Fine for parking under a “No Stopping” sign

Some road driving violations are committed quite often. This can also be said about stopping a car under sign 3.27 “Stopping is prohibited.” Moreover, even drivers with extensive experience often confuse the concepts of “stop” and “parking,” which leads to fines being issued for this.

Incorrect interpretation does not relieve the violator from liability. Moreover, by committing such a violation, the driver puts himself at risk. And those drivers who pass by are also at risk.

  • What to do if you received a fine for sign 3.27?
  • The nuances of stopping within the sign's coverage area
For loading or unloading, boarding or disembarking passengers
  • Can disabled people stop?
  • Meaning and coverage area of the “No Stopping” sign

A sign prohibiting stopping of vehicles is presented in the traffic regulations under number 3.27 “Stopping is prohibited.” It looks like a blue circle with red edges, crossed out by a red cross.

In the area covered by the “No Stopping” sign, even temporary leaving of vehicles is prohibited, regardless of its category. Passengers and cargo cannot be boarded or disembarked. Only movement is possible. The essence of the restriction is simple - if the vehicle remains in place for even a short period of time, difficulties will arise for other vehicles. If these rules are ignored, the driver will be fined for stopping under a “No Stopping” sign.

The designation is valid until it is directly canceled or until the next intersection, as well as until the beginning or end of a populated area or sign 3.31 “End of all restrictions.”

The restriction can be set in conjunction with various signs that make it more focused.

Thus, plates 8.4.1-8.4.8 determine the type of transport that is not allowed to stop in the area of the sign. For example, 8.4.2. indicates that you cannot slow down when there is a trailer. This is most likely caused by a significant restriction of traffic flow in a particular lane or other circumstances that may interfere with other traffic.

The restriction is not always set due to problems with other vehicles. Sometimes stopping can be dangerous for the driver. If, for example, there is a sign 8.4.7, then, most likely, the danger is created for the cyclist, and not for those passing by.

Table 8.18 determines that a fine for stopping under a “No Stopping” sign will be assigned to everyone except drivers who are disabled. Additional guarantees for drivers with disabilities are established due to the availability of special social support from the state. It is more difficult for a disabled person to stop the car somewhere further and walk the extra distance; he may not have such an opportunity at all.

Table 8.2.4 defines the limitation area, as does 8.2.3. However, 8.2.3 states that the effect applies only to the part of the roadway in front of the sign, while 8.2.4 states that it applies both before and after.

How far does the sign apply?

The zone in which you can get a fine for “no stopping” in 2019 begins immediately after the installed sign. The sign suggests that stopping behind it is prohibited for all vehicles except route vehicles such as minibuses and trolleybuses.

The sign's coverage area may end at the next intersection even if, after the intersection, a sign prohibiting parking is not installed again. Also, the end of the zone may also be determined by a prohibiting parking sign with a clarifying sign underneath that parking is prohibited before this sign. These signs will have up or down arrows. All drivers know these signs, as they are part of the theory that everyone takes in the traffic police exam.

When is a fine not imposed for stopping under a “No Stopping” sign?

A car is a technical device that can break down at any time. No matter how good the condition of the car, a malfunction can occur at any time, regardless of the driver. Accordingly, in 2021, vehicles can be left under the “No Stopping” sign without a fine in the event of the following malfunctions:

    • Braking system. Using a car with such a breakdown can create danger not only for the driver himself, but also for others, as well as for property. Accordingly, operation seems impossible.
    • Control, that is, the steering system. Similar to braking, driving a vehicle that has problems in this system seems very dangerous.
    • Headlights and tail lights. This especially applies to situations where visibility is difficult, for example, at night, during fog, rain, and so on.
    • Window cleaning system if there is precipitation or visibility is difficult without cleaning.

These violations allow you to stop where the law may prohibit. Continuing to drive with such malfunctions entails the creation of emergency situations, which is why the legislator allows forced abandonment until the problems are fixed or the vehicle is evacuated.

The concept of a forced stop is given in paragraph 1.2 of the traffic rules. The standards also provide for a certain procedure that the driver must perform in this case in order not to receive a fine for stopping under a “Stopping is prohibited” sign:

    • Turning on the alarm (clause 7.1 of the traffic rules). The action is performed by pressing a special button. Most often it looks like a circle on which a triangle is located and is done in red or orange.
    • Displaying an emergency stop sign (clause 7.2 of the traffic regulations). It must be available to drivers at all times. Its absence may result in the application of additional penalties. It looks like a triangle with red fields.
    • Taking all possible measures to eliminate the malfunction and clear the roadway (clause 12.6 of the traffic rules). The driver must remove the car from the road as quickly as possible. At the same time, you need to understand exactly how transport can be removed. In some cases, you can turn on the hazard lights and drive away slowly, hugging the right side, while in others you will have to call a tow truck.

