What is the fine for not allowing a pedestrian to pass?

If a pedestrian had to change their trajectory or speed because of a car, the owner of this car will be fined from 1,500 to 2,500 rubles.

The traffic police officer decides what amount of fine to impose. He will look at the driver's violation history. If the motorist has already received a fine for such a maneuver or is a persistent offender, they will most likely issue a maximum fine of 2,500 rubles. If there are few violations or no similar offenses are noticed on the driver, they will issue a minimum fine of 1,500 rubles.

When is a fine issued for not allowing a pedestrian to pass?

In almost all cases, when a pedestrian appears on the roadway, the driver is obliged to give way to him. Let's consider all the situations described in the traffic rules:

  1. at a pedestrian crossing;
  2. when turning at an intersection;
  3. when entering and leaving the adjacent territory;
  4. for not allowing blind pedestrians to pass;
  5. for failure to pass on the way to public transport;
  6. on the side of the road - there the pedestrian should not be disturbed by riders on horses.

Where is the driver required to let pedestrians pass?

According to current traffic regulations, the driver must give way to pedestrians in the following situations:

  1. At a pedestrian crossing. Regardless of whether it is a controlled crossing or not, every driver knows that according to paragraph 14.1. it should not interfere with people walking along the zebra crossing.
  2. When turning at an intersection. In 2021, clause 13.1. Traffic regulations require a motorist making a right or left turn to give way to all persons crossing the road on foot. This rule applies even to situations where: - there are no crossing markings on the roadway; - the vehicle is moving along the main road; - the driver drives through a green traffic light, which allows him to turn in the right direction; - a warning light came on for people walking, but they did not have time to complete the maneuver.
  1. When entering and leaving the adjacent territory. Clause 8.3. clearly states the responsibilities of the driver, whose movement is in one way or another connected with the adjacent territory: - when leaving the adjacent area, you must not create any kind of interference with pedestrians and vehicles already on the roadway; - when leaving the road, priority is given to those road users whose movement path is crossed by the car, including pedestrians.
  1. Blind pedestrians. Clause 14.5. Traffic regulations in 2021 establish the obligation to give way to blind pedestrians who signal their intention to cross the road with a white cane. They have the right of way on the road in all cases. Even if representatives of this category of people are not at the zebra crossing, they must be allowed through.
  2. Public transport. Clause 14.6. The traffic rules require drivers to give way to passengers walking towards or leaving a vehicle moving along a strictly designated route if all three conditions are met: - the bus or other transport is at a specially designated stop; -the doors to which passengers approach are located on the side of the roadway; - suspended transport is considered a route (and is not, for example, a bus delivering employees of a private company). Passengers disembarking or boarding a tram have priority in all cases.
  1. On the side of the road. Pedestrians moving along the side of the road must also give way in accordance with paragraph 4.1. Traffic regulations, but only in the absence of specially equipped sidewalks and pedestrian paths.

Fine for repeated failure to allow a pedestrian to pass

There is no such fine. A violation is considered repeated if it is repeated within a year. If a driver fails to let a pedestrian pass three times in a year, the punishment will not increase; the second and third time there will be a fine in the same amount.

Violated - pay!

What traffic fine will be imposed (what will happen) for not giving way and not letting a pedestrian pass? A fine is imposed in any case, regardless of whether you failed to let a pedestrian pass at a pedestrian crossing or simply at an intersection with a traffic light. For such an offense, the law provides for administrative punishment ( Article 12.18 of the Code of Administrative Offenses of the Russian Federation ). If you fail to give way to a person at a crossing, you will have to pay 1,500 rubles .

Please note that from January 1, 2021, you can pay half the amount of the fine if you manage to do this no later than 20 days from the date of the decision.

When can you avoid a fine for failure to pass a pedestrian 2021

Let's consider situations where a driver has an advantage over a pedestrian. If an accident occurs, the motorist will be innocent.

A pedestrian crosses the road at a red traffic light. At traffic lights, pedestrians are prohibited from crossing to red.

The pedestrian was riding a bicycle. When crossing the road at a pedestrian crossing, the cyclist must step off onto the sidewalk and walk.

When driving in unequipped places. Without a pedestrian crossing, the road can be crossed at right angles to the edge of the road. It is prohibited to linger on the road or interfere with the passage of cars. This is stated in the traffic rules, in the section for pedestrians.

If the car owner's DVR records a pedestrian intentionally stopping on the road, this will help avoid a fine.

When crossing the road in prohibited places. A pedestrian can cross a road where there is no dividing strip or fences. But if a two-way road is separated by markings, a curb or a concrete barrier, crossing it is prohibited. If an accident occurs, the pedestrian will be in the wrong. This is written in the traffic rules.

To prove innocence will help:

  • DVR. The recording can be shown to the traffic police officer who stopped you for the violation. If he refuses to look, later attach them to the complaint and submit to the traffic police;
  • photo and video materials from the camera. Often a traffic police officer looks at only one photo and decides whether to issue a fine. At the Center for Automated Recording of Administrative Offenses in the Field of Traffic (CAFAP), you can obtain the entire series of photographs and even video recordings, if the camera has the technical capability.

Responsibilities of a pedestrian

Often it is pedestrian traffic participants who provoke emergency situations on the road. Without thinking about the consequences, people cross the road in the wrong place. They don’t even look around, thinking for some reason that they should be let through in any case.

