How many days before the expiration date is a new OSAGO policy purchased?

According to the law, compulsory motor liability insurance is a mandatory document for all drivers, so failure to comply with it is fined, and the issue of meeting deadlines remains very relevant. Because of this, many vehicle owners are interested in whether it is possible to obtain this car policy in advance or extend it until the end of the current validity period.

Re-concluding a contract in advance is necessary in quite common cases, and it is important to figure out how many days before the expiration of the current insurance you can conclude a new version of the deal. What circumstances should you pay attention to in this situation?

How to buy a new policy if the old one has not expired?

Domestic legislation in 2021, in principle, does not limit the right of drivers to take out new insurance if the validity period of the old copy has not yet expired. Such a prohibition is not contained either in the law on compulsory motor liability insurance No. 40, or in other insurance rules of the Central Bank of the Russian Federation or related regulations.

At the same time, it is worth remembering that by default, every car insurance contract is public, so it has significant restrictions. For example, the Civil Code of the Russian Federation and road safety requirements imply for such contractual relations the seller’s obligation to conclude a new transaction at the buyer’s first request.

From this it follows that the company is obliged to sell the mentioned service. But at the same time, the law allows firms to consider any application for a whole month (Article 445), and allocates another month for discussing the protocol of disagreements.

Is it possible to change rights before their expiration date?

To drive a vehicle, the driver must have a driving license; it is issued for a certain period, after which the driving license must be replaced.

But under certain circumstances, a driver’s license must be replaced ahead of schedule, and for some categories of citizens the replacement process seems very difficult.

To have an idea of what needs to be done, in what cases the Law allows early exchange of a driver’s license and what the procedure is, read our article. We tried to answer the most frequently asked questions in detail.

Refusal for early replacement

New legal acts do not establish specific deadlines for early replacement of rights, so good reasons for refusal are needed:

  • The driver did not pay the fines imposed on him for traffic violations. You can check the presence of traffic police fines online using both the vehicle’s license plate number and your driver’s license.
  • Prepared an incomplete set of documentation.
  • The main civil document - passport - has expired.
  • The state fee for issuing a new certificate has not been paid.

All other requirements, including replacement no earlier than 2 weeks before the expiration of the driver’s license, are illegal.

If you are denied an early replacement of your license, ask the employee to give you a written order indicating the reason for the refusal. It is this that will serve as the basis for appealing illegal demands.

How many days before the expiration date can I apply?

In fact, early receipt of the next MTPL policy is allowed only 30 days before the expiration of the previous document. But some organizations independently extend this period to 2 months, so more current and accurate information on this issue should be obtained directly from your company’s office. Although formally there are no strict restrictions and by law it is possible to buy new MTPL insurance for:

  • day;
  • week;
  • month;
  • 3 months or more.

Only sometimes insurers specifically refuse to issue insurance when there is a long period left before its validity begins. It is logical in such a context to clarify that a request to issue a policy with a start date of more than 1-2 weeks may result in a refusal from the company. But in this case, your rights as a client will be violated.

So the option of filing a response complaint is also not very appropriate here. If you start filming or demanding a written argument for refusing a request to sell insurance much earlier than the start of the action, then the representative may immediately change his decision, because then there will be a good reason not to sell you the policy.

According to Art. 426 and 445 of the Civil Code of the Russian Federation indicate that car owners have the right to agree on the terms of insurance under MTPL for about 30 days. And in order to regulate the protocol, the regulations also provide the same period - a similar extension rule was relevant until 2015.

Previously, drivers bought a motor vehicle license almost 60 days before the old version expired, doing so ahead of schedule. But then RSA began to re-fix tariffs for Green Card agreements every month, so the previously agreed period was halved (to complete all registration procedures).

Therefore, already in 2021, you can insure a vehicle ahead of schedule by purchasing an MTPL policy online or directly in the office only 30 days before the previous contract expires. But you won’t be able to draw up a contract early - the insurance company will probably refuse if you perform such manipulations even 31 days before the expiration date of the old copy.

How long before the end of compulsory motor liability insurance can a new policy be issued?

The constant workload of routine everyday life often becomes the reason that the driver forgets to contact the insurance company before the start of the new insurance period. As a result, he drives with the old policy form until he is stopped by traffic police officers or he gets into a traffic accident.

You need to remember that the insurance company extends the protection agreement every year only upon request, only after contacting and submitting an application for policy renewal. Knowing this, the question arises: is it possible to issue compulsory motor liability insurance in advance or agree on its extension? In this question, the answer will be positive; you can make a new policy before the end of the compulsory motor liability insurance policy, and this procedure must be undertaken.

According to the articles of the Civil Code of the Russian Federation, the policyholder has the right to contact the company for an extension of the agreement 60 days before it expires. At the same time, the first 30 days are designed to resolve disputes and agree on conditions, but the remaining month before the expiration date is intended specifically for prolonging the “automobile license”.

