New law on tinting

A bill to change the punishment for tinted car windows was submitted to the State Duma back in 2015. The document assumes that for the first violation the driver will pay a fine of 1,500 rubles; a repeated violation will entail a new fine of 5,000 rubles or deprivation of rights for a period of 1-3 months.

For 5 years it has not changed its status and is under consideration; there is no talk of acceptance or entry into legal force. This means that from January 1, 2021, the fine for tinting will remain the same - 500 rubles.

Article 12.5 of the Code of Administrative Offenses of the Russian Federation

Tinting that does not meet the technical requirements automatically applies to conditions under which the operation of the vehicle is prohibited. In part 3.1 of Art. 12.5 of the Code of Administrative Offenses of the Russian Federation (as amended as of 2021), administrative liability in the form of a fine of 500 rubles .

Just a few years ago, a violation related to excessive tinting of a car could lead to the removal of license plates. Currently, the use of such a measure is excluded and is not provided for by law.

By the way, to pay the fine under Art. 12.5 of the Code of Administrative Offenses of the Russian Federation applies the rule of a 50% discount in the case when the driver makes a payment within 20 days from the date of the decision (see our website for information on the possibility of restoring the missed 20-day period).

The punishment for tinting does not include deprivation of rights and the placement of the vehicle in an impound lot.

Despite the fact that the violation concerns the presence of malfunctions in which the operation of the vehicle is formally prohibited, the inspector does not have the right to detain the car or remove the driver from driving (this is only permissible if there is a malfunction of the brake system or steering mechanism).

According to clause 259 of the 2021 Traffic Police Regulations, the inspector has the right to demand that the violation be eliminated immediately (in other words, tear off the film on the spot). If this cannot be done immediately, the driver is allowed to drive to the nearest service station, taking the necessary precautions.

If it is possible to objectively eliminate the violation, but the motorist refuses to do so, the inspector has every reason to hold him accountable under Art. 19.3 of the Code of Administrative Offenses of the Russian Federation for disobedience to a legal requirement, punishment for such actions may be in the form of administrative arrest.

Window tinting controversy

Perhaps the deputies are not moving on to consider the law because the issue is controversial.

Proponents of tinting give the following arguments in favor of gluing a special film:

  1. Reducing the number of car thefts; items inside the car are not visible from the street.
  2. Reducing conflicts between drivers on the road, no eye contact - no problem.
  3. Reducing the temperature inside the car and optimizing fuel costs; the air conditioner is turned on less often.

What tinting is legal in 2021?

You don’t have to worry about imposing an administrative fine for tinting if the following conditions are met:

  • the light transmission coefficient of the windshield and front side windows is at least 70% for ordinary cars and at least 60% for armored ones;
  • the rear and rear side windows are completely darkened, but not with a mirror film, it creates glare for vehicles moving behind;

Norms and fines for tinting

What is the basis for imposing a fine and what problems exist today? Currently, traffic police officers are actively fighting against violators. Planned events are being held more and more often. There are similar problems with measuring glass throughput. According to GOST 8.831, when measuring pressure, air temperature and humidity should not go beyond the established limits. In addition, the measurement must be carried out 3 times, and the final result is the arithmetic mean of all measurements.

In most cases, the courts take the side of the state inspector and interpret the provisions of the standards in each case differently. Since the fine is small (only 250 rubles when paying with a discount), few people are ready to go and investigate further.

What to do if an inspector stopped you for tinting?

  1. To impose a fine for tinting, measurements must be taken with a special device - a taumeter. This procedure is possible not only in the conditions of stationary traffic police posts. A traffic police inspector can measure light transmission in any place and in any weather conditions using a special sealed, certified device. You have the right to request a certificate for the device and check the seal.
  2. Measurements should be taken in three places on the glass. If the employee received identical data, everything is fine.
  3. Film the entire procedure on a video camera and involve witnesses to participate in the litigation.

If you are nevertheless caught violating the rules, do not rush to remove the tint on the spot. You will still have to pay the fine.

