The field of voluntary vehicle insurance has been operating for a long time and is very popular among drivers, which cannot be said about companies. People often get into accidents due to their own fault, and they have to pay for all the consequences. Due to the huge number of cars on the roads in the last decade, the accident rate curve has gone up, and no tendency to decrease is expected. At the same time, the number of traffic police crews is limited, which acutely affects the recording of incidents when there are especially many of them. For such cases, a CASCO registration system according to the European Protocol has been developed and implemented. Like any insurance product, it has its own characteristics and rules, pros and cons.
CASCO insurance and Europrotocol
CASCO – voluntary insurance of a car against damage or theft. Depending on the form, it can be complete (from theft and damage) or partial (from theft or from creation).
In accordance with the Directive of the Bank of the Russian Federation No. 3380-U, starting from 2014, citizens who insure their car under a CASCO agreement can use the European protocol. This is a paper containing the circumstances of a traffic accident, without the involvement of traffic police officers, which significantly reduces the time it takes to register an accident. If the document is filled out correctly, it allows you to receive insurance payments.
What are the benefits of the Euro protocol?
The European protocol contains information about the circumstances of the incident, as well as the papers drawn up by the traffic police officer. It is signed by both participants in the road accident. After the incident, the motorist will only have to send a request to the insurer for compensation payments.
In addition, the Europrotocol relieves drivers of the need to communicate with traffic police officers and saves time for vehicle owners involved in an accident. Drivers do not have to wait for inspectors at the scene of an accident to begin processing documents and recording details of the accident.
The simplified procedure has another advantage - the presence of only one document. In contrast to the full procedure, registration of an incident under CASCO implies the absence of a large amount of necessary documentation. In addition, motorists do not have to waste their nerves on correctly explaining the situation to traffic police inspectors.
It would be fair to point out the negative aspects of registering an accident using a simplified procedure.
The disadvantages include the following provisions:
- After an accident, motorists are in a state of stress and shock, which prevents them from correctly assessing the situation. People who are easily influenced by external influences sometimes agree that they were the culprits of the accident. Manipulators look for ways to blame the victim.
- Immediately after a collision, it is difficult to correctly assess the amount of damage caused to property. If the compensation standard under the European Protocol is even slightly exceeded, the motorist wishing to receive compensation will face certain problems in receiving payments.
- The accident that occurred may not meet the criteria for issuing a Europrotocol. Drivers should not complete documents without a clear knowledge of the requirements for simplified paperwork.
- It is impossible to challenge the European Protocol. When a participant in a traffic accident signs the document, he confirms his full agreement with the stated facts.
The simplified procedure for registering an accident has its own characteristics. It is necessary to carefully weigh all the pros and cons of the decision to draw up the Europrotocol.
What insurance cases are suitable?
The conditions for registration of the European protocol impose some restrictions on drivers. First of all, this is the absence of disagreements between drivers regarding the culprit and the circumstances of the incident.
The paper is issued only if only 2 vehicles were involved in the accident. In the event of an accident involving 3 or more cars, even if there is no disagreement, it is necessary to call the traffic police inspectors.

The second condition is the absence of damage to third-party property that is not the property of the participants in the incident on the road. This could be a pole, fence, trash container, etc.
The European protocol cannot be used in an accident in which the driver was under the influence of alcoholic beverages, narcotic or psychotropic substances. This is a serious offense that must be recorded by representatives of the State Traffic Inspectorate.
It should also be taken into account that the European protocol is not appropriate if one party to the accident is a foreign citizen who does not have a Green Card.