In other words, answering the question how many days in advance can a compulsory motor liability insurance policy be renewed, we will answer that one month before the expiration of the current one.

Since the “motor citizen” itself is valid for exactly one year, the preliminary purchase of a new protection agreement will not affect this period. That is, you can sign up for compulsory motor liability insurance 2 months earlier, but the new agreement will come into force only the next day after the old one expires and not the day before. Policyholders are advised to protect their civil liability until the expiration of the existing policy in order to avoid unpleasant consequences and not break the law.

How to renew your MTPL policy in advance

Late registration of a vehicle, violation of traffic rules and lack of a motor vehicle insurance policy are a consequence of the busyness of modern drivers. But when driving a car, everyone is obliged to take out insurance, because the consequences that await a motorist who is not protected by the policy can cost a tidy sum. Since 2015, motorists can apply for compulsory motor vehicle liability insurance remotely, through the website of the selected insurance company.

This feature allows drivers to choose from two options, namely:

  • Go to the insurer's office and fill out the application in person.
  • Register on the website and purchase an electronic MTPL policy online.

The second option is preferable, since this way you can renew your MTPL policy in advance while actually being in another region (different from your place of registration) and simply save time visiting the insurer’s office without standing in queues. Extension before the expiration of the compulsory motor liability insurance period remotely does not differ from regular extension. That is, in the office they draw up the same protection agreement as via the Internet, both in price and duration.

What documents will be required?

So, we have already said earlier that if you receive a compulsory motor liability insurance policy in advance, then you will not be afraid of the consequences associated with the payment of insurance compensation to victims of an accident or fines for the lack of a document issued by the traffic police. To insure a car under MTPL in advance, you need to collect the necessary documents and submit them personally to the office of the insurer or send a scan of them by email (if renewing online).

Regardless of which renewal method you choose, an employee of the insurance company, after receiving your documents, will draw up a new insurance contract, that is, there is no renewal, since a policy is issued with new numbers and at a new cost calculated personally by an employee of the company or using the OSAGO calculator for remote renewal .

The list of documents consists of the following names:

  • Form of a valid motor vehicle policy.
  • Passport confirming the identity of the policyholder.
  • Vehicle license (driver’s license, STS and PTS).
  • Diagnostic card (optional).

Where to submit documents

Since, by planning to issue compulsory motor liability insurance early, you are in fact buying a new policy, the choice of the method of submitting documents is not important. If you decide to carry out the extension in person at the insurer’s office, then the documents should be submitted directly to an employee of the insurance company. After checking the information from the driver's license, vehicle documents and the identity of the policyholder, the insurance agent will ask you to fill out an application using the specified form.

If you choose remote renewal, you do not submit documents, but fill out a special form online, where your data is entered without errors. After completing the forms in person or remotely, you will receive a new form. The new term of the issued motor vehicle insurance policy will be indicated on the new contract and will come into force from the moment the currently valid agreement expires.

Registration procedure

When considering the question of whether it is allowed to renew the policy in advance, it is worth emphasizing that this should be done at least a few days before the final validity period of the current OSAGO . To avoid unpleasant incidents, you should arrange such protection for your car in advance and choose from 2 purchasing options:

  1. If in 1-2 weeks, then the probability of refusal is minimal, because most insurance companies will issue a policy when it is necessary for it to start working 10-12 days earlier.
  2. When the period should be longer, then you will have to submit a written application (submit it in person, receive a return receipt, or send it by registered mail in order to have evidence).

Moreover, in the second case, it is worth officially applying no later than 2 months (60 days) before the current contract ends, if the driver does not want a significant time gap when he will have to drive without compulsory motor insurance due to a discrepancy in terms. For convenient registration, each client is provided with the best conditions. You can update your MTPL in another city or even region: in any locality where there is a branch of the selected insurer.

What documents are needed?

When proceeding directly to the procedure for re-registration (extension) of compulsory motor liability insurance, at the initial stage the driver will have to collect a standard set of documents. The list of required papers is in many ways similar to the set that is requested when concluding a new contract , therefore it includes in the list:

  • passport of a citizen of the Russian Federation;
  • PTS and inspection certificate;
  • vehicle registration certificate;
  • old MTPL policy (original and copy);
  • application for contract extension;
  • valid driver's license.

If several persons were included in the previous insurance at the same time, then at the same time it is worth presenting their passports and licenses - this applies to all persons who, in theory, will drive a specific car (except for special agreements that are drawn up for an unlimited number of drivers). And when a trusted person is involved in the registration, a notarized power of attorney is certainly added to the above certificates.

Where to contact?

