In Moscow, not only traffic police inspectors can issue fines to drivers for traffic violations. There is also a MADI in the capital. To more fully understand the purpose of this structure, it is necessary to study the scope of its activities, powers and violations for which employees of the organization can issue a fine. All these issues will be discussed in detail in the article.

What is MADI?

The abbreviation MADI stands for Moscow Administrative Road Inspectorate. This organization was founded in 2013 to expand the capabilities of recording and suppressing violations of parking rules and the requirements of road signs or markings by the capital's executive authorities. MADI operates only in Moscow.

The organization operates in accordance with established regulations. In particular, the responsibilities and powers of this structure are outlined in the “Regulations on the Moscow Administrative Road Inspectorate” No. 679-PP, adopted on October 14, 2013.

According to this document, MADI is a government agency designed to identify vehicle parking violations. If the actions of drivers do not comply with traffic regulations, the structure has the right to impose punishment in the form of an administrative fine. In some cases, collection may be accompanied by towing of the car.

Drivers may not show their documents to MADI employees

Conflict situations related to the need to provide documents to employees of the Moscow Administrative Road Inspectorate (MADI) began to arise after road inspectors were transferred a number of powers from internal affairs bodies. The fact is that MADI employees, when deciding on the evacuation of a vehicle, regularly require owners to present documents (driver’s license, vehicle registration certificate, and so on). But by law, the driver is obliged to provide the relevant documents exclusively to police officers. MADI inspectors do not have the right to demand documents from a motorist: this organization is not mentioned at all in the traffic rules. In fact, the common practice is actually a violation of the law.

Moscow activists have repeatedly drawn attention to the discrepancy between the demands of MADI employees and Russian legislation. To clarify the situation, the Chairman of the Committee on Public Associations and Religious Organizations, deputy head of the LDPR faction Yaroslav Nilov sent a corresponding request to the Prosecutor General's Office. In his request, the deputy asked the prosecutor's office to clarify whether the requests of MADI employees to show documents can be considered legal.

The Moscow City Prosecutor's Office gave an official explanation, according to which the driver can present documents to MADI employees only voluntarily. If a conflict situation arises (in particular, if the driver refuses to provide the road inspector with the required documents), employees of the State Traffic Inspectorate must be called to the place of the conflict.

“We are talking not only about cases of forced detention of a vehicle, but also about other cases, for example, when the decision to evacuate has not yet been made, the driver of the vehicle appears, and a MADI employee demands to provide documents for prosecution. This is a gross violation of the law until appropriate amendments are made to the traffic rules. The same can be said about situations not related to the evacuation of vehicles, when a walking MADI employee approaches an illegally parked vehicle and demands that the driver provide documents for prosecution, which is also a violation,” Yaroslav himself commented on his request and the response from the prosecutor’s office Nilov.

Methods for checking and paying fines

First of all, the decisions of the capital’s authorities contradict federal laws, the lawyer is convinced. The Supreme Court of the Russian Federation clarified that when considering this category of cases, one should be guided only by the Code of Administrative Offenses of the Russian Federation and the laws of its constituent entities adopted in accordance with it on issues within their competence. Establishing the procedure for proceedings in these cases falls under the exclusive jurisdiction of the Russian Federation and is not within the competence of the Moscow Regional Duma and the Moscow Mayor.

This means that fines can only be issued in accordance with the Code of Administrative Offenses of the Russian Federation. And owners cannot be fined for not having passes based on traffic cameras. In this sense, the Code of Administrative Offenses of Moscow and the decree of the mayor of the capital should not contradict federal laws. Plus, it is not within the competence of the Moscow City Duma and the mayor to change this order, the lawyer noted.

All MADI resolutions contain a reference to the norm of the Code of Administrative Offenses of the city of Moscow. According to which, a fine can be imposed if a violation is detected by “electronic monitoring technologies” and “city video surveillance system.”

How to determine the structure that imposed the fine

There are many organizations in Moscow that are authorized to issue fines for non-compliance with traffic rules. In this regard, drivers often do not understand where to go when imposing a penalty. The answer to this question can be found in the executive document itself.

To do this, you need to study the UIN (unique identification number) of the resolution. Using this code, you can clarify the status of the penalty, the date it was assigned, as well as the organization that recorded the violation.

