Thousands of people die on the roads every year, usually due to non-compliance with traffic rules. Statistics for 2021 show a 10% decrease in the number of fatal accidents compared to 2021. An increase in the size of fines for drivers for traffic violations plays a significant role in the positive dynamics.

According to the traffic rules, there is a list of circumstances in which the driver is obliged to give way to persons who have the right of way.

General information

The requirement stated in the traffic rules as “give way” implies that the driver should not start or continue driving, as well as carry out other maneuvers that could entail a change in the direction of movement or speed of other highway participants who have the right of way. The advantage, in turn, is expressed in the right to priority movement in the intended direction.

The following have the right of right of way on the road:

  • cars moving on the main road relative to those on the secondary road, if the corresponding road sign is installed at the intersections;
  • pedestrians walking along the roadway in places marked by road signs or special crossing markings;
  • special equipment, in cases where signaling equipment is turned on, for example, an ambulance, fire truck, police and other authorities with priority rights;
  • cyclists preparing to make a turn;
  • blind pedestrians, regardless of the crossing location, when signaling to drivers with a white cane.

Ignoring priority rights on the road may entail punishment under the Code of Administrative Offenses of the Russian Federation.

Sign “No passing without stopping” – priority sign

The road sign “Driving without stopping is prohibited” is a strengthened version of the “Give way” sign - the first obliges the driver to come to a complete stop. The priority sign is placed immediately in front of the stop line, or if there is no stop line, in front of the edge of the road that needs to be crossed.

The driver is obliged to give way to vehicles driving on the intersecting roadway, and if there is a sign 8.13 - to vehicles moving along the main road.

Sign 2.5 may be located in front of a quarantine post or a railway crossing. In such cases, the driver must slow down and come to a complete stop before the sign or stop line. Clause 6.15 of the Russian Traffic Regulations describes in detail an exception to this rule - if at a railway crossing there is a traffic light with a white signal on, then this sign is not valid.

Also, priority signs are placed at road intersections with poor or limited visibility, where accidents are often recorded. For this reason, even if there is no one to give way to, the driver must still completely stop driving his car and carefully look around. It is quite possible that just such trifling caution can save your life.

Fine failure to give way to vehicle

According to Article No. 12 of the Code of Administrative Offenses of the Russian Federation, drivers who do not give way to cars moving along the main road at an intersection are subject to administrative liability, as well as fines in the amount of 1,000 rubles. The same amount is provided for motorists who interfere with the movement of other vehicles traveling in the transverse direction. Similar situations can arise as a result of a car driving into the middle of the intersection, in the direction of movement of other vehicles, at the moment of congestion.

When maneuvering in violation of the rights of another car enjoying priority, with the exception of the cases described earlier, drivers are subject to a fine of 500 rubles or a warning (Article No. 12.14 of the Administrative Code)

Penalty for failure to provide priority to a vehicle in other cases

Let's consider part 3 of article 12.14 of the Code of Administrative Offenses:

3. Failure to comply with the requirement of the Traffic Rules to give way to a vehicle enjoying the priority right of movement, with the exception of cases provided for in Part 2 of Article 12.13 and Article 12.17 of this Code -

entails a warning or the imposition of an administrative fine in the amount of five hundred rubles.

A fine of 500 rubles (or a warning) is imposed on the driver in all cases when it is necessary to give way outside the intersection. For example:

  • When leaving the adjacent territory for vehicles on the road.
  • When making a U-turn outside an intersection, oncoming and passing vehicles.
  • When changing lanes, cars moving without changing direction.

A driver who fails to give way to a cyclist or pedestrian is also subject to administrative liability. In this case, the object of the offense will be road safety. The driver is obliged to give way to a pedestrian crossing the roadway, both at a regulated and non-regulated crossing.

According to the Traffic Regulations Decree of October 23, 1993, a “pedestrian” is a civilian who is outside a vehicle on the roadway, pedestrian crossing or bicycle path. Based on the definition, cyclists are also considered to be pedestrians. The amount of the administrative fine if the driver does not give way in these cases will be the same.

Responsibility for violation of Article No. 12.18 of the Code of Administrative Offenses of the Russian Federation provides for a fine in the amount of 1,500 to 2,500 rubles.

The driver did not give way: what fine (other kind of punishment) awaits him

High fines are not imposed for such traffic violations.

  1. If such a violation is recorded for the first time, the inspector may limit himself to only a warning. Such a lenient punishment is possible in cases where the offender:
  • showed inattention;
  • did not create an emergency situation by his actions.
  1. The traffic inspector may impose a not too onerous fine - from 500 rubles. up to 1.5 thousand rubles.

Special circumstances

It is worth considering in more detail other situations when the driver ignores the rules.

A frequent violation of traffic rules is the driver’s intransigence, when the right of movement must be given up during a maneuver such as changing lanes. The driver is not driving in his lane, but is not going to change lanes in a timely manner. For example, if you need to go to the right. A turn is approaching, the car owner turns on the signal. And then he immediately tries to squeeze into the far right lane to complete the maneuver.

However, turning on a signal indicating an intention to turn does not give the right of way. As a result, the relevant articles of the traffic rules are violated, and both the rule violator himself and other car owners who had the right of way when driving in their lane may suffer.

Even if there was no collision, an emergency situation was still created. The fine can be 500 rubles or 1000 rubles. Usually the traffic inspector independently decides whether an emergency situation has really been created or not.

Giving way to special or public transport

The media often broadcast incidents in which participants commit lynching of drivers who do not allow ambulances or other special vehicles to pass. But here, too, one must act according to the law.

If the driver does not yield the right of movement to a special purpose vehicle, he is punished under the terms of the Code of Administrative Offenses:

  • a fine of 500 rubles. (minimum, for inattention);
  • a fine of 1 thousand rubles. (maximum for deliberate violation of the rules);
  • deprivation of driving rights for a quarter (if the rules are ignored by the driver too brazenly).

Only those “risky daredevils” who have already been fined for such insolence are deprived of their rights.

Uncourteous behavior towards a cyclist or pedestrian

The budget of a driver who did not want to let a pedestrian or a person riding a bicycle pass, if such “impoliteness” is detected, will be reduced by 1.5 thousand rubles. This is like the first warning. These amounts are unlikely to intimidate overly self-confident drivers, but they will still make you think. After all, they can then lose their rights.

In addition, cases of serious injuries and even deaths of pedestrians crossing streets at pedestrian crossings have become more frequent in recent years. The guilty driver expects:

  • deprivation of rights for a long period;
  • criminal penalties (possibly imprisonment);
  • payment of large compensation sums to injured persons.

Also, under the terms of Article 264 of the Criminal Code of the Russian Federation, a traffic violation violator can be deprived of freedom and rights at the same time. And you will have to pay for material, moral damage, and the costs of restoring your health in any case.

If you do not give way to special equipment

Special equipment refers to vehicles equipped with light and sound signals for ambulance, emergency and police assistance. Such vehicles have the right of way. Both drivers and pedestrians, cyclists and other road users must allow cars to pass.

The driver’s obligation to allow special equipment to pass arises if the warning equipment is activated.

Punishment for the offense is provided for in Article No. 12.17 of the Code of Administrative Offenses of the Russian Federation and is expressed in the form of a warning or a fine of 500 rubles. The same liability arises in case of failure to provide priority to route transport.

In a similar situation, if special equipment has not only special equipment, but also an external color system, inscriptions and designations, the punishment may be more severe, up to the deprivation of a driver’s license from one to three months.

According to the Administrative Code of Ukraine, Article 122, Part One - violation of the requirements of road signs implies a fine of 15 nmdg, that is, 255 UAH.