When planning to draw up an MTPL agreement in advance, it is worth noting that such actions can only be implemented 30 days before the end of the previous policy. Therefore, in practice, you can renew an expired policy ahead of schedule using only 2 methods:

  1. At the auto insurer’s office (you need to personally visit a branch of your insurance company, collect and take a typical package of documents, show your old expired policy, wait for the due amount to be recalculated taking into account accident-free driving rates and a number of other factors - they may differ depending on the organization and region of residence).
  2. Via the Internet (motorists have the right to draw up a new contract online, if the selected insurer has its own portal with the necessary functionality - at least contacts for communication via email - similar actions should be taken, but all documents should be uploaded using a special form and the form should be filled out).

Despite the chosen option, the total period is still exactly 30 days, during which a Russian motorist can legally conclude a new insurance contract while the old one has not yet come to an end.

Can I apply again and when?

July 1, 2015 is the day when electronic and paper insurance contracts were introduced. You can take care of receiving it ahead of time, avoiding queues and last-minute cancellations due to office closures. It is easier to issue an electronic policy than a paper one.

Drivers often take out a new OSAGO policy in advance. By doing this, they do not violate any laws and regulations in force in Russia. They did not set a deadline for when you need to contact the insurance company for new car insurance. Clause 1.12 only says that the driver must apply for a new one as soon as the old one runs out.

In accordance with Articles 426 and 445 of the Civil Code of the Russian Federation, the legislator established a 30-day period for agreeing on the conditions and the same number of days for resolving disputes over the conditions. In other words, sixty days before the end of the old policy, you can contact the policyholder for a new one, until the moment the insurance ends. At the beginning of February 2015, this period was revised downward, giving the driver a month to renew and resolve disputes under the insurance contract.

The regulatory documents nowhere regulated the deadline for issuing compulsory motor insurance for the new insurance year.

Policyholders recommend applying for it 30 days before the end. Sometimes they do it earlier due to certain life circumstances. Even if you issue it in advance, the new one will be valid from the date the old one expires.

Registration cost

The procedure for extending civil liability insurance itself takes a fairly short period (no more than 30-40 minutes). The company representative is obliged to check the provided package of documentation, personally carry out the current calculation of the insurance premium and print out a new form. Only after this the driver should pay for the company’s services at the cash desk and sign the agreement.

Moreover, the cost of the next protection for a car and the tariff of the previous policy may not always be the same. Since organizations apply changed rates every year, the main coefficients are automatically adjusted.

So, when drawing up a new contract, the company’s managers will calculate the bonus again, from scratch: the final figure may change either up or down compared to the previous value. And when moving to another company, KBM for the previous year is rarely taken into account and the owner of the car will have to pay the full price without discounts and bonuses.

Deadlines and costs

To buy an auto insurance policy, we contact the insurer. This can be done in person in the office or remotely.

By choosing a modern method, remote renewal, you can make an online calculation of the insurance premium that must be paid in order to receive a contract. Of course, you can buy compulsory motor insurance directly at the office of the insurance company, but this will take more time. As a rule, the period for drawing up a new agreement takes from 20-40 minutes.

After filling out the application and making a calculation, you will find out the cost of extending the MTPL for a new insurance period. After paying the premium, you will receive the form on the same day. The registration and renewal procedure itself is free, you only pay for the form, the price of which is calculated taking into account all correction factors and the KBM for the previous year.

Is it possible to renew insurance in advance without the owner?

It is fundamentally important for motorists to remember that without a power of attorney, even persons legally included in the insurance policy will not be able to obtain a renewal.

The registration process, even for several drivers, only provides the right to drive a vehicle, but only the full owner has the authority to perform any manipulations directly with the insurance.

On the other hand, no matter what time and how many days before the expiration of the MTPL policy, only some citizens will be able to issue a new copy:

  • the insured (usually the owner of the car, although in some situations the contract is signed by other persons - friends, relatives, colleagues - since the law of the Russian Federation allows insuring other people's cars, but both persons must be indicated in the policy);
  • owner (being the policyholder, it is the owner of the vehicle who has the right to draw up an insurance agreement 30 days before the completion of the previous one);
  • third parties (on behalf of the owner of the car, third parties can renew OSAGO online or at the insurer’s office, if the driver accidentally expired the old version of the agreement - then the renewal algorithm is carried out by general power of attorney).

To generalize, only a person who has previously been involved in documenting the protection of a specific car can make a new extension of compulsory insurance and repurchase a policy if the old one is expired or will soon expire. Renewal without the current owner of the vehicle is possible only with a previously issued power of attorney certified by a notary.

Is it possible to renew the contract without the owner of the car?

If the owner cannot be present at the receipt of compulsory motor liability insurance on the designated day, for example, due to absence from the country, going on a business trip to another city or due to illness, you can draw up an agreement with the insurance company without it.

