What are the terms of the contract that differ from open MTPL?

The cardinal difference between the conditions of open compulsory motor liability insurance is only that the cost of this option in most cases significantly exceeds standard prices.

There are also a number of less significant distinctive details, which I will discuss below, but first I will briefly dwell on the legislation related to this topic.

What standards govern unlimited compulsory motor liability insurance?

In the main document on compulsory motor liability insurance, Federal Law No. 40, there is no special article regarding an open policy. Maybe it will appear in the future, but today it is not.

The standards one way or another related to multi-drive insurance are as follows:

  1. “OSAGO Rules” – Appendix No. 1 (to the Regulations of the Central Bank of the Russian Federation No. 431-P), chapter 1, clause 1.1. It directly states that, depending on the terms of the contract, the policyholder has the right to obtain a policy for an unlimited number of drivers.
  2. “Instruction of the Central Bank of the Russian Federation” (No. 3384) – Note 5 (to clause 2) explains the nuances of preserving and transferring the insurance history to the insurance company in the case of an open policy;
  3. “Law on OSAGO” (Federal Law No. 40) – Article 16 is devoted to a limited version of OSAGO. This does not directly relate to our question, but many of the provisions in this article also apply to multidrive.

That, in fact, is all there is to the law. Now we need to highlight the pros and cons of this insurance option.

What are the advantages of open MTPL?

The advantages of this insurance option are quite attractive for a considerable number of motorists.

Here is their list:

  • Any driver has the full right to drive a car insured in this way - that is, the question of who can drive such a car has been removed;
  • Payments for insured events are guaranteed and are made according to the usual scheme, regardless of who was driving at the time of the accident;
  • A significantly smaller amount of information is required (information about registered drivers is excluded) and documents, which reduces hassle and increases the reliability of the data;
  • There is no need to contact the Investigative Committee when changing a driver’s driver’s license , or adding one if necessary;
  • Such insurance can be beneficial for young novice drivers who do not yet have driving experience - the cost of a regular and open policy for them will be almost the same;
  • It is possible to change the driver at any time of the day or night - use the help of a sober friend, etc.

What are the disadvantages of open MTPL?

An unlimited motor vehicle license also has a number of disadvantages, which, however, are not very many.

Here is their list:

  • The price of the policy can be 80% higher than the cost of a similar standard option, which, with other high coefficients, gives a considerable amount;
  • KBM is taken into account only for the owner of the vehicle - for all others, the accident-free driving experience is not counted;
  • KBM is lost in some cases when the owner switches from an open MTPL to a regular policy.

Features of cost calculation for unlimited compulsory motor liability insurance

As I already mentioned, the cost of an open car is significantly higher than the base one, all other things being equal. But how much a specific policy costs is also calculated individually. It could be, for example, 13 thousand, 23 thousand, or even 43 thousand rubles.

You should know that multi-drive cost calculation differs from the classic one only for two coefficients:

  • Drivers admitted to driving (CO);
  • Bonus-malus ratio (BMR).

According to the Directives of the Central Bank of the Russian Federation No. 3384-U, the coefficient KO = 1.8 is applied to an unlimited policy (in a regular policy KO = 1). This means that the product of the base tariff (Tb) and the regional rate (Kt) is multiplied by 1.8, which, without taking other factors into account, immediately increases the amount by 80%.

The resulting amount is multiplied by the age and experience coefficient (Kvs). Here in some sources you can find a statement that age and experience are not taken into account for multidrive. This is not entirely true. In fact, it ceases to be taken into account after the driver reaches 22 years of age and has 3 years of experience (Kvs = 1). And in other cases the situation will be different:

  • Less than 22 years with more than 3 years of experience – Kvs = 1.6;
  • More than 22 years with 3 or less years of experience – Kvs = 1.7;
  • Less than 22 years with 3 or less years of experience - Kvs = 1.8.

Next, the resulting value is multiplied by the engine power factor (Km) and bonus-malus (KBM).

Here is the calculation formula for the above calculations:

TB * CT * KO * KVS * KM * KBM

The final amount may also be affected by:

  • Features of operation;
  • Availability of a trailer;
  • Period of use;
  • Driver gender.

Features of KBM for open belay

With an unlimited policy, the bonus-malus coefficient is calculated differently than for a classic contract.