Thus, the new fine for “toner” in the amount of 5,000 rubles turned out to be a myth; to the question “what fine will be issued for tinting?” the answer has not changed - 500 rubles. How is a violation detected?

The traffic police inspector, before bringing the driver to administrative responsibility for tinted windows, is obliged to measure the light transmission with a special device - a taumeter.
If the indicator is below 70%, an appropriate protocol is drawn up. If a strip film is installed on the driver’s front window, then the inspector also has the right to measure its parameters and draw up a protocol if its width exceeds 140 mm.

It should be noted that the inspector has the right to make such measurements and record relevant violations not only at a stationary traffic police post, but also on any section of the road.

The device used by the inspector to measure the percentage of tint must be certified. The technical characteristics of the taumeter, depending on the model and its instructions, must be checked periodically (once a year) by a specialist. Failure to comply with these requirements, as well as violation of the recommended measurement procedure contained in the instructions, may result in the results being invalidated.

There are many models of devices, of which traffic police officers most often use “Svet”, “Tonic”, “Blik-N”. The instructions for these taumeters provide a simple measurement procedure:

  1. The device is brought to the glass and leaned against it (the surface must be clean and dry). For an accurate result, it is recommended to measure the level of light transmission in 2-3 places on one glass;
  2. After a few seconds, automatically generated information appears on the device display.

Most devices (including the models whose names we gave as an example) are capable of measuring the percentage of tint even in the dark. At the same time, there are differences in their operation depending on the temperature conditions. For example, the “Light” taumeter is capable of providing reliable data at temperatures from -40 to +40 degrees, while the “Tonic” is only capable of providing reliable data from -10 to +40. In addition, air humidity also matters: in rainy weather, the Blik-N taumeter will give a more accurate result, since it is capable of operating at air humidity up to 95%.

Does a traffic police officer have the right to remove tint?

Maybe the motorist himself understands that his glass does not comply with GOST, but he is only offended for his desecrated honor, which was encroached on without a special device, not to mention the illegal threats. The law contains those that comply with GOST 5727-88 “Safe glass for land transport. General technical conditions". P.p. 2.2.4. This document states the following: “The light transmission of glass providing visibility to the driver must be at least: 75% for windshields; 70% - for glasses that are not windshields, included in the standard after review P, which determines forward visibility. The light transmission of other non-window glasses is not standardized. Glass with a light transmittance of less than 70% is additionally marked with a V sign. Windshields, painted in the mass and tinted, must not distort the correct perception of white, yellow, red, green and blue colors.”

Any excess of the established standards is a violation, the responsibility for which we will discuss below.

Can a traffic police officer check the light transmission of glass (tinting)

This is perhaps the main question that motorists ask themselves and inspectors. We answer - maybe. But not every traffic police officer. In this case, the main thing is to understand that there is a traffic police service (DPS) and a traffic police unit responsible for technical supervision of vehicles (TS). Both structures are part of the traffic police, but their functions and tasks are different. The work of the first service since September 1, 2009 is regulated by the Administrative Regulations of the Ministry of Internal Affairs for the execution of the state function of control and supervision of compliance by road users with requirements in the field of ensuring road safety (approved by Order of the Ministry of Internal Affairs of the Russian Federation dated March 2, 2009 No. 185) (hereinafter referred to as the Regulations ). The technical supervision division is also guided by this regulation, as well as the Order of the Ministry of Internal Affairs “On approval of normative legal acts regulating the activities of the State Road Safety Inspectorate of the Ministry of Internal Affairs of the Russian Federation for technical supervision” dated December 7, 2000 No. 1240, which approved the Manual on work in the field of technical supervision (hereinafter referred to as the Guidance).

In accordance with clause 5.3. Instructions The traffic police technical supervision unit monitors the design and technical condition of vehicles in operation. Where can I check the tint?

Clause 16.1 of the Manual: “When supervising road traffic, control over the design and technical condition of vehicles can be carried out at stationary posts and police control posts, vehicle checkpoints.

