When is a fine imposed for driving on the side of the road?

Usually the side of the road is used for stopping. The driver has no right to drive along the edges of the roadway or overtake other vehicles on the side of the road. The ban is imposed by part 1 of article 12.15 of the Code of Administrative Offenses of the Russian Federation. If a person was moving along the wrong side of the road, in 2021 he will be charged a fine of 1,500 rubles.

Repeated driving onto the oncoming side of the road will entail an increase in the severity of the punishment. If the driver’s actions are recorded by cameras, the license will not be taken away, but the fine will increase to 5,000 rubles.

Overtaking on the side of the road is also prohibited in 2021. If the maneuver is performed on the right, Part 1 of Art. 12.15 Code of Administrative Offenses of the Russian Federation. The violator will be fined in the amount of 1,500 rubles. If overtaking is carried out on the left side of the road and a solid marking is crossed, the actions are classified according to Part 4 of Art. 12.15 Code of Administrative Offenses of the Russian Federation. The citizen will be deprived of his rights for a period of 4-6 months or will be required to pay a fine of 5,000 rubles.

Who can drive on the side of the road?

Despite such severe punishment for car drivers and the absolute ban on driving cars on the side of the road, there is a category of transport that has the right to move along this element of the road without fear of getting a fine.

This category includes road service vehicles, as well as loaded trucks. Moreover, trucks have the right to stop at the side of the road if the point where they were transporting goods is located in close proximity to it.

Also, some other vehicles can move along the side of the road if they do not interfere with pedestrians. Among them:

  • bicycles, if the person driving them is over 14 years old;
  • mopeds can also continue driving along the side of the road, paragraph 24.7 (traffic rules) confirms this;

Penalties for driving on the side of the road in 2021

The fine for driving on the side of the road is regulated by Article 12.15 of the Code of Administrative Offenses of the Russian Federation. The regulatory act establishes two types of punishment – ​​a fine and deprivation of a driver’s license. The specifics of their use depend on the nuances of the current situation. If you drive on the right side of the road, the penalty under Part 1 of Art. 12.15 Code of Administrative Offenses of the Russian Federation. A fine of 1,500 rubles is imposed on the violator. Driving on the left shoulder is equivalent to driving in the oncoming lane. The violation is classified under Part 4 of Art. 12.15 of the Code of Administrative Offenses of the Russian Federation, if a continuous marking has been crossed. As a result, the person will be fined 5,000 rubles or deprived of his license for up to 6 months.

If a person, violating the marking requirements, drove onto the oncoming side of the road for the second time within 1 year from the date of completion of the execution of the decision, the violation will be considered repeated (Article 4.6 of the Code of Administrative Offenses of the Russian Federation). As a result, Part 5 of Art. 12.15 Code of Administrative Offenses of the Russian Federation. The driver will be deprived of his license for 1 year. If a violation is detected automatically, a fine of 5,000 rubles is applied.

What kind of driving is prohibited?

According to the rules, the side of the road is used for parking.

On the right side

The driver must neither overtake nor simply move beyond the edge of the roadway. This is directly prohibited by the Administrative Code, Part 1 of Art. 12.15.

The penalty for driving on the wrong side of the road is a fine of 1,500 rubles.

On the opposite side of the road

More severe liability is provided for when driving over the left edge on the following types of roads:

  • the road surface has oncoming traffic with two or more lanes in each direction;
  • a carriageway with oncoming directions, one lane in each direction, separated by continuous markings;
  • a two-lane road with demarcation of oncoming traffic by tram tracks;
  • a three-lane road in two directions, where the middle lane is reverse.

If a traffic police officer detects driving on the opposite side of the road on such roads, the driver will expect:

  • or a fine of 5,000 rubles;
  • or deprivation of rights for a period of 4-6 months.

When a traffic policeman records a repeated violation in the near future, the driver’s license will be revoked for 1 year.

If a two-lane road has no markings or has a broken line. Then the driver stopped on the side of the road will receive a fine of 1,500 rubles.

