Fine for a sign “No trucks allowed”

Where trucks are completely closed

Entry restrictions can be temporary or permanent.

Time restrictions are associated with seasonal climate changes. For example, roads are closed to trucks to prevent them from pushing through the soil under the asphalt. Truck traffic is also closed during the heat - the truck will leave ruts on the soft asphalt.

In 2021, Rosavtodor banned the movement of heavy trucks from 10:00 to 22:00 and when the temperature rose above 32 ℃. If such a restriction is introduced again, we will update the article.

Permanent restrictions include regional bans on entry into the city. For example, in Moscow the movement of trucks larger than 1 ton is prohibited from 06:00 to 22:00 within the Third Transport and Garden Rings. Trucks with a maximum weight of more than 7 tons are not allowed to enter the Moscow Ring Road, trucks heavier than 12 tons are not allowed to enter the Moscow Ring Road.

What transport does it apply to?

The image of a road sign in some cases contains an additional designation with the maximum permissible tonnage. If there are none, the sign is valid with a maximum weight of up to 3.5 tons in both directions. However, additional indications for tonnage can be added - 5, 6 or 8 tons. These indicators increase the permissible weight of the vehicle, taking into account the available loads.

Prohibitory traffic rules signs for trucks:

  • 3.3. – for all large vehicles;
  • 3.4 – for vehicles of a certain weight category;
  • 3.7 – for vehicles with trailers.

Exceptions to the rules include the following vehicles:

  1. Postal service vehicle.
  2. Cars are owned by city housing and communal services.
  3. Vehicles designed in design and equipment for transporting people.
  4. Vehicles without a trailer weighing up to 26 tons, serviced in the area where the “Trucks are prohibited” road sign is valid.
  5. Vehicles used to transport disabled people of groups I and II.
  6. Vehicles on the balance sheet of organizations located in the area covered by the prohibitory sign.

What signs block trucks from entering?

When the passage is completely closed, a sign will be placed:

“Truck traffic is prohibited.” If the road services indicated the weight on the sign - for example, 5, 6 or 8 tons, trucks heavier than this are not allowed to move. If nothing is written, the default is 3.5 tons.

The “No Freight Traffic” sign sometimes works temporarily. Then there will be a sign under the sign indicating the time of entry into the city.

"Time of action". This sign indicates that the sign under which it is located is only open on weekends from 8 a.m. to 5:30 p.m.

"Type of vehicle." This is a signal to the driver that the signs are higher for him

"Maximum mass resolution limitation." If the loaded vehicle is heavier than the specified weight, passage is prohibited

This combination means that trucks with a load capacity of 2.5 tons cannot turn right

Prohibitory signs are a category of traffic rules signs that introduce or cancel various prohibitions on the actions of drivers on certain sections of the road. Prohibitory signs include such types of signs as, for example, a sign prohibiting entry, prohibiting any movement on a specific section of the road, a sign limiting the height or weight of a vehicle, a sign limiting speed, parking place, etc.

Prohibition signs are one of the largest sets of traffic rules signs, which include a wide variety of situations in which certain restrictions may be introduced. Due to the variety of prohibition signs, there are also a lot of images on them, which can complicate their study and mislead an inexperienced driver when encountering them. Sign 3.4 - The movement of trucks is prohibited has a bright red color in its color scheme, which will always signal to you that one or another restriction is being introduced next, but which one should be carefully studied and remembered.

A clear understanding and knowledge of traffic rules prohibiting signs will protect you from large fines, which may even include deprivation of your license, as well as from various kinds of unpleasant situations in the form of all kinds of accidents.

How to avoid getting a fine

In short, get a pass to enter a prohibited area. They are in Moscow and St. Petersburg. Below are detailed instructions.

Select a pass. There are two varieties:

  • • one-time – valid for up to 5 days;
  • • long-term – valid for up to a year.

The pass will have an area within which the truck can move. If “point B” on the route sheet is constantly changing, it is better to order several one-time passes. Applicants can be individuals, individual entrepreneurs and legal entities.

To come to Moscow, you don’t have to collect any papers - make a pass remotely on the mos.ru website. The camera compares the license plate number of the car with the register of issued passes. If there is a gap in the system, no fine will be issued.

A pass to enter St. Petersburg can be obtained on the city administration website. Based on the validity period, St. Petersburg passes are divided into types:

  • • daytime - from 7 to 23 hours;
  • • night from 23 to 7;
  • • 24/7.
  • Collect documents. The truck driver provides:
  • • rights,
  • • PTS,
  • • vehicle registration certificate,
  • • diagnostic card,
  • • power of attorney for the car, if the owner is different.

Get a pass. A one-time pass will be issued after 3 hours, a long-term pass will be issued after 14 working days. Passes are free.

