In these situations, the vehicle is placed in a specialized parking lot until the reason for the decision made by the traffic police is eliminated.

To receive a vehicle, a package of documents is collected. In what situations can they refuse to return a car and what to do, read on.

For what violations can a car be towed?

To date, a fairly limited list of cases has been developed in which evacuation of a car is possible. All of them are listed in Article 27.13 of the Code of Administrative Offenses of the Russian Federation (law on the evacuation of a vehicle). Among them:

  • Driving a vehicle by a driver, without a title (Part 1, Article 12.3);
  • Driving a vehicle with a faulty brake system (except for the parking brake) and steering (Part 2, Article 12.5);
  • Driving a vehicle by a driver who does not have the right to drive, or who has been deprived of this right for violating traffic rules (Part 1, 2 of Article 12.7);
  • Driving a vehicle by a driver who is intoxicated (Part 1, 3, Article 12.8);
  • Failure to comply with the requirements prescribed by road signs or road markings prohibiting stopping or parking of vehicles, including in the federal city of Moscow or St. Petersburg (Part 4, 5, Article 12.16);
  • Violation of the rules for stopping or parking a vehicle in places intended for stopping or parking vehicles of disabled people (Part 2 of Article 12.19);
  • Stopping or parking a vehicle at a pedestrian crossing and less than 5 meters before them, or on the sidewalk, as well as in places where route vehicles stop (passenger taxi ranks) or less than 15 meters from places where route vehicles stop (passenger taxi ranks), with the exception of a stop for boarding or disembarking passengers, forced stop (Part 3, 3.1 Art. 12.19);
  • Stopping or parking vehicles on tram tracks; parking second or more next to the edge of the roadway; stopping or parking on the roadway, as well as in a tunnel, resulting in the creation of obstacles to the movement of other vehicles (Part 3.2, 4 Article 12.19).

If you have not violated the above rules, evacuating the car or attempting to evacuate it will be illegal.

Note: From August 8, 2015, a car can only be towed if the vehicle is within the coverage area of the “Parking Prohibited” and “Stopping Prohibited” signs. A “Tow Truck Operating” sign must also be installed. In other circumstances, evacuation is illegal; the owner of the car can only be issued a fine.

But if, despite the illegality of this action, your car was taken to the impound lot, it must be returned. Below we have provided a step-by-step guide to action:

Step 1

First of all, you need to find out which impound area your car was taken to. Since the violation is registered by traffic police officers, it is advisable to contact them. To do this, go to the nearest traffic police department or call 02 (if from a mobile phone, then 112).

All information is received by the traffic police promptly and literally within 10-15 minutes they already know which employee sent your car to the impound lot.

Moscow residents can also find their car on the websites avtokod.mos.ru and parking.mos.ru or by calling the hotline at mobile number 3210.

On the website of impound parking24.rf. you can find the addresses and telephone numbers of all penalty areas in Russian cities.

Step 2

Having found out where your towed car is located, go to the traffic police department whose officer detained your vehicle.

On a note! If this is Moscow, then in addition to the traffic police, you can contact MADI (Moscow Administrative Road Inspectorate).

Wherever you go to pick up your car from the impound lot, you will need to show documents for it.

Already on the spot, the service inspector will issue a resolution on an administrative violation of the rules. You will present this document to the impound lot employees, who in turn will write out a check for payment for evacuation services and vehicle downtime at the site and will take you to it.

What to do if documents are left in the car?

But, as often happens, the driver does not always have the documents with him, and when the car has already been taken to the impound lot, he realizes that the documents left with it, because they were in the glove compartment. We'll tell you what to do in this case!

  1. First, you need to drive to the penalty area, where workers will draw up the appropriate document - an autopsy report, and remove the seal from the driver's door, and you will take your documents. After all these steps, the employee will seal the car again and draw up a re-sealing report.
  2. And only now you can go to the traffic police or MADI, and then return to the impound area again to pick up your towed car.

Step 3

After you arrive at the traffic police department with your documents, you will receive a copy of the report on the detention of the car, a resolution, and permission to issue the car, which will need to be given to the workers of the impound area.

Now we go to the impound lot itself. They work around the clock. You can get your car back immediately, without first paying a traffic police fine or car towing services. This is stated in Article 27.13 of the Code of Administrative Offenses of the Russian Federation:

“The return of detained vehicles […] is carried out immediately after the reason for their detention has been eliminated.”

In order to pick up a car from the impound lot, you need the following documents:

  • PTS;
  • a copy of the arrest report;
  • A driver who is not the owner, but is registered with OSAGO, must additionally present a policy and driver's license.