Penalty for driving on the side of the road

Driving on the right side of the highway is interpreted as a violation of the rules of maneuvering. Driving on the left shoulder of the highway in violation of the markings in 2021 is punishable more seriously. The rules regarding driving into oncoming traffic through a solid lane are regulated by paragraph 4 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation. For violation, a fine of 5,000 rubles is imposed or a driver’s license is deprived for up to 4-6 months.

If the violation is repeated, paragraph 5 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation comes into effect. In this case, the citizen will be deprived of his driver’s license for up to 1 year. However, if the incident on the highway was recorded automatically, the certificate will not be taken away. A fine of 5,000 rubles will be imposed on the violator.

Clause 3 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation reduces the monetary penalty for driving on the left side of the highway to 1000-1500 rubles if the obstacle is avoided. However, in 2021, such a rule does not apply to persons who decide in this way to avoid waiting in traffic jams. In accordance with paragraphs 1.2 of the Russian Federation Traffic Regulations, traffic congestion is not recognized as an obstacle.

What is the punishment?

Motorists stuck in traffic may try to maneuver their way forward. But if the oncoming part of the road is clogged with vehicles or such a maneuver is impossible on this section of the road, the only option left is to go along the side of the road.

It is worth noting that the maneuvers of impatient drivers can create considerable traffic problems for other participants. In the summer, cars, when driving on the side of the road, kick up a lot of dust with their wheels - it complicates visibility, gets into the lungs of other drivers along with the air, and penetrates into the interiors. The driver, having driven some distance along the side of the road, then joins the line of vehicles again. This leads to additional problems when driving, and the traffic jam only increases. Such maneuvers are also dangerous for pedestrians passing along the highway.

Passages for which the driver uses the side of the road are interpreted as a violation of maneuvering. According to Article 12.15 of the Administrative Code, the actions of a motorist are subject to punishment; the fine is 1,500 rubles .

Much more serious punishment will be for those who drive around traffic jams on the left side of the road.

  1. This maneuver involves driving in the oncoming lane. In this case, take into account all the prohibitions provided for by the traffic rules, which are associated with driving on the wrong side.
  2. The prohibition of traffic on the roadsides as a road element is taken into account. Finally, you cannot start overtaking if you are not sure that upon completion of the maneuver the motorist will be able to return to the lane without interfering with other traffic participants (Article 11, paragraph 2 of the Traffic Regulations).

In case of violation, the punishment is determined according to Article 12.15 of the Code of Administrative Offenses (clause 4) and represents:

  • or a fine of 5,000 rubles;
  • or deprivation of the right to drive a vehicle for a period of 4-6 months.

If the offense is committed repeatedly, according to Article 12.15 of the Code of Administrative Offenses (clause 5), the following is prescribed:

  • A fine of 5,000 rubles if the violation is recorded by video recording devices.
  • Deprivation of rights for a year.

It is worth noting that in the event of such a violation, the excuse of a motorist who was avoiding a cluster of cars in the oncoming lane, that he allegedly tried to avoid an obstacle, will not help. Neither traffic jams nor serviceable vehicles stopped on the road are considered an obstacle (Article 1, Section 2 of the Traffic Regulations).

Some of the drivers try to explain their maneuver by saying that they drove to the side of the road to stop, and then could not find a convenient place and were forced to continue driving. But to this, traffic police officers can answer that while looking for a place to stop, you should continue driving in the right lane . Driving along the side of the road, an impatient driver makes other road users nervous, increases traffic jams, and can also provoke an accident.

Who is allowed to drive on the side of the road?

In accordance with clause 12.1 of the Russian Traffic Regulations, parking is permitted on the side of the road on the right side of the road. Driving in this area is prohibited. However, there are a number of exceptions for 2021. The following have the right to drive on the side of the road:

  • cyclists aged 14 years and above, if there is no special path, or it is not possible to ride along it or along the right edge of the road (24.2 and 24.6 of the Russian Traffic Regulations);

Are cars allowed on the side of the road?