Monitoring of the technical condition of buses following the established route is carried out at the final stations of the routes, bus stations and passenger parking lots.”

I think there is no need to explain the huge difference between “can” and “must”, so there will be nothing illegal if they start checking you not at a stationary post, but at an ordinary mobile technical inspection station equipped in a simple GAZelle.

In practice, there are cases when an inspector, having stopped a car and discovered tint, answers the driver’s question: “What are we going to measure it with?!” — offers to drive to the nearest technical inspection station (STS), where everything will be measured as it should be. In this case, the sheriff’s problems should not worry the Indians, that is, you are not obliged to agree to this, and the inspector does not have the right to forcibly deliver your car to a service station, since we will be talking about detaining a vehicle for which there is no reason, and, In addition, a detained vehicle must be sent not to a service station, but to a special parking lot (popularly called an impound lot). True, the inspector can call a technical supervision officer to the site with the necessary technical means, and there’s nothing you can do about it, you’ll have to wait.

How to check tint

Light transmission of glass is carried out only with the help of certified technical diagnostic tools included in the State Register of the type of measuring instruments that have been tested in accordance with the established procedure (clause 14.3.11 of the Manual). These currently include the following devices:

• “TONIK” (NPF CJSC “Meta”, Zhigulevsk); • “BLIK” (RADIANT LLC, St. Petersburg); • “SVET” (FSUE NII PT “RASTER”, Veliky Novgorod).

What is the verification method?

Here GOST 5727-88 will come to our aid again. In accordance with clause 4.7. in which the light transmittance of vehicle glass is measured at three points on each sample . This paragraph also refers us to another GOST - 27902-88 “Safety glass for cars, tractors and agricultural machines. Determination of optical properties". Art. 1 of this GOST establishes the test conditions:

• Temperature = 15 to 250 C • Pressure = 86 to 106 kPa • Relative humidity = 40 to 80%

A little hint. Failure to comply with at least one of the parameters gives every reason to win in court.

What are they punished for?

Fans of tinting are “sentenced” under Part 1 of Art. 12.5 of the Code of Administrative Offenses of the Russian Federation “Driving a vehicle in the presence of malfunctions or conditions under which the operation of the vehicle is prohibited.” The list of malfunctions and conditions (many are often indignant, saying that tinting is not a malfunction, forgetting about such a concept as “conditions”) is contained in the appendix to the Traffic Rules of the Russian Federation. The price of the issue is a fine of 100 rubles, but traffic police officers prefer to go further: they will charge you for tinting right on the spot, otherwise - the number plates will be rolled up (banned operation) and the vehicle will be detained.

A clear example of the mass lawlessness of traffic cops: on the eve of the celebration of the millennium of Kazan, in order to reduce the traffic load, people's cars were seized in batches and put in impound lots because of tinting. At the same time, they explained their actions by instructions from above, and therefore complain wherever you want: our roof is excellent, it will not give offense.

So there are no grounds for detaining a vehicle, even if it is heavily tinted. Well, the list of grounds for detaining a vehicle and prohibiting its operation does not yet include Part 1 of Art. 12.5 Code of Administrative Offenses of the Russian Federation! I understand that traffic cops want to squeeze those who love dark windows, and sometimes this desire awakens in everyone who has seen a motorcade with flashing lights, but why engage in arbitrariness? How should a protocol be drawn up?

Protocol on an administrative offense under Part 1 of Art. 12.5. The Code of Administrative Offenses of the Russian Federation has the right to be drawn up by both a traffic police inspector and an inspector of the technical supervision unit. The corresponding powers are enshrined in Part 1 and Part 4 of Art. 28.3 of the Code of Administrative Offenses of the Russian Federation, as well as by Order of the Ministry of Internal Affairs of the Russian Federation of June 2, 2005 No. 444. Since a technical device was used to detect an offense, the protocol must contain information about it: type, brand, certificate number, information about the verification of the device, as well as the measurement method and the readings of the device at the time of measurement (Part 2 of Article 26.8 of the Code of Administrative Offenses of the Russian Federation ).