You can check whether you have received a pass on the transport portal or on the website of the Traffic Management Center (traffic management center).

What is the fine for driving under a “No Trucks” sign?

For violation of this rule, a fine of 500 rubles is provided for driving under the “No Freight” sign. Sometimes this punishment can turn out to be much more “expensive” - this is influenced by a number of factors.

It is important to understand what kind of transport may be subject to the sign. This is stated in the Traffic Rules - trucks weighing more than 3.5 tons cannot pass under this sign (however, only if a different number is not indicated on the sign). However, this rule implies that there are exceptions: for example, drivers who:

  1. They transport passengers.
  2. Transport cargo for organizations.
  3. They are the transport of Russian Post.

These exceptions are also specified in the legislation. By the way, if you are driving along an adjacent road and enter the highway in a place where there is no restriction sign, this will not be considered a violation. However, please note that some cities have special restrictions on the passage of trucks. So, in the Moscow region:

  1. Vehicles with a carrying capacity of more than 1 ton are prohibited from entering the territory of the Third Transport Ring and the territories lying inside it from 6 a.m. to 10 p.m.
  2. It is prohibited to drive on the Moscow Ring Road and inside the Moscow Ring Road vehicles with a GVW of over 12 tons.

If you do not have a specialized pass and your vehicle does not fall under any exception established by law, you will have to pay a fine of 500 rubles. If you enter an area where the movement of freight vehicles is prohibited, despite the regulation, and all this happens in the Moscow or St. Petersburg regions, the fine will be much higher. An administrative penalty is imposed in the amount of 5 thousand rubles.

It is important to understand that this violation is one that can be paid with a 50% discount - for this, the fine must be paid within 20 days from the moment you received notice of the penalty.

How to challenge a fine that was issued by mistake

You have 10 days to do this. Write a complaint to the head of the inspector who issued the fine. The resolution contains the telephone number of the department where the inspector works. Call and ask for the manager's name. Please attach the following documents to your complaint:

  • • agreement with the driver, if you are a manager;
  • • OSAGO;
  • • waybill;
  • • explanatory note from the driver.

To make it easier to draw up a document, . Send your complaint and copies of documents by registered mail. The appeal is considered by law within 10 days.

What to do with a fine if the truck is registered to a legal entity

Sometimes a breakdown occurs on the road, due to which the driver has to break the rules. For example, if the refrigerator's electrical system fails and frozen food may spoil, the driver finds a place to ship it, but drives through a prohibitory sign. Decide who is responsible for the violation and choose how to proceed.

Here are three options to take when a company truck driver receives a ticket.

Appeal the fine. You have ten days to do this. Here's a sample. Write down the reason why the driver of your organization drove through the prohibitory sign. If technology or force majeure is to blame, the fine will most likely be cancelled.

Withhold the fine from the driver's salary. Within a month of paying the fine, issue a collection order. According to the law, more than 20% of the amount cannot be deducted from one salary. If the fine was not collected in the first month, ask the employee for written consent to compensate for the damage. If he refuses, compensation can only be obtained through the court.

Pay the fine from the legal entity's account. Sometimes the driver is not to blame for receiving a fine. For example, a refrigerator broke down on the road and the entire cargo could have spoiled - this would result in thousands of losses. The driver took action and saved the cargo. In this case, the employer is to blame - he did not service the car on time. Then the employer must pay the fine.

Exceptions

The rules for the passage of trucks under the sign “Trucks are prohibited” also have their exceptions. Sign 3.4 prohibits the movement of heavyweights weighing more than 3.5 tons or the weight that stands on the sign, except in the following cases :

  • municipal and postal vehicles;
  • cars that transport people ;
  • cars of employees who work or live in the area covered by the sign ;
  • trucks that are the property of enterprises located in the restricted area;
  • trucks transporting disabled people ( groups I and II ) and drivers who transport them.

IMPORTANT If falling under the exception, the driver should not abuse the right of way and make his way within the area of the sign - traffic prohibited for freight, as short as possible. This means that leave this section at the nearest intersection .

Remember

  1. Trucks are completely prohibited from entering the city or only during daylight hours.
  2. In Moscow, time restrictions are from 06:00 to 22:00, in St. Petersburg from 7:00 to 23:00. In other cities, only entry into the city center is limited.
  3. To travel during permitted hours, you need a pass.
  4. The driver receives a pass online on the website of the Moscow City Hall or the St. Petersburg Administration. In other cities, the pass can be obtained at the data center.
  5. If you receive a fine, you can challenge it - write a complaint addressed to the head of the inspector who issued the resolution.
  6. If the car is registered to a legal entity, the owner of the company pays the fine.
  7. If the fine is the driver’s fault, the employer withholds money from the salary.