Important! You should carefully read the insurance contract, as some companies indicate a list of cases when it is permissible to draw up a European protocol. In other cases, it is necessary to record the accident with the traffic police.
How to file an accident
The driver receives a form for registering an accident through EUREK with a package of documents when he issues an MTPL policy; similar forms can be purchased additionally.
One form must be filled out for two participants in the accident; it does not matter who provides it.
It consists of two sheets. The data filled in on the front side of the top sheet is printed on the bottom sheet. Participants fill out the reverse side of each sheet independently.
This is not necessary, but to protect against the dishonest actions of the second participant in the incident, you can use any technical means to take a photo or video recording of the accident scene before the roadway is cleared of cars.
If there are witnesses to the accident, you must ask them to give a written explanation of the circumstances they saw and leave their contact information.
Drivers fill out the notice in the following order:
• the first eight points of general information are filled out by any of the drivers,
• points 9 to 15 are filled out by drivers each in their own column “A” or “B” ( in paragraph 15, participants in the accident must indicate themselves as the victim or the culprit ), the completed information is confirmed with their signatures,
• in paragraph 16 the circumstances of the accident are noted by any of the participants,
• in paragraph 17, the location of the accident is schematically drawn (everything that is significantly related to the accident is recorded),
• in paragraph 18, drivers sign the notice, confirming that they have no disagreements regarding the circumstances and causes of the accident.
You need to understand that the last item on the front side is signed only after both drivers have carefully examined everything that has been filled out.
Then the form is divided into two parts, and on their own copy, each person independently describes the picture of the accident.
The completion of the registration procedure is considered the moment when all documents, including the notice, are transferred to the insurer.
Filling out the European protocol
The European protocol form is issued by the insurance company along with the CASCO and MTPL agreement.
Interesting! Insurance companies issue a form equipped with carbon paper, which significantly speeds up the process of completing the document.
You need to fill out the paper in 2 copies, on both sides, using a ballpoint pen. All circumstances of the accident must be described in as much detail as possible.

Important! The authenticity of the European protocol is confirmed by the signatures of the parties on each back.
Front reverse for joint filling, which contains:
- information about the location of the accident: locality, street name, numbers of buildings located nearby, if there are names of shopping centers and stores;
- date and time of the incident;
- the number of participants in the accident who received damage;
- the presence of injured or dead, their number and nature of injuries;
- data from a medical examination regarding driving a vehicle under the influence of alcohol or drugs;
- the presence of damage caused to other cars or other people's property;
- personal information and contact details of eyewitnesses;
- manufacturer and name of the vehicles involved in the accident;
- personal information and contact information of drivers involved in accidents and car owners, if the incident did not occur with their participation;
- insurance policy data (number, name of organization, date of issue);
- detailed diagram of the traffic accident;
- detailed description of the damage.
Important! Corrections in the European protocol are confirmed by the corresponding inscription “Corrections are correct” and the signature of the parties.
The other side of the form is filled out by each party to the accident individually and includes information about the vehicle, the circumstances of the accident, details of the driver and owner of the car, other participants in the accident, and damage. In case of serious damage and the impossibility of independent movement, it is necessary to indicate the address of the parking lot where the car will be parked. The authenticity of the entries made is certified by the signature and date of completion.
Procedure in case of an accident
Following an emergency, participants will be required to take the following actions:
- Turn on the emergency signals on cars and install warning triangles at a distance of 15 m from the collision site (if it occurred within populated areas). If outside - at a distance of 30 m.
- This is followed by negotiations with the other side of the incident. If an agreement is reached, then it is necessary to take photographs and videos of the accident and the damage after it.
- If the vehicles involved in the accident interfere with the passage of other cars, then they must be removed from the road and secured.
- At the next stage, you need to notify the insurance company about the situation that has arisen. In this case, the fact of guilt does not matter.
- Proceed with the 2nd participant in the incident to fill out the protocol form to receive payment under CASCO.
What payments?
A participant in an accident with a CASCO policy has the right to contact the company for full compensation for the cost of car repairs. The second party has the right to compensation for damage under the MTPL policy. When calculating payments, the following are taken into account:
- terms of the agreement (validity period, payment terms, availability of additional services, franchise);
- vehicle data (percentage of theft of the insured car brand, age of the car, cost of spare parts, presence of an anti-theft system);
- information about the driver (age, driving experience, including accident-free);
- region.
In addition, during the calculation only the parts that need to be replaced and depreciation of the vehicle are taken into account:
- tire wear;
- car mileage;
- service life of parts.
Based on the results of the examination, the insurance company offers the victim 2 options for covering the damage:
- repairs at a station with which there is an agreement or in an official service;
- cash compensation.
When choosing the second method, the participant in the accident has the right to payments in the amount of:
- 50 thousand rubles. in the regions of the Russian Federation;
- 400 thousand rubles. in Moscow and St. Petersburg.
To receive compensation, you must contact the insurance company within 24 hours, or better yet, immediately and provide detailed information about the accident, an application and a package of documents specified in the CASCO agreement. After this, the organization sends the car for examination to assess the damage received as a result of the accident. If the payment limit under the European protocol is exceeded, it is necessary to provide photo and video evidence of the incident from the scene of the accident.
Important! Photos and videos from the scene of the incident (vehicles from all sides and detailed location of damage, roads, braking distances, nearby structures) should be attached to the European protocol, which allow you to confirm the accuracy of the information entered in the form.
Compensation or referral to a service station is issued within 20 days from the date of application to the insurance company. In case of delay, the CASCO agreement provides for payment of a penalty in the amount of 1%.
An insurance company may refuse to pay if:
- the fact of a serious traffic violation has been established;
- the protocol is incorrectly drawn up;
- the terms of the CASCO agreement have not been met;
- people were injured as a result of the accident;
- there are disagreements between the parties.