Step 4

At the impound lot you should be given receipts for payment of services, which include the evacuation of the car and its storage. You will also receive a receipt for payment of the fine, which can be paid within 60 days from the date of receipt. But Muscovites can get a 25% discount if they pay all the receipts before picking up the car from the impound lot.

Important ! Before you happily get into your car and drive away, conduct a thorough inspection to identify possible defects that could have appeared as a result of its loading onto a tow truck and transportation.

While you are on site and have not yet left, you have the opportunity to present your claims to the company that towed the car to the impound lot.

Reasons for car evacuation

Tow trucks operate in accordance with the law of the Russian Federation - they have the right to pick up any car only if one of the violations occurs under Article 27.13 of the Code of Administrative Offenses:

  1. You parked incorrectly or left your car for a period longer than permitted in that parking area.
  2. You do not have a vehicle registration certificate.
  3. You are deprived of the right to drive a car.
  4. You are drunk.
  5. You are drunk and refuse to be examined.
  6. You were driving a car that had broken brakes or steering.

This is interesting: How to get pension savings for a pensioner

They do not have the right to evacuate if:

  • You do not have MTPL (since 2015).
  • You do not have a driver's license (since 2015).
  • There is another driver next to the car who has the right to drive this vehicle (there is STS, license and OSAGO), and he expressed his readiness to drive the car before the tow truck moved from the evacuation site .
  • There is no traffic police officer nearby to draw up a report.

What to do if the evacuation is carried out in your presence?

Experienced drivers know that if the owner of the car managed to appear at the place of evacuation of his vehicle before the tow truck started moving, then the further evacuation process should be suspended, and the vehicle itself should be returned to the driver, but only on condition that the reason for the detention is eliminated on the spot . (Article 27.13 of the Code of Administrative Offenses of the Russian Federation).

But what does the phrase “eliminate the reason for the detention on the spot” mean? We will find the answer in paragraph 147.1 of Order of the Ministry of Internal Affairs of Russia dated March 2, 2009 N 185, which reads as follows:

“If the reason for the detention of the vehicle is eliminated at the scene of the discovery of an administrative offense

  • provision of documents provided for by the Traffic Rules;
  • troubleshooting the brake system, steering or coupling device (as part of a train);
  • eliminating violations of the rules for stopping or parking vehicles on the roadway, which resulted in the creation of obstacles to the movement of other vehicles, or stopping or parking a vehicle in a tunnel;
  • eliminating violations of the rules for transporting large, heavy or dangerous goods;
  • provision of another person to drive the vehicle, in the absence of grounds for his removal from driving the vehicle; Before the detained vehicle begins to move, the vehicle is not placed in a specialized parking lot.”

An important document, without which evacuation of the vehicle will be impossible, is the vehicle detention protocol . It is drawn up by the traffic police inspector in two copies, and must strictly comply with the requirements for its content, namely:

  • indication of the time, date, place of drawing up the protocol;
  • the basis for making a decision to detain the vehicle;
  • surname and initials, position, rank of the employee who compiled the protocol;
  • information about the vehicle, as well as about the person (car owner) in respect of whom this measure was applied to ensure proceedings in the case of an administrative offense (in the event of the vehicle being detained in his presence);
  • information about the body (institution), position, surname and initials of the person who will execute the decision to detain the vehicle;
  • if the vehicle detention protocol is drawn up in the absence of the driver, it must be signed by two witnesses; It is possible to use a video recording (as a means of recording what is happening), which should be attached to the protocol. The protocol must also be signed by the person who compiled it.

Information ! If you, the driver, are near the car when it is detained, but despite the legal grounds for its return, the inspector continues to fill out the protocol, insist that he include in it a list of valuables located inside the car, and also indicate which There is damage to the vehicle.

Checking a car for theft

The first action you need to take is to contact the traffic police department directly.

Your main task at this stage is to find out whether your car has been towed or stolen.

Information about all evacuated cars is centralized to the “duty room”, so if a car is detained and delivered to a special parking lot, you will be informed about this.

If the car has been towed, then check which traffic police department inspector drew up the administrative violation report and which parking lot the car was sent to. Have a pen and a piece of paper to write down all the data. The code states that the decision to return the car to you or not should only be made by the traffic police inspector. Therefore, the next stage is communication with officials of the traffic inspection department, whose inspector drew up a report and called a tow truck.

To communicate with the inspector you will need:

  • driver's license;
  • vehicle registration certificate;
  • OSAGO policy.

