File a complaint against KBM under OSAGO
The KBM has been installed and used since 2003. The mechanism for its use is prescribed in the law on compulsory motor liability insurance. To calculate what size of the motor vehicle insurance policy a particular driver is entitled to, you need to use the database maintained by the Russian Union of Auto Insurers - RSA. All information on this indicator enters the database automatically.
When calculating the cost of an insurance policy, OSAGO KBM is not applied if:
- the policyholder takes out transit insurance;
- the car is registered in another country;
- The policy is issued by a newcomer without driving experience (by coefficient 1).
Where to send an application for restoration of the KBM

Reasons for writing a complaint
You can complain about the insurance company in the following cases:
- If the insurer does not use the KBM when calculating insurance.
- If the KBM is calculated incorrectly.
Using a special table with KBM values, each driver can pre-calculate his class and reduction factor. You need to reasonably protect your rights and correctly calculate the amount of the discount on the policy. If the calculation is made incorrectly, you must contact the insurance company with a request to apply the correct KBM.
KBM flew off - reasons
So, the bonus-malus coefficient is one of the components when calculating the cost of compulsory motor liability insurance, affecting this cost up or down.
KBM works simply: the longer you were not at fault in an accident, the less the policy will cost you. Every year, if you do not get into an accident and become the culprit, the total price of insurance falls by 5%.
An important condition for increasing this coefficient is that you must not only be the culprit in the accident, the victim must contact the insurance company. That is, there must be a payment or repair for the insured event. Only then does it affect the rise in the cost of compulsory motor insurance.
There are a number of reasons why the KBM is reset. Let's immediately divide them into those after which it is impossible to restore it “failure-free”, and those when the KBM is subject to restoration.
When can a fallen KBM cannot be restored?
- If you are involved in an accident in which you are found to be at fault (including partially in cases of mutual fault), then it is obvious that the MBI will be increased. We discussed in detail the question of how much the discount is reduced in a separate article with examples.
- If you have been included in the MTPL policy for less than a year . That is, if you were included in the policy in the middle of its validity, and then included in a new policy for the same car, then the KBM discount will not increase, since a year has not passed.
- If you have not had insurance for more than 1 year . That is, they were not included in any MTPL insurance policy and were not the owner of unlimited insurance.
- You have reached the maximum KBM discount . It is 50% (class 13) and then stops growing.
When can and should a reset KBM be restored?
Now let’s look at a number of reasons why the discount for accident-free operation was lost in the context where it definitely needs to be restored.
- The insurer ignored the bonus-malus ratio . Moreover, he did it through inattention or haste. This often happens if you are included in several insurance policies. Then the likelihood of such an annoying mistake is higher. Under such circumstances, the KBM can and should be restored.
- You have been deceived . In an impudent manner and without a drop of embarrassment. The insurer's employee or insurance broker/agent did not specifically enter the KBM data into the policy. Most often in such cases, class 3 is entered with a zero discount.
- The KBM value does not appear in the RSA database because it was entered with errors . The most common errors occur in the driver's date of birth or patronymic.

Where to write
In accordance with the law, complaints filed against the Investigative Committee are processed by three organizations:
- RSA;
- Rospotrebnadzor;
- TSB RF.
Since 2015, filing a complaint has become much easier. To do this, you can use the website rgs.ru to send a complaint by email. This document will be sent to the addressee almost instantly, and will allow it to be processed in the manner prescribed by law. If the complaint is sent by email, you must attach scanned or photographed documents to it.
The bulk of claims under KBM are reviewed by RSA. If there is no response to the appeal, the exact same complaint must be sent by mail to Rospotrebnadzor or the Central Bank.
If in this case there is no reaction, or the decision is negative, if he is confident that he is right, the driver has the right to file an application with the court. This is an extreme measure, and it is very rarely achieved. But you need to know what to do if the issue has not been resolved in the above authorities in order to defend your legal rights.
Typically, at the PCA level, such complaints are resolved quickly, while insurance companies have to recalculate the price of policies, while applying the legal parameters of the CBM.
How to restore bonus-malus if it was accrued incorrectly?
If an error is detected in the calculation (accounting) of the BMR value, it is necessary to send a request (demand, complaint) to correct it. Let us recall that RSA is responsible for operating the database in the AIS OSAGO, but the ability to enter and correct data, and therefore restore the normal parameters of the KBM, lies with insurance companies .
Accordingly, the complaint must be sent to the insurer that issued the policy. Theoretically, any insurance company can correct the data, but it is better to contact your own, where various bonuses are awarded - it will be both faster and more reliable.
How to correctly submit an application to the Investigative Committee for the restoration of the KBM?
This is a fairly simple and relatively free form. The main parameters that need to be specified:
- Name of the insurance company.
- Information about the applicant – full name, date of birth, address.
- Number of the current or previous MTPL policy.
- Information about the KBM used in calculating the cost of the policy.
- Data on the KBM, including previous ones, are correct from the point of view of the applicant.
- Information about the presence or absence of an accident.
- Date, signature.
The application must be accompanied by copies of everything that may be relevant to the case: compulsory motor liability insurance policy, information about the accident, etc.