Studying the scheme for self-registration of accidents, the driver will notice that it is beneficial for car owners.
The advantages of the incident recording method include:
- no need to wait for traffic police officers to arrive at the scene of the incident;
- the method significantly saves time;
- we can resolve the problem among ourselves.
However, in practice, a vehicle owner who decides to use the Europrotocol may encounter a number of problems. The main condition that must be observed in the event of an incident is that no more than 2 objects must be involved in the accident. Drivers who hear the rule often think that it means that no more than 2 cars can be involved in an accident. In practice, the situation is not interpreted quite this way.
The rules imply that no more than 2 road users can become objects of the incident. It should be remembered that these include not only cars. A typical mistake is drawing up a Europrotocol in the event of an accident involving a car with a trailer. The vehicle for transporting goods has its own registration number and must be included in the policy.
For this reason, if a car with a trailer collides with another car, it will be considered that there are already 3 participants in the incident. In this case, it will not be possible to issue a Europrotocol. You will need to call the traffic police.
The method of recording an incident cannot be used if there was no direct contact between vehicles. For example, the owner of 1 car tries to avoid a collision and crashes into a pole. If the Europrotocol is applied in practice in this situation, the insurance company will refuse to provide compensation.
Europrotocol form
Having chosen a method for recording an accident, car owners must check that each other has the appropriate documents. If the policy of the culprit of the incident is expired, or the person who was driving at the time of the incident is not included in the CASCO or MTPL form, the insurance company of the victim will not pay compensation.
An important point that needs to be approached most carefully when recording an incident according to the European Protocol is filling out a notification of an accident. It is necessary to write down the data in full on the paper. All damage caused to vehicles must be recorded in full. There should be no ambiguous statements depending on the degree of guilt.
It should be remembered that the insurance company independently determines the person whose actions led to the incident. If one of the drivers indicates that he admits his guilt, the institution may refuse to provide compensation or issue it in an amount that is not in the amount in which it is due.
The notification of an accident should not contain blots or corrections, as their presence may be a reason for refusal to pay.
Example
A sample Europrotocol was approved by the Bank of the Russian Federation, in particular by Regulation No. 431-P dated September 19, 2014, Appendix 5. Below is an example of filling out the form, which is possible in accordance with Art. 11 clause 8 of Law No. 40-FZ “On compulsory insurance of civil liability of vehicle owners.”
Sample Europrotocol:
- Location of the accident: traffic light at the intersection of Lenin and Kommunisticheskaya streets in Syktyvkar
- Date of accident: August 24, 2021 at 12.20
- Number of damaged funds: 2
- There were no injuries or deaths.
- There was no material damage to vehicles other than A and B or property.
- Eyewitnesses of the incident were the driver and passenger of the car Deo Matiz Antonova Natalya Semenovna and Antonov Alexey Ivanovich, living at the address Syktyvkar, st. Lenina, 10, apt. 100.
- The procedure for medical examination of the state of alcohol and drug intoxication was not carried out.
- Traffic police inspectors were not called to the scene of the accident.

Vehicle A:
Circumstances of the accident: I, Ignatov Vasily Sergeevich, was driving a Mazda 6 car with state number N 004 SE 11 and VIN number 11111111111111111 along Kommunisticheskaya Street and stopped at a red traffic light. At the same time, an Opel Astra with license plate B 777 TT 43 drove into the rear of the car, driven by Kupechesky Valery Andreevich, registered at Kirov, st. Pushkina, 25.
Note : The consequences of the accident were recorded on a camera and a mobile phone video camera; no adjustments or changes were made.
At the end, the date of the accident, signature and its explanation are indicated in the appropriate fields.
Important! If there are empty lines and gaps, it is necessary to cross out the empty spaces to prevent additions and adjustments by interested parties.
Submission order
After filling out the notification form, it must be submitted to the Investigative Committee within 5 days. However, in no case should you begin repairing the damaged vehicle within 15 days from the date of the incident, since the insurance company may request a technical inspection of the vehicle to verify the damage received.
In addition, after filling out the notice and submitting it to the insurance company, you cannot change any of the data in it, so you should be careful when filling out the form.
