Legal norms - 2021 for conducting pre-trip medical examinations of drivers

It is noteworthy that the pre-trip medical examination of drivers is simultaneously regulated by several (not contradictory) regulatory sources:

  • by order of the Ministry of Health of the Russian Federation dated December 15, 2014 No. 835n;
  • letter of the Ministry of Health of the Russian Federation dated August 21, 2003 No. 2510/9468-03-32;
  • by order of the USSR Ministry of Health dated September 29, 1989 No. 555.

In addition, some aspects of pre-trip medical examinations of drivers are regulated by Art. 23 of the Law “On Road Traffic” dated December 10, 1995 No. 196-FZ.

The object of regulation of these legal acts partially coincides (and if we talk specifically about the pre-trip examination of drivers, it coincides completely), but the main document, the provisions of which employers should study, can be considered the most recent - Order of the Ministry of Health No. 835n.

Let us note that in all of these sources of law published by the Ministry of Health, there are provisions that require employers to use a special registration log to record the results of the pre-trip medical examination of drivers. Moreover, only the order of the USSR Ministry of Health No. 555 contains the recommended form of this journal.

So, the most recent of these regulations regulating the conduct of medical examinations of drivers is Order No. 835n of the Ministry of Health of the Russian Federation. Its provisions are also relevant for 2021.

Driver medical examinations

All employees responsible for ensuring road safety (RTS) know about the need to conduct medical examinations of vehicle drivers, but not everyone fully understands what medical examinations exist and why they are needed at all. In this article we will analyze all the nuances of medical examinations of vehicle drivers. To begin with, I will explain why vehicle owners are required to conduct medical examinations of drivers, and what the law prescribes in this regard.

Article 212 of the Labor Code of the Russian Federation dated December 30, 2001 No. 197-FZ, states that the employer is obliged :

  • ... in cases provided for by labor legislation and other regulatory legal acts containing labor law norms, organize, at their own expense, mandatory preliminary (upon entry to work) and periodic (during employment) medical examinations, other mandatory medical examinations, mandatory psychiatric examinations of employees, extraordinary medical examinations...

Federal Law “On Road Traffic Safety” dated December 10, 1995 No. 196-FZ. Article 20:

Legal entities and individual entrepreneurs operating vehicles are obliged to:

  • organize, in accordance with the requirements of this Federal Law, the Federal Law of November 21, 2011 No. 323-FZ “On the fundamentals of protecting the health of citizens in the Russian Federation”, carrying out mandatory medical examinations and measures to improve vehicle drivers’ skills in providing first aid to victims of road accidents incidents.

Article 23 of the Law “On Road Safety” states that medical support for road safety includes, among other things:

  • mandatory preliminary, periodic (at least once every two years), pre-trip and post-trip medical examinations.

From an analysis of federal laws, we conclude that the employer is obliged to organize mandatory medical examinations of drivers. As we can see, Article 20 of Law 196-FZ refers to Federal Law No. 323-FZ “On the fundamentals of protecting the health of citizens in the Russian Federation.” It is there, in Article 46, that the types of medical examinations of drivers are more specifically described:

  • preliminary medical examination carried out upon admission to work in order to determine the compliance of the employee’s health status with the work assigned to him, as well as upon admission to training in the case provided for in Part 7 of Article 55 of the Federal Law of December 29, 2012 No. 273-FZ “On Education in the Russian Federation” Federation";
  • periodic medical examination carried out at established intervals for the purpose of dynamic monitoring of the health status of workers, timely identification of the initial forms of occupational diseases, early signs of the impact of harmful and (or) hazardous production factors of the working environment, the labor process on the health status of workers in order to form risk groups for development occupational diseases, identifying medical contraindications to certain types of work;
  • pre-shift, pre-trip medical examinations carried out before the start of the working day (shift, flight) in order to identify signs of exposure to harmful and (or) dangerous production factors, conditions and diseases that interfere with the performance of work duties, including alcohol, narcotic or other toxic intoxication and residual effects of such intoxication;
  • post-shift, post-trip medical examinations carried out at the end of the working day (shift, flight) in order to identify signs of the impact of harmful and (or) hazardous production factors of the working environment and the labor process on the health of workers, acute occupational disease or poisoning, signs of alcohol, drug or other toxic intoxication.