First of all, let’s turn to clause 9.9 of the traffic rules:

9.9. The movement of vehicles on dividing strips and shoulders, sidewalks and pedestrian paths is prohibited (except for the cases provided for in paragraphs 12.1, 24.2 - 24.4, 24.7, 25.2 of the Rules), as well as the movement of motor vehicles (except mopeds) on lanes for cyclists. The movement of motor vehicles on bicycle and bicycle-pedestrian paths is prohibited. The movement of vehicles of road maintenance and utility services is allowed, as well as access along the shortest route for vehicles delivering cargo to trade and other enterprises and facilities located directly next to the roadsides, sidewalks or pedestrian paths, in the absence of other access options. At the same time, traffic safety must be ensured.

So, from this point we can draw the following conclusions:

  1. In most cases, driving on the roadside is prohibited .
  2. There are a few exceptions discussed elsewhere in the rules. Some of these points were given earlier in this article (for cyclists, mopeds and horse-drawn vehicles), some will be discussed below.
  3. Vehicles of public utilities and road maintenance services can drive along the roadsides, i.e. vehicles engaged in road maintenance and cleaning.
  4. Cars can drive along the roadsides, delivering cargo to objects located directly next to the roadsides.

As for ordinary passenger cars, in most cases they do not fall into the above list, that is, they cannot drive on the side of the road.

Pulling to the side of the road to stop

Let's consider clause 12.1 of the traffic rules:

12.1. Stopping and parking of vehicles is permitted on the right side of the road on the side of the road, and in its absence - on the roadway at its edge and in the cases established by paragraph 12.2 of the Rules - on the sidewalk.

The car can pull to the side of the road to stop. At the same time, he can cross the solid marking line that separates the side of the road:

1.2 - indicates the edge of the roadway;

Pulling to the side of the road when making a U-turn

Let's consider clause 8.8 of the traffic rules:

If, when turning outside an intersection, the width of the roadway is not sufficient to perform the maneuver from the extreme left position, it is allowed to be made from the right edge of the roadway (from the right shoulder). In this case, the driver must give way to passing and oncoming vehicles.

So, when turning outside an intersection, the driver can start the maneuver from the side of the road if the width of the roadway is not enough for him:

Please note that the rules do not allow crossing the solid markings separating the side of the road when making a U-turn. That is, if the side of the road is marked only structurally (by another coating), then you can start turning around from there. If it is separated by markings, then you cannot drive onto it when you start to turn.

Is it possible to go around a traffic jam on the side of the road?

In 2021, driving around traffic jams on the side of the road is strictly prohibited. It is punishable under Article 12.15 of the Code of Administrative Offenses of the Russian Federation. For driving on the right side of the road, a citizen may be fined up to 1,500 rubles. If driving was carried out on the left side of the road, the action is equated to moving in the oncoming lane. If there is a crossing of a solid road, the citizen may be deprived of his driver's license for up to 6 months or given a fine of up to 5,000 rubles if the incident was recorded by cameras. A repeated violation will result in the removal of the certificate for one year.

A traffic jam is not considered an obstacle. Therefore, driving around it on the side of the road is unacceptable. By leaving the road, a citizen obstructs the movement of vehicles that have the right to move in this zone, and also creates a danger for pedestrians.

For what purposes can the curb be used?

  • for stopping and parking vehicles, but not in the area of ​​the prohibition sign;
  • for the movement of cyclists over the age of 14 years in the absence of a bicycle and bicycle-pedestrian path, or there is no opportunity to move along them or along the right edge of the roadway;
  • Moped drivers are allowed to move along the side of the road if this does not interfere with pedestrians;
  • The movement of horse-drawn carts (sleighs), riding and pack animals is allowed if this does not interfere with pedestrians.

Fine from camera for driving on the side of the road

In 2021, most highways are equipped with automatic recording cameras. They record violations, transmitting the data to the State Traffic Safety Inspectorate of the Russian Federation. This makes it easier to monitor compliance with the rules.

