If we talk about vehicles designed to transport passengers, there is a completely individual scheme for assigning a category.

What is the categorization of a vehicle for transporting passengers?

Speaking from the point of view of current legislation, categorization is a procedure for assigning a particular status to a car, i.e. categories, let’s take a closer look at what it includes:

  1. To begin with, the assignment of a category is carried out by an authorized body on the basis of documents provided by the owner.
  2. For vehicles that carry passengers, there are four assigned categories.
  3. The issued document is a legal basis for the use of transport on regular trips, for private transportation of passengers and for the provision of other transport services.

Register of vehicle categorization

  • preparation and submission of documents to the UGADN (the department of state road supervision at) the place of registration of the legal entity. persons or individual entrepreneurs where document verification is carried out. During it, UGADN sends requests regarding the licensee’s agreements (medical organization under a pre-trip inspection agreement, parking agreement, maintenance agreement). The verification period depends on the responses to the request, on average 1-1.5 months;
  • The second stage is an on-site inspection at the location of the licensee. The completeness of documents is checked - constituent documents, orders, journals, documents of the person responsible for the database.

If the client plans to transport passengers on orders, then it is necessary to submit a notification to the State Traffic Safety Inspectorate about the start of business activities. Data is entered into the register on the day of application.

Why is categorization necessary?

Legislatively, the introduction of mandatory categorization was carried out in order to solve the following problems:

  1. Reducing transport danger on public roads. In particular, in order to exclude the use of inappropriate and unsafe transport in passenger transportation.
  2. Systematize the vehicle fleet used for passenger transportation.
  3. Exercising state control over companies that provide transport services to the population in the field of passenger transportation
  4. Reduce the number of traffic accidents that are in one way or another related to buses.

Vehicle categorization

1. Movement on highways of a vehicle transporting dangerous, heavy and (or) large-sized cargo is permitted with a special permit issued in accordance with the provisions of this article.

Thus, carriers who have not included their vehicle in the Register of Categorized Vehicles of Rosavtodor will not be able to obtain permission from Gosavtodornadzor to transport dangerous goods on federal roads of two or more regions.

Types of categorization of vehicles for transporting passengers

The assignment of a particular category to a vehicle is made by the authorized body with reference to the current legislation.

It is worth noting that the law currently spells out a list of categories of vehicles that are subject to the procedure, or more precisely:

  • Motor transport
  • Buses
  • Electric ground transport (trolleybuses and trams)
  • Railway transport

At the same time, each individual type of vehicle provides individual features of the procedure and sometimes its own exclusive package of documents.

Register of vehicle categorization

  • legal support in categorizing vehicles and OTI objects at each stage of document preparation;
  • preparation of documents for assigning categories;
  • filling out an application and covering letter to the competent authority;
  • preparation of documents for combining vehicles that are identical in their technical characteristics into groups;
  • preparation of documents for exclusion from the list of categorized vehicles;
  • preparation of documents for the responsible STI;
  • special permit for the movement of a vehicle transporting dangerous goods on roads*;
  • licenses for carrying out activities for transporting passengers by road**.

Vehicle categorization is carried out by the Federal Road Agency and the Federal Agency of River and Sea Transport of the Russian Federation.

What transport cannot be divided into categories?

Still referring to the current legislation, we can identify a category of transport, which cannot be divided into categories.

Today, in the Federal Law “On Transport Security” you can find regulatory documentation, according to which the categorization procedure is not provided for:

  1. Car trailers, including semi-trailers, and trailers whose purpose is to transport dangerous goods.
  2. Vehicles of category M1. Or, more simply put, simple passenger cars and even those that carry out registered transportation of passengers, i.e. act as a taxi.
  3. Any vehicles, regardless of category, that are used exclusively for registered transportation.
  4. Vehicles that provide transportation for students to an educational institution and to their place of residence, however, in this case, this applies to transport with categories M2 and M3.

It is worth remembering that amendments to legislation are made regularly, which means that the list may be replenished or may lose some items. Therefore, it is worth regularly monitoring and, if necessary, clarifying the information so that no problems arise with the law.

Which vehicles are subject to categorization?

First of all, let’s turn to Article 1 of the Law “On Transport Security”, which defines the basic concepts. Including the concept of vehicle:

11) vehicles - devices intended for the transportation of individuals, cargo, baggage, hand luggage, personal belongings, animals or equipment, devices installed on said vehicles, in the meanings determined by transport codes and charters, and including:

a) road transport vehicles used for regular transportation of passengers and luggage or transportation of passengers and luggage on order, or used for the transportation of dangerous goods, which requires a special permit;

Thus, 3 groups of vehicles are subject to categorization:

  • used for regular transportation (public transport);
  • used for transportation on order;
  • used for the transport of dangerous goods.

