Deadlines for repayment of traffic fines according to the law

Having learned about administrative liability, some drivers do not agree with the measures taken against them and appeal the decision. The majority pay off the fine within the time intervals established by Article 32.2 of the Code of Administrative Offenses:

  • filing an application for an unlawful, from the violator’s point of view, decision – 10 days;
  • depositing funds in the amount of the assigned sanction in any way after the end of the appeal period - 60 days.

Thus, the administrative fine must be paid no later than 70 days after receiving the decision to prosecute.

Payment period

The countdown of the time allotted for paying the fine begins on the 11th day after delivery of a written notice to the violator via mail or a photocopy of the decision on traffic violation.

If a violation is recorded by road surveillance cameras performed in automatic mode, the motorist must sign for receipt of the notification, after 11 days, after which the countdown begins, during which the violator must repay the debt.

Important! There is a common misconception among motorists that if the recipient did not accept the notice and did not sign for its receipt, this eliminates the need to pay a fine. In fact, in this case, the resolution is returned to the traffic police video recording service within 1.5 weeks, and the violator is considered notified of the imposition of a penalty. The period provided by law for compensation of the sanction is counted from the date indicated on the stamp of the envelope affixed by the post office on the day the letter was returned to the traffic police.

The idea that after receiving a notice, the driver has a month to pay a fine of the specified amount should be refuted. After receiving a decision on a legal violation, the driver has 10 days, counted from the day after receiving the notice of penalty, to appeal the decision to impose sanctions.

If this does not happen, the sanctions come into force, while the statutory period for payment of the traffic police fine, in accordance with the current regulations of the Code of Administrative Offenses (2018), has been increased by an amendment (dated 05/09/2013) compared to the previously existing standards and amounts to another 60 days (previously 30 days).

Grace period for payment

The preferential terms for paying a fine are set out in part 1.3 of article 32.2. Code of Administrative Offences, and are presented with the opportunity to pay half the cost of collection within twenty calendar days from the date of the decision. Exceptions to the discount are as follows:

  • secondary and subsequent violations;
  • failure to register or drive a car without a driver’s license;
  • driving while drunk, as well as transferring control to an intoxicated person;
  • gross violations of safety rules (driving through a prohibitory traffic light sign, using the oncoming lane, etc., including those recorded by video recording).

Features of payment of fines

To the chagrin of motorists, not all offenses are eligible for payment at a discount. For those that must be paid in full, the standard procedure is that payment must be made within 60 days of the judgment.

If payment is unaffordable due to the high cost, which is due to the seriousness of the violation, the law provides for a deferment of payment for a period of no more than one month or an installment plan granted for three months.

By default, no one will provide such preferential conditions to a fined prisoner. To obtain them, you must contact the court and the traffic police department, where the order was issued with an application and a certificate confirming the income of the violator. Based on these documents, the above authorities will decide to provide preferential conditions when paying the fine.

What fines are paid in full?

The following types of offenses can only be paid in full; the discount does not apply to them:

  • the vehicle is driven while intoxicated or control is transferred to another person in a similar state;
  • all offenses committed repeatedly . Repeated offenses include offenses that occurred within the year following the payment of the previous fine or the end of the period of deprivation of rights. However, to assign the status of a repeat violation, its type may be different from the previous one. The fact itself is recorded, not its variety. Repeated violation implies increased punishment in the form of a larger fine or deprivation of a driver's license. And only for a repeated offense related to driving while intoxicated, criminal liability is already provided;
  • violations related to causing harm to the health of the victim , the damage of which can be classified as light or moderate;
  • If a decision is made to appeal the decision, then paying half of the traffic police fine may not be possible. This is due to the time spent sending a complaint against the decision, its delivery to the executor at the traffic police, the time it takes to consider the complaint and deliver the response to the addressee. This entire procedure does not fit within the allotted 20 days and in case of an unsatisfactory response you will have to pay the entire cost of the fine;
  • unpaid parking. In large cities, there are paid parking areas designed to regulate traffic in the central areas of the city. You can stand in parking lots for free for no more than 15 minutes; beyond this time an administrative offense is issued, the amount of which is individual for each city. The discount does not apply to this violation, since information about penalties for parking is specified only in the regulatory documents of the city that has a parking lot and is not reflected in the new law of the Russian Federation.