Impound lots

How much does evacuation and demurrage cost at the impound lot in 2021?

Services for evacuation of a car and its storage at the impound area are individually determined by the authorities of a particular region.

For example, in the capital, evacuation services are estimated at about 3,000 - 7,000 rubles (the cost is affected by engine size). In the Moscow region, the tariff is 4,227 rubles. In St. Petersburg, towing a car costs 2,700 rubles.

The same applies to the cost of storing a car at a impound lot. in Moscow, the owner of the car will have to pay 1,000 rubles for one day of downtime, in the Moscow Region - 100 rubles / hour, in St. Petersburg - 32 rubles / hour.

Note : the first day of storing a car at the impound lot is not paid for!

According to the new rules, the “violator” does not need to pre-pay for services for evacuation and storage of the vehicle. The car will be issued upon request, without advance payment. The driver will be able to repay the debt later, and if he meets a certain deadline, he will even receive a discount.

The car was damaged as a result of falling from a tow truck

Where to call in St. Petersburg if your car has been towed

an hour after the evacuation. — illegal parking in St. Petersburg is now VERY expensive: 2.7 rubles for a tow truck, 30 rubles per hour for storing a car in an impound lot, 3 rubles for a fine for violating traffic rules, in total, at least 5.7 rubles! - during the same day you can go straight to the parking lot, everything will be processed there and the car will be returned (payment only in CASH) - if later - through the traffic police. Something like that. PS I must note that I didn’t encounter any rudeness or rudeness anywhere, I was surprised. PPS Do not violate, and you will be happy! PPPS Good luck to everyone and good luck on the roads!

PS If you manage to find out contacts in the first stages and contact the duty department of the traffic police unit that made the arrest, then you will be able to find out from them how to obtain permission to issue a vehicle. Maybe you won't have to go to the impound lot twice.

What to do if your car is scratched or damaged during evacuation

There are cases when the car was taken by a tow truck to the impound lot and later it turned out that he damaged it. To prevent this from happening to you, next time inspect your iron horse for possible defects received during transportation to the impound lot.

When receiving the car at the impound area, the driver will be asked to sign an acceptance certificate. We advise you not to rush into signing, but to conduct a thorough inspection of your vehicle.

If you find that there are any chips, scratches, or dents on the car, indicate this in the report.

The next step is to estimate the cost of repairs at the service center and demand compensation for the costs from the company that towed the car and stored it at the impound lot.

Lawyer quote:

You can write a claim to the evacuation service; in case of refusal or silence, file a claim in court. You must put a note from the evacuation service on your copy of the claim upon receipt of the claim. Refer to Article 1064 of the Civil Code. Harm caused to the person or property of a citizen, as well as harm caused to the property of a legal entity, is subject to compensation in full by the person who caused the harm. And also to Article 1068 of the Civil Code of the Russian Federation. Entity

or the citizen
compensates for the harm caused by his employee in the performance of labor (official, official) duties.
In addition to the towing service, write a claim to the parking fine; you will also need their response if there is further proceedings.

Since the activities of these organizations are subject to insurance, problems with paying compensation to the injured person will not be a big problem for them and everything will happen quite quickly.

If your demands are not met, go to court. In this case, tow truck operators will have to not only compensate for the costs associated with car repairs, but also the costs of lawyers and the court.

How to find out which impound lot a car is in Moscow

In this case, the first thing you need to do is go to the impound lot. In the presence of the car owner, the employee will have to fill out an autopsy report, after which it will be possible to obtain the necessary documents. Unfortunately, drivers do not always comply with traffic rules: they drive while drunk or without a license.

Nobody wants to quarrel with the law, be nervous while looking for a car, and even part with a lot of money in order to get the car back safe and sound. A traffic police inspector can fine a car when there is a driver in it, but also when there is not. Let's figure out in what cases a car ends up in a parking lot.

How to challenge the evacuation of a car and its storage in an impound lot: list of documents

To appeal the evacuation, you need to collect a package of necessary documents. You will need:

    1. Copy of the passport.
  • A copy of your driver's license.
  • A protocol received from the traffic police confirming the fact of evacuation of the vehicle.
  • PTS.
  • A copy of the receipt for payment of the issued fine.
  • If there is a court decision, it must be attached to the documents.
  • Photos and videos proving the fact of illegal evacuation of the car.
  • Testimony from witnesses will also be needed in court.
  • If the legal representative of the owner of the evacuated car goes to court, he will need to provide a notarized power of attorney.