Leaving the car is also forced if the car stops functioning, regardless of the reason. The driver has no opportunity to continue driving. In this case, he must take the same measures as in case of specific breakdowns.

    What counts as a stop?

This article should begin with an explanation of the concept of “stop”, and in what cases it will be possible to receive a fine for it in 2019. The first step is to be able to distinguish between a stop and a parking lot. A stop involves a forced stop while driving for a period of no more than five minutes, when a stop is considered to be a stop that will last longer.

However, in the case of parking, there are several exceptions. It can be regarded as a stop in several cases: if it is a stop of a route vehicle or bus for the purpose of disembarking and embarking passengers, a stop for the purpose of loading or unloading. Only in these cases can a fine for “no stopping” be avoided in 2021. Anything else will be considered a violation.

As for places where stopping for no more than five minutes is allowed, it is also worth knowing how to park your car correctly, so as not to get a fine for stopping illegally in 2019.

So, the vehicle must be parked close to the curb and only parallel to it. Please note that parking in a herringbone pattern is only possible in those places where markings or an installed sign allow it. In all other cases, you risk getting a fine for “no stopping” in 2021.

Next, it should be explained how large the zone is in which you can get a fine for “stopping is prohibited” in 2021, and what nuances you should remember.

Amounts of fines for stopping and parking under a “No Stopping” sign in 2021

Violation of the rules provides for bringing the perpetrator to administrative liability on the basis of Article 12.19 of the Code of Administrative Offenses of the Russian Federation. The amount of the fine for stopping under a “No Stopping” sign in 2021 depends on the specific situation:

    • Violation of the rules, including leaving the car under sign 3.27 “Stopping is prohibited” - a fine of 500 rubles or a warning (part 1). It is considered a less severe offense, and therefore the amount of the fine seems less significant.
    • The same violation, if it entailed the creation of obstacles to other transport - a fine of 2,000 rubles (part 4). The violation is more serious because there is an additional person who is inconvenienced. Accordingly, the amount of recovery increases.

For Moscow and St. Petersburg, the amount of the fine for stopping under a “No Stopping” sign will be increased. Thus, under part 1 a person can receive a fine of 2,500 rubles, and under part 4 - 3,000 rubles.

Theoretically, a person who was obstructed by an illegal stop can file a claim for damages if any were caused. For example, as a result of unlawful actions, the driver of another vehicle was late for work and was fired. If travel was impossible at all, then compensation is possible. However, there is practically no practice on such issues; it is very difficult to prove your position in such a situation.

Additional expenses for the guilty party may be caused by the need to evacuate and place the car in an impound lot. The cost will be different in each region.

On what days is parking allowed?

Prohibitions on stopping under certain signs are prescribed in the Traffic Regulations and the Code of Administrative Offenses. Stopping for a stop sign can be bad for your record and your wallet. But there are exceptions that allow you to avoid financial punishment. If you see a sign with a red border and a blue center with two or one perpendicular white sticks and one diagonal red line, then this means that parking is prohibited only on certain days. One stick indicates parking restrictions on odd days, and two on even days. For violating the rules, you can receive a fairly large fine. In Moscow and St. Petersburg, the amount can reach 2,500 rubles. What is the purpose of installing such signs?

Because of parked cars, it can be quite difficult to remove snow and dirt from the streets, so utility services advocate installing such signs to clear roads in a timely manner. However, there are exceptions to every rule. In this case, relaxations in the law are provided for postal service vehicles and for taxi drivers with the meter on.

    Car evacuation

A car left on the roadway under sign 3.27 “No Stopping” can create significant obstacles to traffic, provoke a high accident rate or even block the passage.

Violations for which a car can be towed are presented in Article 27.13 of the Code of Administrative Offenses of the Russian Federation. In Part 1, among the violations, Article 12.19 is listed, that is, violation of the rules of stopping and parking. However, we are not talking about point 1. The car can be towed only if it interferes with the passage.

Evacuation is carried out only if the owner or driver does not appear before the start of the procedure. However, a fine for stopping under a “No Stopping” sign may still be issued. The decision is made by the traffic police inspector or the Administrative Road Inspectorate. A report on the arrest is drawn up, after which the car is sent to the impound lot.

