According to the Code of Administrative Offences, driving a car without a motor insurance policy is an offence. But to obtain it, you need to prove to the insurer that the car is in proper technical condition. The vehicle owner can do this in only one way: by showing a legally completed and valid diagnostic card form. A very popular question among drivers is whether it is possible to issue or renew an MTPL policy without a diagnostic card, and how to do this? Let's look at all the options available to a car owner for concluding a car insurance contract.

Basic facts about OSAGO

An MTPL policy is a document issued for a specific vehicle indicating the persons who can drive it. Its presence is mandatory; for absence there is a fine.

Let us note that, first of all, the owner of the car needs the policy, since in the event of an accident that was not his fault, he will receive compensation for repairs.

In the absence of insurance, all costs fall on the shoulders of the car owner. Today, registration of compulsory motor liability insurance is permissible both through personal application and through the official websites of insurance companies. The cost of the policy and the conditions for obtaining it are identical regardless of the form of purchase. The price depends on the number and experience of drivers, the presence or absence of an accident involving the car.

OSAGO is more expensive for reckless drivers

But first things first. Amendments to the law were published on the official Internet portal of legal information. In accordance with them, from the moment of publication, that part comes into force that cancels the obligation to provide a diagnostic card when purchasing a policy. That is, this amendment has already entered into legal force. And it applies to all contracts concluded from March 1.

This was adopted due to the fact that due to quarantine measures, car owners had difficulties passing inspection. In many regions, service centers are simply closed. Therefore, buying insurance was a problem. Now there is one less problem.

But we must keep in mind that after September 30, car owners are required to undergo a technical inspection and present a diagnostic card to the insurer within a month, no later than October 31. However, the government received the right to increase these periods, but not by more than 90 days.

If the car owner does not pass the technical inspection, the policy will continue to be valid. And if he causes an accident, the insurer will pay compensation to the victims. But he will be able to submit recourse claims to his client for the entire amount paid.

90 days after publication, that part of the amendments that is aimed at even greater individualization of the tariff comes into force.

Now the insurer can set a tariff within the tariff corridor established by the Central Bank for the region. Now the insurer will be able to set a tariff for each driver personally. If the client does not bring losses to the company, he can be assigned a tariff at the lower level. Now for passenger cars of individuals it is 2,746 rubles. If a client constantly has accidents and the insurer constantly has to pay for it, then he will be assigned a tariff at the maximum level - this is 4942 rubles.

All coefficients that are in effect now will remain when this part of the amendments comes into force. The coefficient for territoriality will remain, as well as depending on engine power, which it was recently proposed to remove. But a new factor will be added that increases the cost of insurance. Namely, for gross and repeated violation of the rules.

The cost of the policy will increase for those who have had their license revoked for driving while intoxicated or for an accident in which people were injured or killed. And also for those who were deprived of their rights for refusing a medical examination or leaving the scene of an accident.

Also, an increasing factor will be established for such repeated violations during the year as driving through a prohibiting traffic light or a traffic controller's gesture, speeding by more than 60 km/h or driving into oncoming traffic. But provided that these violations were not detected automatically. It is clear why such an exception was made, because with automatic recording it is not known who was driving and committed these violations.

It is surprising that the list of traffic violations does not include driving in the opposite direction on a one-way road. And this is a separate composition and a separate article of the Code of Administrative Offenses.

What this coefficient will be is still unknown. It should be installed by the Central Bank. The Central Bank has been given 90 days to develop a new directive that will establish a tariff corridor and coefficients.

Conditions for purchasing insurance

A compulsory car insurance policy is a document giving the right to receive compensation from the company in the event of an accident. It is advisable to familiarize yourself with all registration rules in advance. So, the key conditions for purchasing insurance include:

  • the policy is issued for one year;
  • registration of insurance is possible both online and by receiving a paper copy at the company’s office;
  • the owner has the right to choose any licensed company, and that, in turn, cannot refuse to issue it, but sets its own prices.

We also note that if the owner does not provide an inspection certificate in the list of documents, and the car is older than three years, then the company inspects the vehicle independently. When registering for compulsory motor liability insurance, a diagnostic card guarantees that the machine is in good working order and can be used.

