cannot be done in any place that seems accessible at first glance.

Paragraph 11.4 of the traffic rules clearly describes where overtaking is prohibited:

  1. When passing a pedestrian crossing.
  2. When driving through intersections - both regulated and unregulated. But at intersections that are not regulated, overtaking is prohibited only if the traffic is not on the main road (what is the fine for overtaking at an intersection?).
  3. In places with a railway crossing - at a distance of one hundred meters from it.
  4. When driving through a tunnel, bridge, overpass, overpass and under them (what is the penalty for overtaking on a bridge?).
  5. In areas where visibility is limited by road conditions, for example, at a dangerous bend, at the end of a slope, etc.

How to avoid a fine for overtaking at a pedestrian crossing in 2021?

How to get a fine and not lose your license

The type of administrative punishment for overtaking at a pedestrian crossing in the event of the driver’s disagreement will be assigned by a magistrate. If you get caught with this violation for the second time in a year, then, alas, we do not have any solutions to this situation; in any case, you will be deprived of your rights from 4 months to 1 year.

However, if the violation is yours for the first time, and it was recorded by a traffic police inspector on the spot, then you will still have a chance to avoid a fine for overtaking at a pedestrian crossing in 2021.

To do this, you will need to provide a sufficient number of facts that will help mitigate your punishment in court. Some of the most common reasons that help to avoid deprivation of rights are usually: poor visibility of signs due to bad weather, etc. or an urgent matter due to which the driver was in a hurry, for example, rushing to help a sick or injured person.

Is it possible to avoid punishment?

Still, there are cases when overtaking is allowed and the driver remains unpunished. Eg:

  • the driver unintentionally overtakes in the event of preventing an accident;
  • sudden brake failure or other vehicle malfunction;
  • the driver is driving around a traffic jam, but the road markings are invisible;
  • if a traffic police officer makes gross errors in the administrative violation protocol that do not correspond to reality;
  • if for some reason there are no markings or appropriate road signs on the road.

The decision on deprivation of rights is made by the magistrate. If the violation is committed for the first time, the driver has a chance to remain with his driving license and only pay a fine. To increase his chances of receiving a minimum sanction, the offender can tell the judge about poor visibility of markings or signs on the road or that he failed to stop driving in a permitted area in time. Another argument could be the fact that the driver was in a hurry for an urgent matter (he was transporting a person who needed an ambulance). But, judging by the reviews of drivers, the judge often does not take the last example into account, and to prove the poor visibility of markings and signs, it is recommended to provide photo or video recording of your arguments in court.

Full exemption from fines for overtaking at a pedestrian crossing 2019

There are exceptions in which it is still possible to avoid punishment for such a maneuver as overtaking at an unregulated pedestrian crossing. Such exceptions may include gross errors in the protocol drawn up by the traffic police inspector at the scene of the violation.

For example, if the driver denies his violation, he has the right to demand video recording, which the traffic police officer, in turn, does not have. Also, there may be no witnesses on the roadway who could confirm the violation.

In all these situations, you can safely refer to poor visibility, lack of a properly installed sign, lack of pedestrians, vehicle malfunction, etc. Under such circumstances, it is likely that the court will acquit you and not impose a fine on you for overtaking at a pedestrian crossing in 2021.

What should I do if the fine received from the camera was erroneous for driving on the side of the road?

If a person is forced to drive on the side of the road to avoid an obstacle, the punishment will be less severe. Paragraph 3 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation states that in such a situation the amount of the monetary penalty will be 1000-1500 rubles. If there is a special sign instructing you to go around an obstacle on the right or left, the action will not be considered a violation at all.

If the violation is detected automatically, a fine will still be imposed. In this situation, the citizen has the right to challenge the collection. You must proceed according to the following scheme:

  1. Make sure deadlines are not missed. You have 10 days to appeal the decision from the date of receipt of the relevant document. The period is calculated from the moment the recipient puts the appropriate signature.
  2. Contact the photo and video recording center. To do this, in 2021 a complaint is filed on the official website of the traffic police. The portal has a section “receiving requests”. Here you need to fill out an online form, attaching supporting documentation. An alternative is to enter data into a classic form. In this case, the complaint is submitted during a personal visit to the authorized body.
  3. Wait for the application to be reviewed. The procedure is carried out within 30 days in accordance with the norms of Federal Law No. 59 of May 2, 2006 “On the procedure for considering appeals from citizens of the Russian Federation.” If the situation related to driving on the side of the road is controversial and requires additional consideration, the period can be extended for another 30 days.
  4. Get the answer and read it. If the decision made is not satisfactory, you must go to court. Documentation must be submitted to the district office where the offense was committed. If a citizen considers the court’s verdict to be untrue, he can file an appeal to higher authorities.