Let's look at each type of mandatory medical examination of drivers separately.

Preliminary medical examination

Why is a preliminary medical examination necessary? Article 46 of Federal Law No. 323-FZ “On the fundamentals of protecting the health of citizens in the Russian Federation” states that a preliminary medical examination is carried out:

  • ...in order to determine the compliance of the employee’s health status with the work assigned to him...

The employer is obliged to organize a preliminary medical examination. Clause 6 of Appendix 3 of the Order of the Ministry of Health and Social Development of the Russian Federation dated April 12, 2011 No. 302n “On approval of lists of harmful and (or) hazardous production factors and work, during the performance of which mandatory preliminary and periodic medical examinations (examinations) are carried out, and the Procedure for conducting mandatory preliminary and periodic medical inspections (examinations) of workers engaged in heavy work and work with harmful and (or) dangerous working conditions,” reads:

  • Responsibilities for organizing preliminary and periodic examinations of employees rest with the employer .

A preliminary medical examination is carried out when hiring a driver, that is, before concluding an employment contract with him (see article “Hiring vehicle drivers” ). This is stated in paragraph 3 of Article 23 of the Federal Law “On Road Traffic Safety”:

  • Mandatory preliminary medical examinations are carried out for persons hired as vehicle drivers.

This is also stated in Article 328 of the Labor Code of the Russian Federation:

  • An employee is hired for work directly related to the movement of vehicles after a mandatory preliminary medical examination .

The same thing is in Article 213 of the Labor Code of the Russian Federation:

  • Workers engaged in work with harmful and (or) dangerous working conditions (including underground work), as well as in work related to traffic , undergo mandatory preliminary (upon entry to work) and periodic (for persons under the age of 21 years old - annual) medical examinations to determine the suitability of these workers to perform the assigned work and prevent occupational diseases.

Preliminary medical examinations are carried out in medical organizations. Clause 7 of Article 23 of the Federal Law “On Road Safety” states:

  • Mandatory preliminary and periodic medical examinations are carried out in medical organizations of the state, municipal and private healthcare systems that have a license for medical activities to provide relevant services (perform work).

The preliminary medical examination is carried out at the expense of the employer. This is stated in paragraph 5 of Article 23 of the Federal Law “On Road Safety”:

  • Mandatory medical examinations specified in paragraph 3 of this article are carried out at the expense of the employer .

So, the sequence of passing the mandatory preliminary medical examination of drivers is as follows:

  • Before concluding an employment contract, the employer issues the person applying for work a referral for a medical examination at a medical institution;
  • In a medical institution, a medical report is made in two copies. One copy is given to the driver to provide to the employer, the second remains in the medical institution;
  • The employer pays for the services of conducting a preliminary medical examination.

Periodic medical examination

As the name of this type of medical examination suggests, it must be carried out periodically . This is stated in Article 46 of Federal Law No. 323-FZ “On the fundamentals of protecting the health of citizens in the Russian Federation”:

  • periodic medical examination carried out at established intervals for the purpose of dynamic monitoring of the health status of workers, timely identification of the initial forms of occupational diseases, early signs of the impact of harmful and (or) hazardous production factors of the working environment, the labor process on the health status of workers in order to form risk groups for development occupational diseases, identifying medical contraindications to certain types of work.

The purpose of conducting periodic medical examinations is to timely identify signs of diseases and medical contraindications to the performance of driver duties. This is stated in Article 46 of the Federal Law “On the Fundamentals of Protecting the Health of Citizens in the Russian Federation.”

What is the frequency of mandatory periodic medical examinations of drivers? According to paragraphs 16 and 17 of the Procedure for conducting periodic inspections of the Order of the Ministry of Health and Social Development of the Russian Federation No. 302n:

  • Employees driving ground vehicles undergo a medical examination - once every 2 years;
  • Employees under the age of 21 undergo periodic examinations - annually.

In all other respects, a periodic medical examination is no different from a preliminary one. It is also carried out in licensed medical organizations. The employer sends the driver for inspection. One copy of the report is kept in the medical institution, the second is given to the employer. The medical examination is carried out at the expense of the employer.