It is especially sad when parents do this, passing their children across the road, endangering themselves, the child and the drivers.

Every pedestrian should know that he is obliged:

  • cross the street only at pedestrian crossings;
  • follow the traffic light signal at a controlled intersection;
  • You can only cross the street at an angle of 90°;
  • You can cross the street only after making sure that there are no cars nearby;
  • Before you step on a zebra crossing, you need to slow down and notify traffic participants of your intention to cross the street.

For those who do not comply with these rules, the new traffic regulations provide for the following penalties:

  • violation that did not result in an emergency – 500 rubles;
  • the violation resulted in interference with the car - 1000 rubles;
  • the violation resulted in minor damage to the health of another traffic participant - 1,500 rubles.

Important! If, while crossing a zebra crossing, you notice a moving ambulance, fire truck or police car with a siren and flashing lights, you need to give way.

How a pedestrian's refusal to cross a zebra crossing is recorded by cameras

The cameras are located at intersections where pedestrians are most often hit. The device calculates the trajectory of the car and the pedestrian as soon as the car is in its visibility range. If the camera notices that a pedestrian has changed speed, direction or stopped, the driver will receive a fine. The Moscow Traffic Management Center (TCOC) announced this on its official Twitter account.

In this case, file a complaint with TsAFAP, where there should be an expanded set of materials - best of all, a video recording that will allow you to study the situation in dynamics. And based on the results of the review, the inspector may agree that there is no violation and cancel the fine.

What to do if you receive a fine for not allowing a pedestrian to pass

Depending on the situation, there are three options: challenge the fine, pay half or the entire amount.

Challenge the fine. The driver has the right to appeal the decision of the traffic police, even if the basis for the fine was photo and video materials from traffic cameras. Reasons why a fine can be challenged:

  • the traffic camera made a mistake - the car had the wrong license plate or the pedestrian was too far away;
  • the markings or sign were not visible - for example, due to fog or snowfall;
  • the driver was absent from the scene of the violation.

The driver can appeal the decision within 10 days from the date of the document. The date can be viewed on the paper order or when checking the “Traffic Police Fines”.

The grounds for appeal are best supported by the dash cam footage. Write it down on a flash drive or disk and submit it to the traffic police officer along with your complaint. If the traffic police refuses, the driver has the right to go to court

Pay with a discount. If the driver agrees with the ruling, he can save on paying the fine. The law allows you to pay a fine with a 50% discount in the first 20 days from the date of the decision. If a driver receives a fine of 2,500 rubles for not allowing a pedestrian to pass, in the first 20 days he can only pay 1,250 rubles.

Pay the full amount. If the letter arrived late and the driver received the letter for 21 days, he has another 40 days to pay the fine, but at full cost.   1. Giving way to a pedestrian means stopping and not moving so that his speed and trajectory do not change.
  2. The fine for not allowing a pedestrian to pass is from 1,500 to 2,500 rubles.
  3. You can receive a fine if you do not allow a pedestrian to pass at a crossing, on the side of the road, when entering and leaving the adjacent territory, as well as for not allowing a blind pedestrian to pass.

  6. The deadline for paying a fine for not allowing a pedestrian to pass is 70 days from the date of the decision.

In Russia, the number of collisions with pedestrians on zebra crossings continues to grow. Moreover, the vast majority of such accidents are caused by drivers who ignore traffic rules and do not allow pedestrians to pass.

“We have to note with regret that, despite the ongoing preventive work and tougher penalties, the number of accidents involving collisions with pedestrians directly at pedestrian crossings continues to grow,” said the Chief State Road Safety Inspector of the Russian Federation, Colonel-General of Police Viktor Kiryanov. “In just four months of this year, more than 4.5 thousand such cases were recorded in the country—an increase of 2.5 percent.” As a result, 232 people died under the wheels of cars and 4,578 were injured. Some of these people may be disabled for life."

“Today, and the statistics I cited confirm this, pedestrians remain the most unprotected group of road users,” Kiryanov said. “They will not be able to feel safe on the road until every, and I emphasize, every driver remembers one simple rule - a pedestrian must be allowed to pass.” Then the number of such accidents will immediately decrease significantly.”

“Since the beginning of this year alone, over 3.7 thousand collisions with pedestrians on zebra crossings have occurred due to the fault of vehicle drivers - an increase of almost 5 percent. As a result, 188 people died, which is 20 percent less than a year earlier, but still a huge figure,” the general noted. “These people who became victims of reckless drivers left behind families, small children, friends who are missing them so much now.”

However, according to him, some of the accidents - approximately one in nine - were also due to the fault of pedestrians themselves, who failed to properly assess the situation and provoked an accident. As a result, 41 pedestrians were killed and another 531 were injured.

“I would like to once again appeal to all road users - pedestrians and drivers. Be extremely careful on the road, do not rush, because your family and friends are waiting for you at home. Pedestrians, do not rush to cross the street when it turns red. Drivers, slow down when approaching pedestrian crossings, because it will take a few seconds, but perhaps it will save more than one human life,” said the head of the State Traffic Inspectorate. “After the penalties for failure to allow a pedestrian to pass at a pedestrian crossing were tightened, we were all able to see that pedestrians began to be allowed to pass much more often. The main thing now is that all drivers without exception start doing this, and then our roads will truly become safer,” he concluded.