Driving on the side of the road can also be detected automatically. Violation is punishable by a fine. Its size depends on the side of the road on which you were driving. Driving on the right side of the road entails a fine of 1,500 rubles, and driving on the left while crossing a solid road - 5,000 rubles. The punishment is applied in accordance with Article 12.15 of the Code of Administrative Offenses of the Russian Federation.

What should I do if the fine received from the camera was erroneous for driving on the side of the road?

If a person is forced to drive on the side of the road to avoid an obstacle, the punishment will be less severe. Paragraph 3 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation states that in such a situation the amount of the monetary penalty will be 1000-1500 rubles. If there is a special sign instructing you to go around an obstacle on the right or left, the action will not be considered a violation at all.

If the violation is detected automatically, a fine will still be imposed. In this situation, the citizen has the right to challenge the collection. You must proceed according to the following scheme:

  1. Make sure deadlines are not missed. You have 10 days to appeal the decision from the date of receipt of the relevant document. The period is calculated from the moment the recipient puts the appropriate signature.
  2. Contact the photo and video recording center. To do this, in 2021 a complaint is filed on the official website of the traffic police. The portal has a section “receiving requests”. Here you need to fill out an online form, attaching supporting documentation. An alternative is to enter data into a classic form. In this case, the complaint is submitted during a personal visit to the authorized body.
  3. Wait for the application to be reviewed. The procedure is carried out within 30 days in accordance with the norms of Federal Law No. 59 of May 2, 2006 “On the procedure for considering appeals from citizens of the Russian Federation.” If the situation related to driving on the side of the road is controversial and requires additional consideration, the period can be extended for another 30 days.
  4. Get the answer and read it. If the decision made is not satisfactory, you must go to court. Documentation must be submitted to the district office where the offense was committed. If a citizen considers the court’s verdict to be untrue, he can file an appeal to higher authorities.

Fine for driving on the side of the road in Moscow and the Moscow region

Moscow has its own administrative code that applies within the capital. It reflects controversial issues that are not fully defined by Federal legislation. A similar rule applies if the regulation of the problem has been transferred to the jurisdiction of local authorities.

However, the punishment for driving on the side of the road is clearly stated in Article 12.15 of the Code of Administrative Offenses of the Russian Federation. Sanctions will change in accordance with it. Moscow drivers will be punished according to the same standards that apply to car owners from other regions.

The question arises when driving on the side of the road on the Moscow Ring Road. Present here. The shoulder of such a roadway is separated by a solid line. The markings prohibit stopping or driving in the area. A similar rule applies when we are talking about a highway. The traffic rules that all drivers must adhere to are established by Government Decree No. 1090. In accordance with paragraph 9.9 of the document, the movement of vehicles on sidewalks, dividing strips, pedestrian paths and roadsides is prohibited. It is allowed to pull onto the side of the road only to stop or park and only in situations where there are no signs prohibiting this maneuver.

Failure to comply with this rule is an administrative violation and is punishable in accordance with Chapter 12 of the Administrative Code.

On the Moscow Ring Road

The fine for driving on the side of the road in Moscow, including on the Moscow Ring Road, is 1,500 rubles (Article 12.15 of the Administrative Code).

It should be taken into account that along the entire length of the ring road there is a sign 5.3 (road for cars), which prohibits the movement of vehicles such as bicycles and mopeds, which are an exception and can move on the side of the road.

In addition, on the Moscow Ring Road the shoulder is separated by a solid line, and crossing it may result in the imposition of additional sanctions. Driving along a continuous lane or failure to comply with the rules established by road markings is punishable by a fine of 500 rubles (Article 12.16 of the Administrative Code).

If crossing a solid marking line does not lead to a traffic jam, a traffic accident or other negative consequences, then penalties may be replaced by a warning.

On the road

Punishment for driving on the side of the road within a populated area or on a highway, including in the Moscow region, is determined by Article 12.15 of the Administrative Code. Violators of traffic rules are subject to fines of 1,500 rubles.

During a traffic jam

Driving onto the side of the road is prohibited, including to bypass a traffic jam that has formed on the roadway. The amount of punishment is also determined by Article 12.15 of the Code of Administrative Offenses.