Pre-trip and post-trip medical examination

I will once again quote the paragraphs of Article 46 of Federal Law No. 323-FZ “On the fundamentals of protecting the health of citizens in the Russian Federation,” which explains in detail the purpose for which pre-trip and post-trip medical examinations of drivers are carried out:

  • pre-shift, pre-trip medical examinations carried out before the start of the working day (shift, flight) in order to identify signs of exposure to harmful and (or) dangerous production factors, conditions and diseases that interfere with the performance of work duties, including alcohol, narcotic or other toxic intoxication and residual effects of such intoxication;
  • post-shift, post-trip medical examinations carried out at the end of the working day (shift, flight) in order to identify signs of the impact of harmful and (or) hazardous production factors of the working environment and the labor process on the health of workers, acute occupational disease or poisoning, signs of alcohol, drug or other toxic intoxication.

Who needs pre-trip and post-trip medical examinations? In accordance with Article 23 of the Road Safety Law:

  • Mandatory pre-trip medical examinations are carried out during the entire time a person works as a driver of a vehicle, with the exception of drivers driving vehicles traveling on calls from emergency services.
  • Mandatory post-trip medical examinations are carried out during the entire time a person works as a driver of a vehicle, if such work involves the transportation of passengers or dangerous goods.

So, we determine the most important things for mandatory pre-trip and post-trip medical examinations:

  • since, according to the Law “On Road Traffic Safety”, a driver is a person driving a vehicle, pre-trip medical examinations must be completed for all persons driving vehicles owned by a legal entity or individual entrepreneur, regardless of the person’s position or status;
  • pre-trip medical examination is carried out before the start of the working day (shift, flight);
  • post-trip medical examinations are carried out for drivers transporting passengers or dangerous goods .

Who should conduct pre-trip medical examinations and where? According to paragraph 8 of Order of the Ministry of Health of the Russian Federation dated December 15, 2014 No. 835n “On approval of the Procedure for conducting pre-shift, pre-trip and post-shift, post-trip medical examinations”, pre-trip and post-trip medical examinations are carried out:

  • medical workers with higher and (or) secondary vocational education, a medical organization or other organization carrying out medical activities (including a medical worker on the employer’s staff), if they have a license to carry out medical activities that involve performing work (services) on medical examinations (pre-trip, post-trip), medical examinations (pre-shift, post-shift).

Based on this, pre-trip and post-trip medical examinations can be carried out by:

  1. Medical workers of a medical organization;
  2. Medical workers on the employer's staff;
  3. Medical workers with higher or secondary vocational education;
  4. Organizations licensed to carry out medical activities to conduct pre-trip and post-trip medical examinations.

As a rule, medical organizations already have licenses to conduct medical examinations of drivers, and in order to organize medical examinations it is enough to conclude an agreement with a medical organization for the provision of this type of service. In this case, the disadvantage is that medical examinations must be carried out on the territory of the medical institution, which may be located at a considerable distance, and in this case it is necessary to think about the transportation of workers to the medical institution and back. The second option for organizing medical examinations for drivers involves conducting them on the employer’s premises. The difficulty here is that initially it is necessary to organize a medical office, hire an employee and obtain a license to carry out medical activities to conduct pre-trip medical examinations. Each employer determines which method of organizing medical examinations to choose based on its capabilities. The main thing is to always remember that pre-trip medical examinations can only be carried out in an equipped office, by a qualified specialist, at the place where the license was obtained.

The procedure for undergoing pre-trip and post-trip medical examinations is described in detail in Order of the Ministry of Health of the Russian Federation dated December 15, 2014 No. 835n.

The Methodological Recommendations approved by the Ministry of Health of the Russian Federation and the Ministry of Transport of the Russian Federation dated January 29, 2002 describe in detail how a medical office is organized:

  • To conduct pre-trip medical examinations and medical examinations, it is necessary to have a room consisting of at least two rooms: a room for examinations and a room for collecting biological media. The room must be equipped with the following medical devices, equipment and furniture (minimum):
  • medical couch;
  • desk, chairs, table lamp, wardrobe, coat hanger, floor mat, safe;
  • device for determining blood pressure - 2 pcs., thermometer - 3 pcs., stethoscope - 2 pcs.;
  • device for determining alcohol vapor in exhaled air - 2 pcs.;
  • breathalyzer, rapid tests for alcohol and drugs. A constant supply of: breathalyzers - 2 pcs., express drug tests - 10 pcs.;
  • table for medical equipment - 1 pc.;
  • medical spatulas - 10 pcs.;
  • bag with a set of medicines for emergency medical care - 1 pc.;
  • equipped room for sampling biological media;
  • the premises must be equipped with communications equipment.