Fines for all other offenses may be paid subject to a discount. The full list of articles falling into this category is prescribed in Federal Law No. 437.

Is it possible to pay the fine in installments?

If a citizen is unable to adhere to the deadlines within the time given to pay traffic fines, he has the right to use the norms established in Article 31.5 of the Code of Administrative Offenses:

  1. Postpone execution up to one month. The decision is made by the person who imposed the punishment (court, authority, etc.).
  2. Request consideration of an installment plan of up to three months, providing evidence of income that does not allow you to make a lump sum payment. Other circumstances may also be considered when making a decision. You can pay off your debt ahead of schedule - you don’t have to wait until the term expires.

It is important to know! For foreigners or stateless persons, deferment (installment plan) is not provided in cases where the court makes a decision to simultaneously expel them from the state. The restriction also applies to the circumstances of offenses accompanying road accidents of vehicles with foreign registration.

Responsibility for delay

In circumstances where the deadline for payment of the traffic police fine has been violated, within the framework of Article 20.25 of the Code, the following enforcement measures are taken:

  • recovery of funds twice the amount of the initial sanctions, but not less than a thousand rubles;
  • administrative arrest not exceeding a period of 15 days;
  • involvement in compulsory community service, up to 50 hours in total.

In case of untimely fulfillment of the obligations imposed by the sanctions, simultaneously with the above incentive measures, the materials are transferred to the bailiff service. They have ample opportunities to collect debts from both legal entities and individuals.

Forced debt collection

The result of malicious violations of the deadlines for paying a traffic fine is the initiation of enforcement proceedings. In addition to collecting the main payment and the requirements of Article 20.23 of the Administrative Code, the violator pays a 7% fee (but not less than 1 thousand rubles). The tools to influence the execution of the decision are presented as follows:

  1. Collection of funds from active accounts of the debtor's financial organizations.
  2. Claiming part of your salary.
  3. Seizure of property, followed by sale at auction.
  4. Restriction of travel outside the country.

Advice! Among other things, a ban will be applied on registration actions, for example, with a car. If the debtor decides to sell it and pay off the debt himself, he will not be able to do this.

Limitation period for administrative sanctions

Despite the strictness of the debt collection procedure, the law provides for an amnesty if the deadlines for payment of the traffic police fine were significantly violated - the execution of the decision was not carried out within two years from the date of assignment (Article 31.9 of the Administrative Code). When calculating the time, the period presented for appeal is taken into account - you can not pay the penalty after two years and ten days.

You should not seriously count on successful payment evasion for the following reasons:

  • development of technology and equipping police officers with modern means of communication with databases, with the ability to check information online;
  • expanded debt collection capabilities and active work of the bailiff service;
  • impossibility of registration actions in the presence of outstanding fines.

The statute of limitations can be renewed if the debtor or his property is found even one day before the expiration. Keeping drivers informed about the deadline to pay a traffic fine allows them to avoid tougher sanctions, and if temporary financial difficulties arise, they can resort to installment payments.

What fines can be paid in the amount of half the fine?

Amendments to the current legislation established that when imposing a punishment under Articles 12 of Chapter 12 of the Code of Administrative Offenses of the Russian Federation, not specified in the section “What fines cannot be paid with a 50% discount the fine can be paid in half (see the table below).

The only condition is the deadline for paying the fine (no more than 20 days from the date of drawing up the decision on the case).

Please note that the period during which you can pay a fine with a discount is 20 calendar days, not from the date of receipt of the decision, but from the date of its issuance. There are often situations when a fine from cameras recording photo-video violations arrives by mail after such a period has expired. In this case, the deadline for paying half of the fine is not restored, and the fine must be paid in full.

The traffic police clarified that paying fines “at a discount” during the grace period is not a mandatory condition, but is an opportunity that the person held accountable may or may not take advantage of.
