The fine for dirty license plates is regulated by Article 12.2 Part 1 of the Code of Administrative Offenses of the Russian Federation. In some cases, Part 2 of the same article applies, when the readability of the license plate is deliberately reduced, in which case the driver faces a fine of 5,000 rubles or deprivation of the right to drive a car for a period of 1 to 3 months.

Situations with the government numbers, when the motorist faces an administrative fine in the amount of 5,000 rubles or deprivation of rights for a period of 1 to 3 months (Part 1 of Article 12.2 of the Code of Administrative Offenses of the Russian Federation):

  1. not readable due to a layer of dirt stuck on;
  2. covered with snow, ice;
  3. the number is attached in the wrong place;
  4. partially contaminated.

All options listed apply only to moving vehicles.

Room pollutants are usually:

  • dirt from the roads;
  • snow, ice;
  • foliage;
  • bitumen;
  • paper;
  • polyethylene film.

If the driver manages to prove the fact of natural pollution of the state. sign, then he can get off with a warning or a fine of 500 rubles for dirty license plates. Otherwise, another punishment is imposed.

Fines for driving with false license plates

According to current legislation, the owner of a car with fake license plates, if the fact of driving is recorded, can be deprived of his driver's license for a period of 6 to 12 months. The imposed fine for installing fake numbers is 2,500 rubles for individuals, and from 400 thousand to 500 thousand rubles for companies. In this case, the traffic police may initiate a criminal case related to fraudulent activities and deliberate misleading of law enforcement agencies.

When is a room considered dirty?

According to the note to Article 12.2 of the Code of Administrative Offenses of the Russian Federation in 2021, the state license plate on any vehicle is considered unreadable if at least one symbol is not visible during the day at a distance of 20 meters (this applies equally to the rear and front plates). At night, only the rear license plate, which is illuminated, falls under this criterion.

It is not considered a violation if the records on the state are not completely read. number “RUS” and “transit”, as well as a flag icon.

In fact, the criteria are clearly outlined, but in reality, controversial situations often arise on this issue between the driver and the traffic inspector. When stopped by an inspector regarding dirty license plates, if the car owner behaves correctly, the problem can be resolved peacefully, without imposing a fine.

How to determine the readability of a number

The Code of the Russian Federation on Administrative Violations clearly defines the criteria for determining an unreadable car license plate:

  • During the day or during daylight hours, the front and rear numbers are considered unreadable if it is not possible to see at least one letter or number within 20 meters.
  • In the dark, at night, according to the law, the license plate number cannot be read if it is not possible to identify at least one sign at a distance of 20 meters.
  • Contamination of the white background while letters and numbers are fully legible is not a violation.

That is, each driver can independently check the condition of the license plates and eliminate the violation using a simple wet cloth or sponge, which should always be in the car. You can also water the room.

How will the legibility of a license plate be determined? What are the standards? Answers in this video:

Fine for intentionally dirty or sealed license plates

When a driver is convicted of deliberate actions that impede the recognition of license plates, then in 2021 they are charged with Part 2 of Article 12.2 of the Code of Administrative Offenses of the Russian Federation. Then the inspector has the right to issue a fine of 5,000 rubles. or draw up a protocol on the deprivation of a driver’s license for a period of 1 to 3 months.

This refers to the sealing of signs with some materials that distort visibility: film, mesh, plastic, dirt, paper, etc.

What to do if stopped by an inspector

If your dirty license plates do not escape the attention of the inspector, you face a fine of 500 rubles or a warning. What punishment the traffic police officer decides to apply depends on his mood and your behavior.

Ask a Question

Some have encountered the fact that unscrupulous traffic cops are trying to equate a dirty license plate with its absence. This is argued by the fact that since the sign is not visible, then it does not exist at all. This is a “scam” and an attempt to impose a more severe punishment on you, since the lack of license plates entails a fine of 5,000 rubles or deprivation of your rights. Be vigilant - if there are numbers, although they are not visible due to a layer of dirt, no one can fine you for their absence.

When communicating with a traffic police officer, behave calmly and politely. Do not try to swear and argue - this way you will definitely not be able to avoid a fine. When you learn about a dirty room, you will be surprised, complain about your carelessness, and agree with the inspector’s claim.