Documentary support for pre-trip and post-trip medical examinations implies the presence of a Register of Pre-Trip Medical Examinations and a Register of Post-Trip Medical Examinations. According to paragraphs 14 and 15 of the Order of the Ministry of Health of the Russian Federation dated December 15, 2014 No. 835n “On approval of the Procedure for conducting pre-shift, pre-trip and post-shift, post-trip medical examinations”, logs are kept on paper, the pages of which must be laced, numbered, sealed with the organization’s seal, and The logs contain the following information about the employee:

  • date and time of the medical examination;
  • surname, name, patronymic of the employee;
  • employee gender;
  • employee's date of birth;
  • the results of the studies specified in paragraph 10 of the Procedure;
  • conclusion on the results of medical examinations in accordance with paragraph 12 of the Procedure;
  • signature of a medical worker with a transcript of the signature;
  • employee signature.

Logs can also be filled out on electronic media, but taking into account the requirements of the legislation on personal data and with the mandatory ability to print out the log pages.
In this case, the information entered into the journals is certified by an electronic signature. In addition to magazines, in accordance with paragraph 15 of Order of the Ministry of Transport of the Russian Federation dated September 11, 2021 No. 368 “On approval of mandatory details and the procedure for filling out waybills,” a note on pre-trip medical examinations is affixed to the waybill:

  • The dates and times of the pre-trip and post-trip medical examination of the driver are entered by the medical worker who conducted the relevant examination and certified by his signature indicating the surname and initials.
  • Based on the results of the pre-trip medical examination, the following information is indicated on the waybill.

Order of the Ministry of Health of the Russian Federation No. 835n, in paragraphs 16 and 17, also describes in detail how the mark is placed on the waybill:

  • ... the waybills are stamped with the stamp “passed a pre-trip medical examination and is allowed to perform work duties” and the signature of the medical worker who conducted the medical examination;
  • …the waybills are stamped “passed a post-trip medical examination” and signed by the medical worker who conducted the medical examination.

Bottom line

I repeat once again that all of the above medical examinations are MANDATORY for persons authorized to drive vehicles. Information about the results of these medical examinations must be stored in the organization and provided to supervisory authorities for verification.   • List of drivers of the organization;
  • Copies of driver's licenses;
  • Certificates of preliminary medical examinations;
  • Certificates of periodic medical examinations;
  • Schedule of mandatory periodic medical examinations for drivers for the year;

  • Waybills with a note on pre-trip and post-trip medical examinations.

Order No. 835n on pre-trip medical examinations of drivers

The main feature of Order No. 835n of the Ministry of Health of the Russian Federation is that it regulates not only pre-trip, but also pre-shift, post-trip and post-shift examinations of employees. Pre-trip medical examinations

Medical examination of drivers is an important part of the safe operation of transport companies. Due to the large number of accidents, the government is constantly amending regulations. The pre-trip and post-trip medical examination for drivers of the new law 2021 also received some adjustments.

What is this

Regular bus drivers undergo a medical examination before each route to ensure that their physical condition does not cause an accident. The procedure includes several simple steps during which a person’s suitability to drive a vehicle is determined.

To prevent accidents on the road, driver precautions are regulated by law, since the driver is responsible not only for his own life, but also for the safety of passengers.

Who conducts them

Medical institutions, licensed companies, and a full-time doctor have the right to conduct pre-trip and post-trip examinations in 2021.

Features of the pre-trip medical examination procedure for drivers

Order of the Ministry of Health of the Russian Federation No. 835n establishes that pre-trip medical examinations of drivers:

  • are carried out immediately before the start of a work shift in order to detect harmful and dangerous factors, as well as health conditions that may interfere with a person’s performance of work functions;
  • are financed and organized by the employer;
  • are carried out by medical workers who have the necessary qualifications, confirmed by a certificate, and who work on the staff of the company or represent a third-party medical organization, with the appropriate license to carry out medical activities.