Due to the fact that the court will require evidence of illegal evacuation, it is advisable to provide it, so do:

    1. Photos and videos on your phone. They should show that the car was parked in a place that is not prohibited for parking.
  • Screenshots of panoramas from the place where the car was evacuated.
  • If a recording was made from the car recorder during the loading process onto the tow truck, this will also need to be provided.

Deadlines for consideration of the application in court and return of money

An application must be submitted to the traffic police within 10 days from the date of evacuation of the car. The authorities responsible for parking spaces in the city should be contacted within 10 days. As a rule, the processing time for an application is 5 business days.

If you decide to challenge the evacuation through court, you have 3 months to do so. During this time, you need to prepare materials on the case and attach all certificates and documents from the authorities that you applied to before.

If the court's decision is positive, the funds will be returned to the account specified in the application within 2 weeks.

As a rule, the court considers the claim for about 1-2 months. The case will go faster if the plaintiff’s interests are challenged in court by a lawyer. Moreover, he will help you file a claim in accordance with all the rules.

Where to call if your car has been towed to St. Petersburg

— You come to the traffic police, receive written permission to release your car, presenting all the necessary documents (a document confirming the ownership of the detained vehicle, i.e. a vehicle registration certificate and a power of attorney, for those who are not the owner of the car). Here you will be given a fine of 3,000 rubles (which you must pay within 40 days), and will be asked to mark: agree, disagree.

The towed car will be returned to you only after paying the cost of moving the car. You can pay for the towing of your car at any bank, at terminals installed in traffic police departments or directly in the parking lots themselves. For this purpose, special terminals have begun to be installed at impound lots in Moscow (the commission for transferring funds is 2%). To pay through terminals, you need to select Payment for services in the main screen of the terminal, then go to the Transport section, touch the Moscow parking button and click on Payment of a fine for storing/towing a car. Then enter the state number of the vehicle, after which the amount of debt will be displayed on the screen. Remember, terminals often only accept cash.

Fine and tariffs

The fine will depend on what exactly you violated. For example, for illegal parking in Moscow in 2021 it is 3,000 rubles. To these costs are added the tariffs for the work of the tow truck and the hourly presence of the car in a special parking lot.

Below are some approximate figures by city:

CityHour in the impound lot, rub.Tow truck services, rub.
Moscow41.6 from the second day (the first is free)5000
Saint Petersburg322700
Novosibirsk44,81750
Ufa25 from 13 hours of presence1500
Kazan601200
Ekaterinburg331090
Krasnodar252225

This is interesting: Disabled children and children with disabilities
Thus, for example, evacuation in Moscow can cost the driver about 9-10 thousand rubles (5,000 for the tow truck itself, 3,000 for incorrect parking, 1,000 for a day of parking). This is quite a large amount, so there are “incentive” discounts, for example:

  1. For paying a fine on the spot or within 1-2 days – 25 percent.
  2. For paying a fine in the first 20 days - 50 percent of the fine.

Discounts, like the cost itself, depend on the city, the impound lot and the nature of the offense.

Don't pay for tow truck services

The whole idea of evacuating for wrong parking comes down to commerce . They simply collect money from ordinary citizens for the imposed tow truck services. Do not pay for this service on site. Let them write out the invoice .

Towing service workers do not have the right to seize your vehicle. In fact, they do. If they get really impudent, call the police . Let them check.

Sometimes, tow truck operators are simply outrageous:

As a rule, “tow truck operators” are a kind of commercial structure that imposes and provides a service at an arbitrarily set rate.

In order to issue you an invoice for tow truck services, tow truck operators must know personal information about the driver of the vehicle. You don’t have to provide any information to tow truck operators or sign any statements. But in this case, they will not let your car out of the parking lot. If you have a principled position, then call the police. The fact is that tow trucks do not have the right to detain your car. Only police officers can do this.

Don't pay tow trucks on the spot. Let them write out an invoice for the services (give them a receipt).

Further, there are two ways to pay for tow truck services:

  • after the decision on an administrative offense comes into force and the fine is paid, you can voluntarily pay for the services of a tow truck.
  • do not pay for the services of a tow truck at all, let them go to court and collect in court , prove in court that they provided a service for transporting the vehicle.

Appealing a decision on an administrative offense

You can appeal a decision in a case of an administrative offense according to the rules of the Code of Administrative Offenses of the Russian Federation. You can appeal to a superior manager or to court. I suggest appealing to the court.

In order to effectively appeal a decision to hold you administratively liable, you can:

  • contact a lawyer to write a complaint against the decision;
  • write a complaint yourself; For your own writing, I suggest you use my sample. It needs to be slightly modified to suit you.