Get out of the car and wipe the license plate with a rag or snow. If the traffic cop has not yet managed to photograph them, then he has no right to fine you - after all, the numbers are clean and in fact there is nothing to fine you for.

Car stop

If the traffic police officer is still going to draw up a report and impose a fine, politely remind him of Article 2.9 of the Russian Code of Administrative Offenses. It states that for a minor offense, the person who committed it can be released without punishment, having received only a verbal warning. But this, of course, is at the discretion of the official.

Dirty license plates are really a minor offense, because there were no gross traffic violations on your part (if they were dirty unintentionally). Weather conditions can serve as a mitigating factor - when the roads are dirty and slushy, it is even more difficult to keep track of the cleanliness of license plates. Even for a conscientious driver, they can become unreadable again in a matter of hours.

Important! Unreadability of license plates on a stationary car cannot result in any punishment. Only the driver of the moving vehicle can be fined for this. This is often used by motorists in large cities who are trying to avoid paying for parking and hiding their license plate number from parking cameras.

Fine for dirty or illegible parking plates

Penalties under the law regarding license plates that are not subject to identification only apply to vehicles in motion. If the car is parked or in a parking lot, then there can be no claims against it.

In 2021, the car owner is not responsible for dirty or unreadable state license plates. numbers on the car if he does not use it for its intended purpose.

However, a parked car with or without license plates may be evacuated to an impound lot due to the ongoing fight against terrorism. After identifying the car owner, he may also be fined for parking in the wrong place or for failure to pay for a parking space in a paid parking lot.

Parameters for fixing a dirty number

As noted, having a dirty vehicle license plate is an offense that is punishable by a fine. The state number must be clearly visible both day and night from different angles. There are specific criteria for license plate contamination. Situations arise when the number is readable, but there is a violation with subsequent punishment. These include:

  • A situation where a dirty license plate is completely visible from a 20-meter distance, but it cannot be captured with photo or video equipment;
  • There is very heavy soiling on one side of the license plate. In this case, the symbol sticks out and, if desired, is quite visible, but since it is covered with a layer of dirt, this situation is considered a violation.

Procedure for imposing a fine for dirty license plates

When moving along the roadway and noticing an inspector waving his baton on the side of the road, you should stop immediately. Otherwise, the driver faces a fine for opposing a law enforcement officer.

The inspector must immediately introduce himself and present his identification (clause 45 of Order of the Ministry of Internal Affairs No. 664 of October 20, 2017). He will then ask for documents for the car and driver's license, and also explain the reason for the delay - in this case, it is an unreadable number. It is not rational to argue in such a situation. If you show understanding and correct the problem immediately, you can only get by with a warning from the police.

Sometimes no arguments work and a traffic police officer begins to write a report on an administrative offense and imposing a fine for dirty license plates. He attaches the corresponding photo or footage from the video to the document. The resolution is written in two copies, one of which is given to the driver and explanations are given regarding payment of the fine, as well as the consequences for failure to pay on time.

The driver has the right to indicate his disagreement in the protocol in order to have the opportunity to challenge the punishment in court in the future. It is advisable to personally photograph the numbers, the surrounding area and the inspector himself.

A protocol on an administrative offense is drawn up on the basis of the regulations of Article 28.2 of the Code of Administrative Offenses of the Russian Federation.

How can you avoid punishment?

Many people manage to escape punishment. First, you should follow the instructions presented above. Respectful communication and an adequate response contribute to resolving the conflict in favor of the car owner. Secondly, it is advisable to wash the rooms before the inspector indicates the need for this action.

Assessment of contamination is subjective. According to the rules, a traffic police officer must move 20 meters away and determine how visible the information is. There he takes a photo, which is attached to the protocol. In fact, while the inspector is leaving, the driver has time to at least wipe the state sign. Also, the car owner has the right to disagree with the specialist’s assessment, indicating this in the protocol. In this case, it is also recommended to take a photo with clean numbers.

Rules for drawing up a protocol

Fill out the administrative violation report manually or print it out. It contains the following information (Part 2 of Article 28.2 of the Code of Administrative Offenses of the Russian Federation):

  • date and place of the incident;
  • Inspector's name and position;
  • personal data of the citizen against whom charges are being brought for driving with dirty license plates;
  • initials and other information (address, telephone) of persons involved as witnesses;
  • regulations that were violated;
  • explanations of the offending driver regarding this fact (in this line it is allowed to enter the driver’s disagreement with the fact of dirty license plates, so that in the future the punishment can be challenged in court);
  • applications in the form of photographs and stills from video shooting.