Order of the Ministry of Health No. 835n determines that pre-trip examinations include:

  • consideration of driver complaints;
  • conducting a visual inspection;
  • measuring temperature, pressure, pulse;
  • identifying signs of intoxication;
  • determining the percentage of alcohol in the blood;
  • determination of the presence of psychoactive substances.

Based on the results of the pre-trip medical examination, the doctor makes a conclusion that:

  • no harmful and dangerous factors or health conditions that prevent the driver from performing his job function have been identified (and therefore the driver can start working);
  • relevant factors or conditions have been identified (and therefore the driver cannot be allowed to work).

In both cases, the employer is informed about the results of the medical examination. In the second scenario, if factors and health conditions that prevent the driver from working are identified, then the employee is issued a certificate for subsequent contact with a medical organization in order to receive the necessary assistance.

Pre-trip medical examination: scope of research

Based on Order of the Ministry of Health No. 835n; Clause 10, keep in mind that the standard is currently being edited. The order in connection with the introduction of remote medical. monitoring the health status of employees does not meet the new requirements. When undergoing an in-person medical examination, nothing changes, therefore, until the updated document comes into force, they adhere to the previous Rules. At the appointment, the health worker must:

  1. Listen to the driver’s complaints about how he feels, whether there are any reasons for referral to a clinic. An employee is not allowed to drive a car if: there is pain in the heart, headache or toothache; symptoms of gastrointestinal disorder appeared; there are signs of acute respiratory viral infection (this is especially true during the COVID-19 pandemic), etc.
  2. Inspect visually: observe the behavior and self-control of the employee; examination for damage to the skin and mucous membranes, traces of injections, identification of characteristic signs of intoxication, poisoning, lethargy or, conversely, hyperactivity.
  3. Measure parameters: temperature, AD (pressure), pulse.
  4. Conduct a test for intoxication (hangover syndrome).

If there are no contraindications to driving, the measured indicators are within the normal range, a stamp indicating the pre-trip medical control has been completed is placed on the waybill. The health worker certifies the admission with a personal signature, writing down his last name + initials, indicating the date and time spent on the procedure.

Results of paragraph 12 of the Order of the Ministry of Health of the Russian Federation

12. Based on the results of the pre-shift, pre-trip and post-shift, post-trip medical examination, the medical worker issues a conclusion on:

  1. presence of signs of exposure to harmful and (or) dangerous production factors, conditions and diseases that interfere with the performance of work duties, including alcohol, narcotic or other toxic intoxication and residual effects of such intoxication (indicating these signs);
  2. absence of signs of exposure to harmful and (or) dangerous production factors, conditions and diseases that interfere with the performance of work duties, including alcohol, narcotic or other toxic intoxication and residual effects of such intoxication.

Additional research

In cases where it is clear from external behavior that the driver is intoxicated, although the alcohol test turned out to be negative, a urine test is performed. If psychotropic substances are detected in a biological sample, the employee is suspended from work. The doctor writes a referral to the clinic to confirm the diagnosis - drug poisoning.

The certificate indicates (clause 19 of Order of the Ministry of Health No. 835n):

  1. Serial number of the document.
  2. Full date (time up to minutes) of the procedure.
  3. Type of inspection.

Regulations on the organization of pre-trip medical examinations of drivers

In addition to Order No. 835n, the letter of the Ministry of Health of the Russian Federation dated August 21, 2003 No. 2510/9468-03-32 also retains legal force. Pre-trip and post-trip. How to organize medical examinations for drivers

Pre-trip medical examinations are carried out before the start of the working day, post-trip medical examinations are carried out after the working day. To conduct such examinations in a company, the manager will need to either independently obtain a license to carry out medical activities and hire a medical employee, or enter into an agreement for the provision of services with a medical organization that has such a license. The medical worker reports the results of these examinations to the manager.

Conducting a pre-trip medical examination of drivers is an employer’s obligation provided by law. During its implementation, it is important for the enterprise to comply with the procedures provided for by the provisions of Order of the Ministry of Health of the Russian Federation dated December 15, 2014 No. 835n.
