Fine for washing (parking) a car on a river, lake, sea (reservoir) (Article 8.13 or 8.42 of the Code of Administrative Offenses of the Russian Federation)

Where is it prohibited to wash a car?

Federal laws do not list places where car washing is prohibited. The Code of Administrative Offenses only limits washing near water bodies and in forests. Other places are listed in regional codes:

  • areas near bodies of water, such as rivers and lakes;
  • embankments;
  • yards;
  • children's and sports grounds;
  • pedestrian paths;
  • streets;
  • public spaces: squares, squares, parks;
  • forests;
  • agricultural land.

According to the sanitary rules of Moscow, the car cannot be washed or cleaned throughout the city, with the exception of specially designated areas.

Lawyer of "Pravo Group" German Kuts The legislator prohibits washing cars in the wrong place in order to avoid harmful consequences: the formation of dirt on the roads, harm to the environment from detergents and petroleum products washed off from the car body - they go into the soil or water bodies.
In winter, the sink creates ice that can cause you to slip on it. Therefore, when the owner purchases a car, he must understand that he can wash it only in special places, and not wherever he wants.

Prohibitions on car washing specified in regional laws

In each individual region of the country, local authorities determine their own list of prohibited and permitted places for washing cars. Such regulatory documents provide more accurate answers:

  • in which places it is forbidden to wash vehicles according to the law;
  • what places serve as specialized facilities for washing cars and equipment;
  • how such sinks should be equipped in accordance with norms and standards.

Today, in almost all localities it is prohibited to wash vehicles in the following public places:

  • courtyards of multi-storey buildings;
  • on streets, squares, public areas;
  • in recreation areas and forested areas;
  • closed areas of residential complexes;
  • near children's and sports grounds;
  • close to water intake structures.

It should be noted that for violation of regional laws, each city has its own amount of fines, which is several times higher than the cost of visiting a car wash. If one visit to a specialized car wash complex costs the owner 200-350 rubles, then the minimum fine established in one of the provincial towns is 2 thousand rubles, and in the capital it is 5 thousand. But washing off dirt from a vehicle near the coastline of rivers and lakes can cost 40 thousand rubles.

Where can you wash your car?

At the car wash. At the stations, wastewater does not enter the soil and water bodies. Car washes are required by law to treat water before it goes down the drain. Therefore, you can wash your car at the station without harming the environment.

On your own territory. Theoretically, you can wash your car in your garden or in your personal garage. In this case, the owner of the territory himself is responsible for pollution and the entry of chemicals and petroleum products into the soil. To avoid consequences, it is better to install sewer drains with filters and ensure that water does not flow out of the territory - this will be a direct violation of the law.

Publication of relevant acts by local government bodies

Federal legislation allows for some generalizations, inaccuracies, and gaps in legal acts. Local authorities are forced to issue additional regulations to fill the gaps. Authorities at the level of:

  • regional;
  • regional;
  • regional;
  • urban;
  • rural

Usually, such an offense (for washing a car in a common yard) is fined, thereby replenishing the local budget.

Examples of punishments

First example. The car owner washed the car in a courtyard in the capital or St. Petersburg. He will pay a fine of 3 thousand rubles. up to 5 thousand rubles.

Second example. For damaging a city park or public garden in this way, the culprit will pay 40 thousand rubles.

Similar acts are issued by self-government bodies at both the city and regional levels. Some rural residents naively believe that this measure cannot affect them in any way. They are deeply mistaken. If a car owner washes his car right on a village street, he will also have to pay a fine.

It's important to understand. You can wash your car in your own yard, but waste water should not get into your neighbors’ plots.

Conclusion: you can’t wash cars yourself anywhere except in your own yard. Fines will be imposed if it is discovered that the car was washed:

  • in a park area;
  • within the street;
  • in the park;
  • in the local area, near an apartment building;
  • within a housing complex;
  • by the pond.

What are the penalties in case of violation?

For violating sanitary standards. Washing a car in the wrong place can be considered a violation of sanitary standards. For individual entrepreneurs and companies, it is possible to suspend activities for up to 90 days.

For washing a car by a pond. The Administrative Code has two articles related to car washing near rivers and lakes:

  • use of the waterway in violation. Art. 8.42 of the Administrative Code is relevant for those who have a summer cottage near water. The fine for washing in this case is higher: for a citizen - up to 4,500 rubles, for a director or individual entrepreneur - up to 12,000 rubles, for a company - up to 400,000 rubles.