Witnesses are invited to prove that the license plates are unreadable from a distance of 20 meters. Their testimony is entered into the protocol. Such people can be passengers, even if they are related to the driver and are considered interested parties. According to Article 25.6 of the Code of Administrative Offenses of the Russian Federation, interest can only be attributed to attesting witnesses, experts and others (this does not apply to witnesses).

It is advisable for the driver to personally photograph the license plates and attach them to the procedural document. This will be additional evidence of the car owner’s innocence.

After this, the traffic police officer must hand over the protocol to the driver for review against signature. If necessary, certain amendments are made (Part 4 of Article 28.2 of the Code of Administrative Offenses of the Russian Federation) by the inspector or the defendant. Then the signature of the employee who compiled the document is affixed. If the driver and witnesses refuse to sign after familiarization, this fact is recorded in the protocol (Part 5 of Article 28.2 of the Code of Administrative Offenses of the Russian Federation).

The protocol on imposing a fine for dirty license plates in 2021 is written in two copies, of which one is given to the driver (Part 6 of Article 28.2 of the Code of Administrative Offenses of the Russian Federation) and explanations are given regarding payment of the fine, as well as the consequences for failure to pay on time (Part 3 of Art. 28.2 Code of Administrative Offenses of the Russian Federation). This is recorded in the protocol.

Which number is considered unreadable and dirty?

A fine for driving with dirty license plates is imposed if at a distance of 20 meters it is impossible to read all the numbers and letters without errors. Unreadability of license plates may be due to a number of reasons:

    • dirt due to bad weather conditions;
  1. paint wear;
  2. mechanical damage to the sign;
  3. intentional damage to the license plate by applying drawings or other symbols.

Note that assessing readability is subjective. In some cases, dirty numbers are visible at a distance of 20 meters, and sometimes almost clean signs are not detected even at a closer distance.

What should a driver do if the traffic police stops a car for having unreadable license plates?

In the spring and autumn, drivers being stopped due to dirty license plates is a standard occurrence. If this happens, then there is no need to argue with the traffic police officer and show aggression. If the inspector has not yet recorded the numbers, it is recommended to quickly clean them with a damp cloth. When the violation is eliminated, then, in fact, there can be no claims.

If the inspector continues to insist on his opinion and intends to begin drawing up a protocol, then proceed as follows:

  1. They remind you of Article 2.9 of the Code of Administrative Offenses of the Russian Federation, which states that in case of a minor administrative offense, the accused person can be released from liability and be limited only to a verbal warning.
  2. Take a photo of the state yourself. signs to confirm that they are legible. The photographs are attached to the protocol. The driver can also make his amendments in the following form: “I was detained by a traffic police inspector (full name) for dirty license plates, which I consider unauthorized, since registration plates are visible. This is confirmed by photographs taken immediately after the vehicle stopped. I ask that the paperwork regarding this matter be discontinued due to the absence of an offense.”

It should be remembered that traffic inspectors are quite adequate people, but until they start being rude. Therefore, the driver’s tone should be calm, and his arguments should be weighty. It is important to immediately admit your guilt and promise to monitor the condition of the rooms in the future. Then the issue will be resolved without issuing a fine.

When cleaning registration plates on a car, it is unacceptable to use dry rags, paper or hard brushes. This leads to the paint rubbing off. Then the inspector will have a new reason to impose a fine, but under a different clause of the article of the Code of Administrative Offenses.

Ways to avoid administrative responsibility

So, driving with unreadable license plates is fraught for drivers with administrative liability in the form of a fine. Following simple rules will allow you to avoid the traffic police officer issuing a fine for unreadable license plates in 2018-2019. They are given below:

  • When leaving, it is worth looking at what appearance your license plate has, whether it is not subject to mechanical stress, and whether it is clean;
  • You should always carry a rag or napkin with you, which can be used to wipe off dirt if necessary. Very often, traffic inspectors, in addition to issuing a punishment, require immediate cleaning of the license plate. And most likely, you will not be released until the room is cleared;
  • When the weather outside is dirty, it is worth stopping periodically to rest and inspect license plates;
  • You should not wipe license plates with dry rags, because dry dirt has a bad effect on license plates. This will cause it to wear off or become scratched, so use only wet cloths. This will ensure the cleanliness and safety of your vehicle's license plates.