The MTPL policy can be extended without the owner only if he has provided the authorized person with the corresponding right. Without a power of attorney to renew insurance, prolongation of the MTPL contract in some companies is impossible. Moreover, this document must clearly state:

  • information about the authorized person;
  • powers of the representative (submitting an application and the necessary documents for concluding or extending the contract, signing the insurance contract, making the required payments and, finally, receiving the policy itself, possibly granting powers to choose the insurer and others);
  • vehicle data.

The remaining papers are collected in the standard manner (according to the list described above), only instead of the vehicle owner’s passport, a copy of it is provided.

So, how long before you can conclude a new insurance contract? You can contact the Investigative Committee at any time, since the exact deadlines for registration are not regulated by regulatory legal acts, but are limited by the Civil Code of the Russian Federation (30-60 days). Insurers recommend applying 30 days before the end of the current contract, not earlier. Only some people name shorter periods (2 weeks, several days) to impose additional charges. service or illegally refuse.

You have every right to insist on your own (issuing MTPL policies is the responsibility of the insurance company, enshrined in the legislation of the Russian Federation), but is it always worth doing this? As a last resort, the law allows the opportunity to drive on the country's roads after the expiration of the compulsory motor liability insurance policy, but only within 24 hours or provided that a new policy was ordered in advance, but has not yet been received. That is, you must have a special document in your hands confirming that you will soon receive new insurance.

When does the new policy come into effect?

It is important to understand that when a car owner completes another transaction, but the previous copy is not yet expired, the contract will begin to be in full force only the next day after the completion of the earlier version. Therefore, you won’t be able to use it for compensation - not only will you not be given compensation, but they may also revoke the agreement and, in return, be charged with fraud. Therefore, a fresh contract should be used only after the old MTPL policy has been canceled within the specified time frame.

Are there any discounts on renewal?

As practice shows, when renewing a contract with the same insurance company, a driver who is a regular customer of this particular company has the right to count on special conditions and benefits if he has proven himself to be a conscientious consumer. For example, a significant reduction in the total cost of regular insurance occurs when no accidents were recorded in the driver’s statistics during the previous period.

Many insurance organizations value their clients, so they periodically offer them pleasant bonuses. But if the policy expires, there is a risk that all benefits will be withdrawn altogether - you need to try to maintain your reputation during the period of validity of the compulsory motor liability insurance policy and be less likely to get into accidents.

If the insurance is expired

By default, checking the documents of all road users is considered one of the reliable methods of control by traffic police officers. The fact of having a car insurance policy, as well as a license with a registration certificate, is a mandatory requirement for all car owners.

Violation of this rule is subject to a fine, the amount of which is determined depending on the severity and type of offense committed.

Typically, insurance company employees 1-2 weeks before the expiration of the compulsory motor liability insurance policy warn the client about the need to renew the policy and offer several options to choose from. But many drivers still ignore this requirement and risk being penalized for:

  1. Presentation of an insurance policy that has expired.
  2. Complete absence of compulsory insurance during inspection.
  3. Presentation of compulsory motor liability insurance issued for another car.
  4. Availability of a contract that is issued to another citizen.

As a result, the liability of the true owners of vehicles for driving with expired insurance is provided for under Art. 12.37 Code of Administrative Offenses of the Russian Federation No. 195. According to this regulatory act, the amount of the fine will be about 500-800 rubles, as in the case of the absence of compulsory motor liability insurance - a more precise amount is assigned on an individual basis.

How to apply

The procedure for drawing up a new contract when applying before its expiration follows the standard renewal scheme. You are required to:

  1. Provide the insurer with a package of documents.
  2. Write an application for a new OSAGO policy. The law does not establish a uniform form of registration, so each company has its own template that must be followed.
  3. Pay the cost of insurance and present the corresponding receipt.
  4. Receive a document whose validity period coincides with the issue date. It can be in electronic or paper format, depending on your preference.

What documents will be required

If you plan to take out a compulsory motor liability insurance policy in advance, you need to take into account that this will, in fact, be the conclusion of a new contract. This means that you will be required to provide the same package of documents as when you first received the MTPL policy. This rule applies even if the extension is made with the same insurer that issued the current document.

So, in order to renew your insurance in advance, no matter how many days before its expiration you deal with this issue, you will need:

  • original current policy;
  • personal passport of the policyholder;
  • driver's licenses of all persons who will be allowed to drive a vehicle (if limited insurance is issued);
  • diagnostic card indicating that the technical inspection has been completed;
  • certificate of registration of the vehicle and its title.

This list is required if the document is purchased or renewed in the standard way - through a visit to the insurer's office. But today you can apply for an extension online without leaving your home. Obtaining an electronic MTPL insurance policy is not associated with any difficulties and does not require much time. To complete it you will only need:

  • fill in all the required fields (for which the above documents will be required);
  • pay the cost of renewal (purchase);
  • Receive it by email and print it.