The need for technical inspection

The serviceability of a vehicle is a mandatory element of the normal process of its operation. Please note that monitoring is carried out annually. In the first three years, car owners are exempt from undergoing maintenance, since it is believed that all its systems are in good working order.

From a logical point of view, the process is defined as follows. To drive a car you must have an MTPL policy. Its registration is possible if you have a valid diagnostic card. What the law says

On June 1, 2011, Federal Law No. 170 “On the technical inspection of vehicles and the compulsory compulsory motor liability insurance policy” was adopted. But over the course of the year, significant shortcomings were identified, so in December 2012, amendments were made to the Law on Compulsory Motor Liability Insurance.

They came into effect in January 2013. The amendment related to the diagnostic card, which became a full replacement for the technical coupon.

Innovations have made life much easier for many motorists, as paperwork has become simpler, and in many situations the driver has found himself more financially protected.

Previously, a temporary policy could only be obtained to move a car to the place of new registration, but now it is allowed to issue it to deliver the car to the place of maintenance.

Now, in order not to break the law and transport your vehicle yourself, you can take out a temporary policy for twenty days.

The revised paragraph 3 of Article 10 of the adopted Federal Law of 2011 explains in what situations it is possible not to present a maintenance document when applying for a policy.

It also legislates the possibility of issuing a temporary policy in certain cases provided for in this paragraph.

Paragraph 3 cancels the rule on the six-month validity period of the technical inspection document. Previously, in order to purchase an insurance policy, it was necessary to have a maintenance certificate valid for six months.

Now you can renew your policy even with a document that expires in a few days.

The original law, with its ill-conceived aspects, made subsequent reform regarding road transport and car owners much more difficult.

As a result, after several years of action of the new standards, there are proposals to completely cancel technical inspection. Taking out car insurance without maintenance is now practiced in Georgia.

Since 2013, the inspection ticket has been abolished and now the car owner can undergo inspection where it is more convenient for him without being tied to the place of registration of the car. Instead of a coupon, a diagnostic card was introduced.

Companies that provide licensed policies include: RESO, Alfastrakhovanie, Ingosstrakh, Rosgosstrakh. All of these companies are on the RSA list.

When everything is approved, an agreement for the provision of this type of service is concluded between you and the center that will carry out the inspection. It is this that will serve as the basis for subsequent claims, if any, as well as for making all necessary payments.

Why is it worth getting tested in advance?

In fact, the new rules should not affect conscientious drivers in any way. However, in practice, during the first months, motorists may encounter queues at technical service stations. According to Sravni.ru Insurance Director Alexander Krainik, currently the register of the Russian Union of Auto Insurers includes only 5,077 technical inspection operators, where you can issue a diagnostic card. The stations themselves are most often located in a city or regional center. This means that other residents of the region have to travel far for diagnostics. Moreover, by March 1, the number of accredited operators may decrease even more; not all of them will meet the new requirements, which means they will be excluded from the database.

And the number of diagnostic cards issued by one service will be limited. This will create a collapse of technical inspection points,” explains the expert. “At the same time, the diagnostic card itself is connected with the issuance of compulsory motor liability insurance - in the end, you can get behind the wheel when the compulsory motor liability insurance expires, and you cannot go to the inspection station - after all, without compulsory motor liability insurance you cannot drive, and you cannot buy compulsory motor liability insurance, because you need to get to the station.”

To avoid this, it is better to make a new diagnostic card in advance, before updating the procedure.

Since insurance company agents are interested in getting the maximum number of customers who apply, they try to find numerous ways to do this. This also includes the issuance of policies without existing valid diagnostic cards. They receive bonuses and premiums, and you will not be able to receive anything if insurance claims occur. The fact is that such an agreement will be declared invalid, since without an inspection card the car does not have the right to appear on the roads and streets.

There will be savings, but they are insignificant. There will be no need to undergo inspection at technical centers, and this reduces costs by only 600-800 rubles. And the transport itself will not need to be brought into proper shape, and everything necessary for inspection will not be done in it.