In a situation where it was not possible to avoid being stopped for a violation, it is worth trying to solve the problem through ordinary human communication. It is quite possible that it will be possible to get by with just a warning. The main thing here is not to be rude to the traffic police inspectors and comply with their requirements for cleaning the license plate. Moreover, the unreadability of a license plate is a rather subjective concept; it all depends on the visual acuity of the traffic police officer. If the violation was not recorded by traffic police officers on photo or video equipment, and the license plate was promptly brought into proper form, then the violation will not be able to be proven.

In addition, if you are a law-abiding citizen and have no offenses or traffic fines, then you can focus the inspector’s attention on this. It is quite possible that you will be able to do without a fine.

In case of a real violation not caused by climatic factors, that is, in the case of deliberate complete or partial concealment of a car’s license plate, punishment will follow immediately and a fine will be imposed. There is nothing you can do about it, and the only way is to pay for it. If it comes to drawing up a protocol, then it is important not to sign it without first reading all the data specified in it, and, perhaps, make some amendments in your favor.

Appealing a fine for dirty numbers

Many citizens are interested in how to appeal a fine imposed by the traffic police for dirty license plates in 2021. According to the current legislation, such a possibility is provided for, according to which there is a choice of government body where you can apply for the protection of your rights. In our case, this is the court or the traffic police.

A complaint can be filed directly against a traffic police officer by addressing it to management. It is sent by registered mail with notification and a list of enclosed documents. If there is time, then visit the inspection in person and submit a written complaint to the secretary. You can also do this through the State Services portal.

Appealing the decision to impose a fine under Art. 12.2 of the Code of Administrative Offenses of the Russian Federation is permissible within 10 days from the date of receipt of the document in hand (Article 30.3 of the Code of Administrative Offenses of the Russian Federation). The traffic police considers such applications within 3 days, in court – up to 2 months.

The complaint must be accompanied by documentary facts confirming the driver’s innocence (a certificate of weather conditions, a photo of the license plate being viewed and an inspector nearby). There is no standard sample application for appealing the actions of a traffic inspector, since each case is individual and has its own nuances. But you can consider a universal form of complaint, which it is recommended to rely on.

When appealing a fine for dirty numbers in 2021, you can use the example below for writing a complaint.

Head of the Department of the Main Directorate of the Ministry of Internal Affairs of Russia for Moscow

Kovalenko Viktor Anatolyevich

From Timoshenko Vladimir Viktorovich

Living at the address: ………………………………………

Complaint

On unauthorized actions of a traffic police inspector

I, Timoshenko V.V., February 12, 2021 at about 9:00 p.m., driving a car of brand …….. with state registration. number ………….., moving in the direction from Znamenka Street to Mokhovaya Street, was stopped by a traffic police officer (his badge is …….) in the area of Mokhovaya Street, building 7-8. The inspector introduced himself illegibly, and without announcing the reason for the delay, demanded to see the license and documents for the car. Only after my request, he gave the reason for the stop - dirty license plates, which contradicts Art. 12.2 part 1 of the Code of Administrative Offenses of the Russian Federation.

After presenting the documents, he immediately began drawing up a protocol on the administrative violation. The inspector's name and position were illegible on it.

I consider the protocol unfounded based on the following:

1. I cited bad weather, as it was wet snowing and snow removal machines were working. So the rooms got dirty while moving and I was ready to clean them on the spot. My application was ignored. 2. According to the note to article 12.2 part 1 of the Code of Administrative Offenses of the Russian Federation state. The number is considered unreadable if at least one character in the background is not visible at night at a distance of 20 meters. Due to the movement of my car in the dark and taking into account the location of the patrolman, he could not assess the degree of readability of my license plates.

Considering the above facts, on the basis of Art. 30.1 of the Code of the Russian Federation on Administrative Offenses, I ask:

1. Stop the paperwork on this administrative offense dated February 12, 2021. 2. Consider the complaint without my presence. 3. Send the response in writing to my residence address, in accordance with the deadlines required by law. Please send a copy of the court decision by email...... 4. If my complaint is not satisfied, please indicate the procedure for making a court decision.