For washing a car in the forest. The company's activities may be suspended for 90 days.

Regional fines. Local laws govern car washing in other prohibited areas. Fines vary in different cities. If a fine is not established in the city, penalties for violating sanitary standards will apply.

I wash my car by the river or in the yard: what will happen to me?

What happens if you wash your car near a river?

First, let's figure out why you can't wash your car in rivers and other bodies of water. The rules and norms of behavior near bodies of water are primarily regulated by the corresponding document - the Water Code of the Russian Federation, and it contains direct prohibitions on washing and even on access to the shore. Part 8 of Article 6 of the Water Code specifies that “every citizen has the right to use ( without the use of mechanical vehicles

) the coastal strip of public water bodies for movement and stay near them.”
And paragraphs 4 and 5 of paragraph 15 of Article 65 clarify that within the boundaries of water protection zones the movement and parking of vehicles (outside paved roads), as well as the washing of vehicles, are prohibited
. Many people do not know what a water protection zone is: in fact, these are territories that are adjacent to the coastline of water bodies. Thus, driving to the shore of a reservoir, much less washing a car there, is prohibited by law.

The punishing document in this case will still be the Code of Administrative Offences, but not Chapter 12, which is familiar to motorists, but Part 1 of Article 8.42. It states that “the use of the coastal protective strip of a water body, the water protection zone of a water body in violation of restrictions on economic and other activities entails the imposition of an administrative fine on citizens in the amount of 3,000 to 4,500 rubles

. In 2021, there was talk of tightening fines to 20-50 thousand rubles, but so far this initiative has remained at a theoretical level. But even for 3-4.5 thousand you can already order not a wash, but detailing, so trying to save a few hundred by polluting a reservoir is definitely unjustified.

What happens if you wash your car in the yard?

With car washing in the yard, everything is somewhat different: it is controlled not by federal legislation, but by regional authorities. The Code of Administrative Offenses has Article 6.4, which controls violations of sanitary and epidemiological requirements for operation, including transport, but in practice it refers to sanitary standards for transporting products, transporting children, and so on. Therefore, to understand the dangers of washing a car in a yard, you need to refer to the local laws of the region in which you are located. For example, in Moscow this is the Moscow City Code on Administrative Offences, Article 8.8 of which states that washing vehicles outside specially designated areas entails a warning or the imposition of an administrative fine on citizens in the amount of 1,000 to 3,000 rubles.

Is it possible to wash a car at the dacha or in the yard of a private house?

There is no legal ban on washing a car on your own property, so the only legal option to save on washing is to carry out the procedure in the courtyard of a private house or country house. The main limitation here is not to overdo it with detergents and other chemicals, so as not to cause inconvenience to neighbors, who may also call the police.

Fines for washing a car in the wrong place

According to existing legislation, washing a car is allowed only in designated areas. The main goal of the government decree is to bring cleanliness to the country and not create unsanitary conditions in courtyards and public places. If a motorist decides to wash his car on the shore of a reservoir, then he must pay a certain fine:

  • 500-1000 rubles for individuals. persons;
  • 1000-2000 rubles for officials;
  • 10,000-20,000 rubles for legal entities.

Washing within city limits creates unsanitary conditions. Yards fall into the category of such places and violators will face a severe fine of up to 5,000 rubles. This applies not only to individuals, but also to officially registered car washes, which will be located in areas prohibited for washing. The fine for washing a car in the yard has increased. Previously, this amount ranged from 500 to 2,500 rubles, but now the amount of the fine has doubled and can reach up to 5,000 rubles .

Local authorities did not limit themselves to punishment for car washing in an unequipped place. They provided for punishment in the form of a fine for:

  • throwing out garbage from any vehicles;
  • creation of unauthorized dumps near the roadway.

Previously, there was a fine of up to 1,000 rubles for littering. Currently, this amount has become up to 3,5000 rubles, and even more for officials. Its size is up to 10,000 rubles.

Where you can and cannot wash your car according to the law

For example, local laws in specific areas may define sports and playgrounds, residential areas, and sometimes areas adjacent to water intakes and wells as prohibited areas for car washing. In such regions, drivers who dare to violate the established restrictions will be forced to pay a fine.