Fines for crossing a continuous road

For the implementation of this illegal event, two types of punishment are provided:

  1. Financial penalty equal to 5,000 rubles.
  2. Withdrawal of a driving license for a period of 4 months or more. The time of deprivation increases if a similar violation is repeated and can reach up to 1 year (Parts 4, 5, Article 12.15 of the Code of Administrative Offenses of the Russian Federation).

According to the laws of the Russian Federation, a traffic police inspector does not have the right to confiscate a driver’s license in case of a traffic violation. The driver is obliged to submit the driver's license on his own, subject to the relevant decision of the judicial authority.

The fourth part of Article 12.15 of the Code of Administrative Offenses of the Russian Federation regulates that if a motorist crosses a continuous marking for the first time, then he is subject to a financial penalty. Confiscation of driving license in such situations is rarely carried out, mainly if the offense led to an accident.

You can watch a video about the punishment a driver faces for crossing a solid line.

Overtaking

The exception is the yellow continuous stripe, i.e. a temporarily marked strip, which is most often applied if the road is being repaired or an accident has occurred, etc.

In the future, it is assumed that motorists will not be fined for such traffic violations, but will be immediately deprived of their driving license. Officials believe that tougher penalties could discourage motorists from aggressive driving, which will reduce the number of accidents.

Avoiding traffic jams (obstacles)

In all other options, i.e. If a vehicle is moving in the oncoming lane, such an action is regarded as overtaking.

There are 3 options that do not allow detour:

  • Detour into oncoming traffic on a road with 4 lanes or more traffic.
  • Detour on a 3-lane road surface with access to the far left traffic.
  • Detour with oncoming traffic in front of the railway rails.

In all other cases, detour is permitted. These options include:

  • Detour without crossing continuous markings.
  • A detour into oncoming traffic on a 2-lane road marking or into the central lane on a 3-lane road surface, not in front of the railway rails.

For failure to comply with detour rules, the motorist is subject to a financial penalty of 1,000 to 1,500 rubles.

Driving in the oncoming lane before turning left

Traffic regulations regulate when driving into oncoming traffic is prohibited. In this version, this is reflected in clause 8.6, clause 9.2, 9.3 of the Rules.

If a motorist makes a left turn maneuver, running into two or one continuous stripes, and before making the turn “jumps out” towards the moving stream, then he is liable on the basis of Part 3 of Art. 12.15 of the Code of Administrative Offenses of the Russian Federation, expressed by a penalty equal to 1000 to 1500 rubles and even confiscation of the driving license.

Random intersection of solid

Accidental intersection of continuous markings can include the collision of a car wheel with a marking when turning in a large vehicle. This option also applies to unlawful action regulated by Art. 12.16.1, with a penalty equal to 500 rubles.

Rotate and pivot through a solid line

When turning or turning around through continuous markings, the motorist is subject to a penalty equal to 1,000 to 15,000 rubles (Part 2, Article 12.16).

Most often, such an offense is committed when leaving a parking lot onto a general-purpose road surface. The car owner immediately makes a left turn, instead of turning right, driving to the dotted markings and making a U-turn there.

Definition

According to the current traffic rules for 2021, overtaking is crossing a continuous dividing line in order to avoid a car moving in the same direction. Previously, such a maneuver on a zebra crossing was allowed, but only if there were no pedestrians on it.

At the same time, overtaking should not be confused with the concept of advancing. Overtaking is overtaking the car in front within the lane of passing traffic. This option is most likely on roads consisting of several lanes.

Rules for crossing zebra crossings

When approaching unregulated zebra crossings, the first thing the driver should do is slow down. Then he should make sure that there are no people. If there are pedestrians, they must be allowed through.

To define the concept of letting them pass, the rules use the term “give way.” According to it, the driver is prohibited from performing any maneuvers that could force pedestrians to change direction.

Even if a person has just stepped onto the crossing, not giving him an advantage qualifies as a violation. The situation when the pedestrian has not yet reached the end of the zebra crossing, and the car has started moving, can be assessed in two ways. In this case, the driver will have to defend his position in court. When resolving such controversial issues, car video recorders installed in the car play an important role. Recordings from them can be used in court.

For failure to allow a pedestrian to pass, the driver is subject to a monetary penalty of 1,500 rubles. This measure of liability is prescribed in the Code of Administrative Offenses in Article 12 Part 18.

Also, if the driver sees that other participants have stopped to let people cross, he is obliged to do the same. If the zebra crossing is adjustable, and the traffic light has already turned green, cars finishing the movement will need to let people through.

At the same time, cyclists and scooter drivers are required to cross the road at the zebra crossing in a dismounted state. For failure to comply with this requirement, they may be subject to a fine of 800 rubles.