Applications:

1. Copy of the resolution. 2. Materials confirming the illegality of the actions of the traffic police officer.

Date Signature (decryption)

Applications not to appeal a fine for dirty rooms can be found here.

It is impossible to answer unequivocally whether it is worth complaining about a fine issued regarding dirty rooms. If the driver is confident that he is right, then he must defend his position to the bitter end. When there has been an offense, there is no point in appealing.

When considering such cases in court, it should be taken into account that if the evidence base is equivalent on the part of the motorist and the road service inspector, the court usually takes the side of the government body. But multiple examples from practice suggest that a competent approach to the matter and a properly compiled evidence base produces positive results. It is advisable to involve a professional lawyer in the process.

Do video cameras read dirty license plates?

Despite the fact that the range of fines issued not by employees, but by cameras, is growing from year to year, it is impossible to receive a “letter of happiness” because of dirty license plates. This is all connected with the same necessary analysis on the ground. Even if the camera is set to a distance of 20 meters, there is no guarantee that its lens is not damaged by weather conditions. Therefore, the video camera assessment is not considered correct.

Note that dirty license plates are often even exempt from some fines that are recorded on camera, including speeding. If the registrar does not recognize the state sign, then it is not able to determine the culprit. There is a violation, but there is no one to punish for it.

Some motorists claim that the cameras transmit information about dirty license plates to the nearest traffic police post, and there the inspector begins to wait for the careless car owner. There is no official evidence of this, but even if a traffic police officer stopped the car, it is always permissible to refer to bad weather and the fact that the license plate was dirty recently.

How to avoid a fine for dirty license plates in 2021?

To avoid problems with traffic police, you should keep your registration plates clean and follow basic safety rules:

  1. Always have wet wipes on hand to wipe license plates frequently. In addition, when stopping, the inspector may ask you to clear the sign.
  2. Get into the habit of checking license plates every time you stop for a long time.
  3. In bad weather (blizzard, rain, snowfall), try to stop every 10 km and inspect the state. signs.

In winter, it is recommended to pre-wet a cloth with a special anti-freeze liquid and then wipe off the dirt. This will prevent damage to the number.

Amount of fines

For driving with an unreadable license plate, a fine of 500 rubles is provided. However, in addition to being unreadable, the sign may be deliberately hidden, and in this case the driver will no longer be able to limit himself to just a warning. He faces either a fine of 5,000 rubles or deprivation of rights for 1–3 months. The line between these two concepts is very thin and, unfortunately, is determined only at the discretion of the traffic cop.

When communicating with the inspector, try to do everything so that he does not suspect you of deliberately concealing the license plate number. Behave calmly, politely, follow his instructions and recommendations, try to clear the license plates as quickly as possible. However, if the license plates were covered with snow, mud, clay or leaves, then this is unlikely to escape the eyes of an experienced employee.

Money and cars

Interesting! On the Internet, it is common to sell aerosol cans with “dirt” to simulate a dirty car. Sellers actively urge not to use a means to hide license plates, but for what other purpose can one intentionally dirty a car is unclear. By using this method, cunning people run an even greater risk of receiving a large fine or losing their license.

Article 12.2, part 2 for license plates: how to avoid deprivation and receive a fine?

At night, license plates are considered unreadable if it is impossible to see at least one letter or number of the rear license plate from a distance of 20 meters.

Please note that in the dark, the check is carried out only for the rear registration plate of the car, of which every letter and number must be visible. In this case, the condition of the front number plate is not taken into account.

For example, if the back number plate is perfectly clean, and one digit on the front number is stained with dirt, then the car number plates will be considered readable at night. During daylight hours, exactly the same numbers will be unreadable.

You should remember these features so as not to receive a traffic police fine for unreadable numbers.

In this case, everything is quite simple. Before starting your trip, walk around the car and inspect it from all sides. If necessary, simply wipe the dirty number.

Note. It is not recommended to wipe the numbers with a dry cloth, because... in this case, along with the dirt, the black paint applied to the numbers and letters will quickly be erased.

I recommend using wet wipes for wiping, which you can buy for 20-30 rubles at any hardware store. Usually one napkin is enough to restore one unreadable license plate to normal. If the layer of dirt on the license plates is so large that a napkin cannot cope, then it’s time to wash the car at a car wash.