Moreover, at this point, vehicles are not divided into cars, trucks and buses. That is, it follows from the law that categorization is also necessary for passenger cars .

Please note that the above list does not include transportation for the organization’s own needs. That is, if a bus carries passengers for its own needs, then it needs to be licensed, but categorization is not required.

Necessary documents for the procedure

In order to carry out the procedure for categorizing a car, you will naturally need a certain package of documents that should be submitted to the authorized body.

In order to help avoid any difficulties in collecting papers, it is worth providing a detailed list of them:

  1. A copy of a document confirming the existence of a specific carrier, i.e. certificate of registration of an individual entrepreneur, or a corresponding package of documents for a legal entity.
  2. A copy of the technical equipment passport
  3. A copy of the vehicle registration certificate
  4. All documents related to the vehicle, which reflect as much information about it as possible. Such as: cost, hazard class of the car, capacity (or, more simply, the maximum number of passengers that it can carry according to information from the manufacturer).

Individually, the package of documents undergoes changes depending on who applies to the authorized body, the direct owner of the car or its lessee.

If the initiator of the appeal is the direct owner, then the following items are added to the list:

  • A copy of state registration, certified by a notary
  • Extract from the cadastral passport about the transport infrastructure facility

If the submission of papers is carried out by the tenant, then he will be required to:

  • A copy of the agreement between the owner and the applicant on hiring or renting a vehicle
  • An extract from the cadastral passport will also be required.

List of exceptions not subject to categorization

Attention! Order of the Ministry of Transport No. 196 “On establishing a List of transport infrastructure facilities and vehicles that are not subject to categorization by type of transport” dated July 23, 2014, which provided for a list of exceptions, became invalid on January 31, 2021.

The new Order of the Ministry of Transport No. 331 “On identifying transport infrastructure facilities and vehicles that are not subject to categorization by type of transport” dated August 28, 2020 does not contain a similar list. there are no exceptions in 2021 .

Until January 31, 2021, it was possible to refer to Order of the Ministry of Transport No. 196 “On establishing a List of transport infrastructure facilities that are not subject to categorization by mode of transport” dated July 23, 2014.

II. Vehicles

Automobile transport

Motor transport vehicles of category M1 carrying out passenger transportation on request

Motor vehicles carrying out transportation on order for the purpose of providing funeral services

Car trailers, car semi-trailers used for the transport of dangerous goods

Vehicles of categories M2 and M3, used to transport students from their place of residence to their place of study and back, free of charge

Until 2021, the list of exceptions included the following vehicles:

  • Passenger cars carrying passengers on request (taxi).
  • Vehicles for funeral services.
  • Trailers and semi-trailers for the transport of dangerous goods.
  • School buses.

Note. Category B trucks, which can also be used as taxis, were not included in the list of exceptions, because they belong to category N1.

Where can categorization be done?

The authorized body to carry out the procedure today is Rosavtodor. It is important to understand that you will not be able to carry out the categorization procedure anywhere else, although there are plenty of scammers who offer such services.

The cost of this procedure

The cost of categorization consists of a number of factors and features, for example:

  • Payment of state duty or any fee is currently not required
  • Depending on who submits the documents, a power of attorney may be required to be drawn up and notarized, which totals about 1,500 rubles.
  • If you submit documents by registered mail, you will also need to pay postage costs, which amount to approximately 100-200 rubles.

Categorization of vehicles for passenger transportation

From 2021, in order to obtain a license to transport passengers, it is necessary to categorize vehicles. To transport passengers, this procedure is carried out by Rosavtodor. This is exactly where you need to go.

The essence of categorization is that a vehicle (hereinafter referred to as the vehicle) is assigned a certain category from 1 to 4, depending on the risk of an act of illegal interference in its activities. The higher the category, the lower the risk, the fewer safety requirements that the vehicle owner must fulfill.

Results of the procedure

Based on the results of the categorization, the car is included in the appropriate register within 30 days based on:

  • Decisions on assigning the appropriate category
  • Decisions on inclusion in the register of categorized vehicles
  • Solutions for changing vehicle category

Operating a car without carrying out the categorization procedure is prohibited by law, which means that this process should not be neglected, because otherwise serious problems with the law may arise.

Categorization of transport infrastructure objects and vehicles