In addition to administrative punishment, going to the side of the road to avoid a traffic jam can lead to:

  • to the formation of even greater congestion of the roadway, since violating cars, after making a maneuver, try to return to their lane, which creates additional obstacles
  • to an accident, which will result in property damage and harm to life/health. If, as a result of driving to the side of the road, harm is caused to the health of other drivers, pedestrians, passengers, and so on, the amount of penalties will be increased. In this case, the fine is 2000-2500 rubles
  • to create obstacles for pedestrians, which will also lead to an increase in the penalty to 2,500 rubles

On the opposite side of the road

A separate situation can be identified as a violation in the form of driving onto the side of the road adjacent to oncoming traffic.

In accordance with Article 12.15, Part 4 of the Administrative Code, leaving the left lane and driving along the side of the oncoming lane can lead to:

  • to the imposition of penalties in the amount of 5,000 rubles
  • to deprivation of driver's license for a period of 4-6 months

The type of punishment is determined depending on the method of recording the violation and mitigating/aggravating circumstances.

If the offense is recorded by an automatic security camera, then the punishment, regardless of other circumstances, will be a fine. If the violation was recorded by a traffic police officer, then additional aspects will be taken into account when determining the punishment.

If, as a result of the violation, no one was injured, no interference was created for the movement of other motor vehicles (which is especially important in large cities, Moscow, St. Petersburg, etc.), or other types of violations were not committed, then the punishment will be a fine. In other situations, a decision may be made to impose more severe liability.

It should be borne in mind that the patrol inspector cannot deprive the driver of his license. The issue of deprivation is considered exclusively by the judicial authorities. To transfer a case to court, a protocol is drawn up at the place where the offense was committed, which confirms the fact of violation of traffic rules and is the basis for the court’s decision.

Fine for driving on the side of the road in St. Petersburg and the Leningrad region

Punishment for driving on the side of the road in St. Petersburg and the region in 2021 is also regulated by federal legislation. The violator may be fined 1,500-5,000 rubles depending on the side of the road on which the movement was carried out and the fact of crossing the solid line. Sometimes deprivation of a driver's license is applied. They can be confiscated for up to six months. If a St. Petersburg resident drives onto the side of the road in violation of the markings again, the duration of the punishment will be 1 year. Rights are not deprived if a violation is detected automatically. In this case, the citizen will be fined in the amount of 1500-5000 rubles.

Nuances

We allow you to drive to the edge of the roadway if you need to stop. In this case, no monetary penalty is imposed. We're not talking about a highway. Here the curbs are separated from the main roadway by a solid line. As a result, roadside travel is not permitted regardless of the circumstances.

Reversing onto the side of the road is prohibited. The maneuver creates a danger for other road users. The punishment is applied in accordance with Article 12.14 of the Code of Administrative Offenses of the Russian Federation. The amount of the penalty will be 500 rubles.

If a person drove onto the side of the road and continued driving along it, the offender may be subject to other penalties. Thus, measures can be applied in accordance with Article 12.18 of the Code of Administrative Offenses of the Russian Federation if the driver did not provide an advantage to the pedestrian. The amount of the penalty will be up to 2,500 rubles. If, as a result of the driver’s actions, harm is caused to human health, Article 12.24 of the Code of Administrative Offenses of the Russian Federation comes into force. The fine varies from 2,000 to 25,000 rubles. It all depends on the extent of the injuries caused.

If the driver does not comply with the markings or does not take into account the signs, Article 12.16 of the Code of Administrative Offenses of the Russian Federation applies. It involves a fine of 500 rubles. If a person does not turn on the turn signal, Part 1 of Article 12.14 of the Code of Administrative Offenses of the Russian Federation comes into force. The amount of the penalty is exactly the same as for the previous offense.

When driving on the side of the road in 2021, the degree of danger for the driver and other road users increases. Dust rises and visibility deteriorates. There is not enough good adhesion to the ground. There are often bumps on the side of the road. All this increases the risk of car collisions. If an accident occurs, the person who was driving along the side of the road will definitely be recognized as the culprit of the incident.