Is it possible to stop under sign 3.27 “No Stopping” to disembark passengers in 2021?

Sign 3.27 suggests that not only parking is prohibited, but also stopping vehicles.

Paragraph 1.2 of the traffic rules establishes that a stop is a cessation of movement for up to five minutes or more, if this is required for unloading, loading or boarding passengers.

Parking differs in that it requires a longer period, from five minutes, and is not associated with loading cargo or boarding/disembarking passengers.

Sign 3.27 “Stopping prohibited” does not allow you to stop, even for a short period of time. Accordingly, passengers cannot be dropped off in its coverage area, otherwise a sanction may be applied to the driver for violating stopping rules.

Boarding and disembarking of passengers will be possible if the transport indicated on the sign is used (under numbers 8.4.9 - 8.4.15). This is how exceptions are set. For example, some places allow people to be dropped off by taxi, but it is important that it is properly marked.

Is it possible for disabled people to stop under a “No Stopping” sign?

The legislator provides for a number of concessions for people with disabilities regarding compliance with traffic rules. Some of them also concern leaving the car without moving.

Appendix 1, Section 3 of the Traffic Regulations contains exceptions. Thus, the effect of sign 3.28 does not apply to cars equipped with a special “disabled person” designation, that is, they can park the car where others are prohibited from doing so.

In 2021, the law does not allow citizens with disabilities to park their cars under sign 3.27 “Stopping is prohibited” and prescribes the imposition of a fine. The reason is simple - such abandonment may result in the creation of obstacles on the roadway. Allowing such an action would significantly infringe on the rights of other road users who would be hindered in their movement.

    Appealing a fine and evacuation

Persons brought to administrative responsibility have the full right to appeal decisions. This also applies to fines for leaving a car in the area covered by sign 3.27 “Stopping is prohibited.”

The procedure for appealing a fine for stopping under a “No Stopping” sign in 2021 is as follows:

    1. Obtain a decision to prosecute. If it is issued in front of the driver, it will be handed to him against signature. It is not recommended to refuse to receive it, as this will not bring any positive effect. You can indicate your disagreement with the document.
    2. Prepare a complaint against the decision. The text lists exactly what the driver disagrees with and on the basis of which standards he should not have been held accountable.
    3. File a complaint with the court or a higher traffic police authority.

The legislator allows for the possibility of appealing a fine for stopping under a “No Stopping” sign both through the court and through a higher authority of the traffic police. In practice, a judicial appeal seems to be a more effective option.

The text of the complaint must include the following information:

    • Details of the authority to which the document is submitted. This is its name, as well as the address where it is located. You can find out accurate information through the official website; now all government agencies have their own portals that contain up-to-date information.
    • Applicant details. His full name and residential address are indicated.
    • Data of the authority and traffic police officer who issued the decision.
    • Title of the document.
    • Listing of the main facts related to prosecution: date, place, other information related to the event.
    • Reasons why a document should be cancelled. It is important to correctly substantiate your position from the point of view of the current law.

At the end, a list of applications is indicated, followed by a signature and date. The appendices must contain all the papers that in one way or another relate to the issue, including the resolution itself.

In accordance with Part 1 of Article 30.3 of the Code of Administrative Offenses of the Russian Federation, a complaint can be filed within a period not exceeding 10 days from the moment the decision was received. It is possible to restore the missed deadline if there is a good reason for missing it. For example, if a citizen was sick or was on a long business trip.

    Nuances

Sign 3.27 “Stopping is prohibited” prohibits leaving vehicles in the coverage area. Its use may seem like an obvious procedure, but there are some peculiarities that need to be taken into account:

    • You cannot stop to pick up/drop off passengers or load/unload goods. Accordingly, parking is prohibited as a longer option for maneuver.
    • Some signs may indicate vehicles covered by the sign, meaning they are the only ones not allowed to stop. Others make exceptions, that is, they indicate that the sign applies to everyone except a certain type of transport. For example, sometimes you can let people out of taxis or you can't just stop a motorcycle.
    • There is a separate sign 3.28, which prohibits parking, but allows a temporary suspension of no more than 5 minutes.
    • The punishment depends on whether the car creates an obstacle for other traffic or not.

It is worth remembering that you cannot stand at all within the coverage area of sign 3.27, but a forced pause in movement is not considered a violation, since it occurs for reasons beyond the driver’s control.