Thus, in order to find out whether car washing is prohibited in a certain place and the courtyard of a residential building in particular, it is necessary to refer to the legislative framework of a particular region.

One of the most acceptable options is a car wash, the owner of which provides the equipment and water supply. Similar in nature are asphalt sites in an industrial zone, which, as a rule, are equipped with a drainage system and a water supply system with running water. Both of these options are ideal, but not numerous.

The legislation provides for administrative penalties in the event of a negative impact on hydrophytic objects (including lakes and rivers) due to human actions. The Code of Administrative Offenses of the Russian Federation finds that washing a car near rivers has a similar effect that can cause irreversible damage to the environment, in particular to every body of water.

Therefore, to determine possible measures, it is better to refer to regional regulations. Regional regulation Almost every subject of the Russian Federation develops and puts into effect laws or other regulations that relate to environmental protection and city improvement issues.

Causes

Some people wonder why if you washed a vehicle in the yard, you will have to pay a fine. After all, drivers believe that such a procedure does not harm anyone. However, this is not the case, and now we will explain why.

The fact is that machine dirt contains gasoline, various petroleum products, road dust, and oil. All this harms the environment and directly people, since unhealthy substances can evaporate into the air, which the residents of the house then breathe. It is also worth noting that special cleaning products are used for the procedure. And they, in turn, are also extremely unhealthy and can harm human health. In addition, dirty liquid flows onto the asphalt, and then children play on it.

It is also worth noting that cleaning a car in a private area is also highly undesirable. Because, firstly, the person and his family will then inhale harmful substances. If water from the surface of the vehicle flows onto the garden plot, then because of this the soil may deteriorate and plants may die. It is also worth thinking about your neighbors, because if they are also affected by the harm caused by washing in the wrong place, then at least it will be dishonest towards them. Chemicals can really do a lot of harm to gardeners.

General rules

Motorists washing their cars can be found in parks, garages, near houses and rivers.
Many drivers do not pay attention to complaints from passers-by or neighbors, because there is no direct prohibition on “cleaning” a public place in federal laws. It is this misconception that is the reason for numerous fines, which vehicle owners then have to pay to the state budget. Indeed, there is no article in the Code of Administrative Offenses of the Russian Federation that would talk about assigning responsibility for washing a car. However, the driver’s use of public places, especially rivers, city parks or playgrounds, violates the general rules of environmental protection, which are established in the following acts:

  • Federal Law “On Environmental Protection” 2002;
  • Federal Law “On Sanitary Epidemic Well-Being...” 1999.

The 2002 Law defines the general principles of environmental protection and the presumption of danger from any activity potentially harmful to the environment. In accordance with the Federal Law of 1999, it is prohibited to carry out activities that harm the health of people and their living environment. In addition, these federal laws establish a general rule regarding the liability of persons who, through their actions, endanger human health and the environment.

The following articles of the Code of Administrative Offenses of the Russian Federation establish indirect responsibility for car washing:

  • Art. 8.13, which establishes the inadmissibility of violating the rules for the protection of water bodies if this may lead to their pollution;
  • Art. 8.42, according to which it is unacceptable to use the coastal strip of a water body in violation of restrictions on economic activity or the requirements of SanPiN;
  • Art. 6.3 about the abuse of sanitary and epidemiological norms.

These rules apply to any actions that may negatively affect the environment and potentially harm the population.

Note. When brought to justice under Articles 8.13, 8.42, 6.3 of the Code of Administrative Offenses of the Russian Federation, it does not matter whether the motorist pollutes the territory in which he washes the car or not. It is enough to confirm the very fact of creating a threat to the environment.

Advice for car owners

  • Remember the list of places that are prohibited for car washing purposes: courtyards, streets, public places.
  • When improving the appearance of a car near your private home, do not forget about your neighbors: watch out for dirty water drains, which should not be directed to the neighboring area; do not use a lot of automotive chemicals.
  • Never wash your car closer than 50 meters to a body of water. The width of the water protection zone is determined in each specific case, but 50 meters from the reservoir is always prohibited.
  • Choose the most optimal washing option for yourself: do it yourself near an individual home, use car wash services, or visit a self-service car wash. Then your car will always sparkle, and you will be clean before the law.