All license plates on cars are made in accordance with GOST and must be clearly visible at any time of the day or night. These are the legal requirements that drivers must comply with for good readability of numbers and letters.

The number is considered unreadable if the following conditions are not met:

  • During the day and during daylight hours: letters and numbers on both the front and rear license plates are clearly legible from 20 m;
  • At night and in the dark: all symbols on the rear number plate only must be readable from 20 m.

If the license plate is smeared with dirt or one of the letters or numbers on it is poorly visible, hidden by something, or the paint on it has been erased, then it is automatically considered unreadable. This is a traffic violation that carries a fine. So, what is the traffic police fine in 2021 for a dirty license plate?

The driver is responsible for an unreadable license plate. So, on the basis of Article 12.2 Part 1:

If the license plate on the car is not legible, is non-standard, or is installed in violation of mandatory requirements, then a fine of 500 rubles or a verbal warning is provided.

Bad weather is no reason not to wipe your license plates. However, in such situations, traffic police inspectors are usually less picky about ensuring that the rooms are perfectly clean. So, if the roads are dirty, then it is enough to check and wipe them before each departure, or stop to wash them if the trip is very long. In such cases they will be more or less visible and not dirty. If they are not monitored for a long time, this will lead to an administrative fine.

The number may also be unreadable in cases where drivers deliberately cover it completely or only one number or letter. Such violations are punished more severely. So, on the basis of Art. 12.2 part 2:

If the car does not have a license plate or it has been modified using secondary means, due to which it cannot be read and identified, then a fine of 5,000 rubles or deprivation of rights for 1-3 months is provided.

Some drivers believe that in bad and rainy weather inspectors do not have the right to stop a car for unreadable license plates, check and issue fines. To challenge such cases, confirmation and receipt of a conclusion on the weather forecast from Phobos will be required, which does not necessarily indicate 100% rainy weather, but, for example, variable precipitation. The court may also not consider such evidence to be significant. Therefore, when stopping, it is better to immediately wipe the dirty number and continue on.

Since state signs on vehicles are used for their registration, issued to car owners by the traffic police directly during vehicle registration, there can be no talk of driving without license plates. It is also prohibited to use those signs that do not comply with the unified Russian standard, even if their serial number fully corresponds to that entered in the general database.

In 2021, a number of changes were adopted regarding traffic rules. Certain adjustments were also made to the procedure for issuing license plates, according to which now this will be managed not only by the State Traffic Inspectorate, but also by certified car dealerships. In addition, drivers will no longer be able to use the car before it is registered, as was previously the case with a 10-day period for registration.

What about motorcycles, do the penalties also apply to two-wheeled vehicles of category A? The law speaks of the equivalence of penalties, regardless of what transport category we are talking about. The exception is mopeds, trams and trolleybuses moving along a specific route, while in all other cases you will have to prepare 5 thousand rubles or not go onto the public road.

Completely different rules apply to vehicles parked in parking lots, parking lots and impound areas.

In this case, the absence of license plates does not entail penalties for the motorist.

However, the previously prescribed restrictions come into force again as soon as the driver starts the engine and drives out onto the public road, so static is the only excuse for not receiving a fine.

Many drivers do not consider a trailer to be a full-fledged vehicle, and believe that signs alone on the tractor, which can be almost any technically sound vehicle, will be more than enough. In fact, this is a gross violation, and the owner of the trailer will pay for it in full, paying 5 thousand rubles the first time and losing his rights the second time.

The parameters for “unreadability” of a state registration plate are not specified in traffic rules or other regulatory documents, but directly in the Code of Administrative Offenses of the Russian Federation.

If from a distance of 20 meters it is impossible to recognize at least one of the characters (no matter letters or numbers) of the license plate (both front and rear) during daylight hours, or the rear license plate from a distance of the same 20 meters in the dark, the license plate is considered unreadable .

That is, in the dark, claims to legibility by the inspector can only be made against the rear license plate.

The only legal way to deal with dirt on license plates is timely cleaning. So, when driving long distances in bad weather, it is a good idea to stop every 100 kilometers, get out of the car and wipe the license plates. The sign must be clearly legible.

Attention! The use of plexiglass is strictly prohibited, although previously this was the most popular way to protect license plates.