  • If the resolution number consists of 20 digits and begins with the combination 782, then the fine is imposed by MADI.
  • Also, decisions of this structure may have a 25-digit number starting with 03560430.
  • If the UIN begins with the numbers 780, then the collection was ordered by the AMPP service.
  • A number starting with combination 188 indicates a traffic police fine.

What is MADI, and what can you get a fine for?

MADI is an organization operating at the regional level. It was formed in Moscow, receiving some functions of the traffic police. In particular, you can receive a fine from a representative of the Moscow Administrative Road Inspectorate for the following violations:

  • parking under signs 3.27 and 3.28 on public roads located in the capital;
  • parking on the lawn in Moscow;

Amounts of fines
The Moscow Administrative Road Inspectorate was created to achieve two goals:

  1. Combating parking violations.
  2. Redistribution of financial flows received when paying fines.

The emergence of MADI made it possible to relieve some of the responsibility from the capital’s traffic police officers. At the same time, the new organization works precisely and substantively, recording even minor offenses. MADI operates within the framework of the Code of Administrative Offenses of the Russian Federation, and therefore, if fines are paid on time, motorists can receive a 50 percent discount. However, this rule does not apply to all types of violations.

The amounts of fines issued by MADI employees may be as follows:

  1. Ignoring the requirements of road signs and markings when parking or stopping a vehicle is fined 3,000 rubles. If payment is made on time, the motorist can receive a discount, and the total amount will be 1,500 rubles. Cars may be towed.
  2. Parking on the lawn - 5,000 rubles. No discount provided. Car evacuation is possible.
  3. The taxi driver violated the rules for transporting passengers or luggage. The fine is 3,000 rubles without evacuation. A 50% discount is possible.
  4. Violation of conditions for loading/unloading goods at night. We are talking about the operation of shopping centers and stores built into apartment buildings. Depending on the severity of the offense, the fine can range from 1,000 to 2,000 rubles. There is no provision for evacuation.

In accordance with Part 4.2.2 of the “Regulations on the Moscow Administrative Road Inspectorate”, MADI employees are authorized to impose fines for non-compliance with the norms of the Code of Administrative Offenses of the Russian Federation or the Code of Administrative Offenses of the city of Moscow. MADI fines imposed for violations of the Code of Administrative Offenses of the Russian Federation can be paid with a 50% discount. To do this, you must make a payment before the expiration of 20 days from the date of drawing up the resolution. How to return a car from an impound lot

If the car has been towed, the owner must call the helpline number. Here he will be able to obtain information about the evacuated vehicle at any time of the day.

To pick up a car from the impound lot, you must prepare the following documents:

  • passport of a citizen of the Russian Federation;
  • papers confirming ownership of the car.

You can obtain permission to return a vehicle at one of the service centers or at the MADI permit issuing point. Cars are most often evacuated to one of the AMPP parking lots.

Appeal procedure

In case of disagreement with the penalty imposed by MADI, the motorist can appeal the fine within 10 days from the date of registration of the decision. To confirm that you are right, it is recommended to obtain evidence of the legality of your actions. The most compelling arguments are photo or video materials.

A decision on an administrative offense can be appealed directly to the structure that imposed the punishment, or in court. The motorist can independently determine the most suitable option for himself. To do this, you need to file a complaint against the actions of MADI employees and express your disagreement with the imposed fine. You will need to attach the available evidence of your case to the complaint and personally transfer the materials to the selected structure.

It is also possible to appeal MADI fines via the Internet. To do this, you will need to use one of the available Internet resources, for example, the Autocode portal. After authorization in the system, the driver must go to the “Appeals” section and select the “Appeal MADI fine” menu item.

Receiving a car

Contact the specialized parking lot at the address you received. To return the car you must present a package of documents:

  • A copy of the protocol on the administrative violation or a copy of the protocol on the detention of the vehicle with a note from the official that the reason for the detention has been eliminated
  • Receipt for payment for moving the vehicle
  • Receipt for payment of storage costs (in case of storage for more than 1 day)
  • The owner requires an identification document and a document on the right to own the vehicle
  • For the owner’s representative who has the right to drive a vehicle: MTPL policy and power of attorney or waybill for a legal entity
  • For the owner's representative who does not have the right to drive the vehicle: documents certifying ownership of the vehicle, the recipient's passport and power of attorney to receive the vehicle