  • Regular compulsory motor liability insurance involves an annual adjustment of the motor insurance policy for the main owner and all drivers included in the policy - in accordance with the facts of insurance payments (accident-free driving);
  • Open compulsory motor liability insurance makes it possible to annually adjust the vehicle insurance policy only for the car owner.

That is, everything is simple: according to multi-drive, the KBM is calculated for one person - the owner of the car, which is sometimes called “KBM by car”.

Now for a more complicated option.

Let's say you had a regular policy and wanted to switch to unlimited. Moreover, in your regular insurance, someone is listed as an authorized driver, and he has accumulated points for accident-free driving. These points will expire upon transfer. Therefore, this driver must be re-registered in advance into some other regular policy with the preservation of the KBM.

Now the situation is the opposite - you want to switch from open insurance to regular insurance and keep your CBM. RSA (Russian Union of Insurers) explains that for this the following conditions must be met:

  1. Be the owner of a car;
  2. Have no insurance payments for the previous period.

To complicate the situation: you switch to a regular policy with another insurer. This is where most insurance companies will refuse to transfer your KBM - usually on the basis that the computer program is not suitable for such a transfer. Moreover, this is not fiction and such a problem really exists. Everything is resolved through the RSA hotline and the IC IT department.

Attention! RSA also has an IT department, but its specialists do not have access to correcting data in the databases. They can provide valuable advice to IT departments of small insurance companies, which have all the rights to make changes to their databases.

How to change an open policy to a regular one and back within one insurance period?

There are situations when unlimited or limited insurance is needed urgently, and it is not possible to wait until a regular policy expires. In this case, you can change the form of insurance within one insurance period.

To do this you need:

  • Contact the insurer or its official representative directly;
  • Write an application to replace one insurance service with another;
  • Wait for the insurance cost to be recalculated and deposit additional money (if required);
  • Receive a new completed insurance contract form with the required service.

Please note that previously, with such a replacement, insurers sometimes resorted to a certified correction of the policy data without replacing the form. Now you can't do this:

  • The old contract must be submitted for archiving to the insurance company;
  • The new contract (clause 8, “Special notes”) must indicate the number of the previous contract and the reason for the replacement.

If it is impossible to personally make changes to the insurance, you can use an authorized person who has a notarized power of attorney to do this.

Do I need a power of attorney to drive a vehicle with open insurance?

Today, handwritten powers of attorney for driving a vehicle have been abolished. This was done in 2012, according to Government Decree No. 1156.

This legislative act abolished the 4th paragraph of clause 2.1.1 “Road Rules”. This paragraph ordered the driver to have a handwritten power of attorney for the vehicle being driven and to present it to traffic police officers as part of the road documentation package.

Now you don't need to do this, but not in all cases. If the car travels outside the borders of the EAEU, then a power of attorney is required, but not a simple one, but certified by a notary.

Today you can not only choose an insurance company, but also estimate the cost of insurance. A few years earlier, such an opportunity was not available, and all because the calculation used not only a single formula, but also the same base rate for everyone, which was also set by the Central Bank. There was no threshold of 20%, as is the case now. But due to the policies of insurance companies and the ability to compete, the government decided to expand the scope and choose the size of the base rate within the established limits.

If you want to choose the lowest price for an MTPL insurance policy, then proceed from the size of the base rate, which is included in the calculations in specific insurance companies. For 2019, the following values ​​are relevant for passenger cars:

  • Rosgosstrakh - 4118 rubles;
  • Sogaz - 4118 rubles;
  • VSK - 4118 rubles;
  • Renaissance - 4118 rubles;
  • RESO - 3604 rubles;
  • Ingosstrakh - 3432 rubles;
  • MAX — 3432 rubles;
  • Alfa insurance - 3432 rubles.

As you can see, by choosing, for example, Ingosstrakh or AlfaStrakhovanie, you can save 700 rubles compared to Renaissance Insurance and other companies, which are based on the maximum base rate as of 2021.

It is worth noting that after changes are made to the base rate by the Central Bank, each insurance company chooses for itself the optimal value that will be included in the calculation formula, and reports on the decision to the Central Bank and RSA (Russian Union of Auto Insurers). From this moment on, the company has no right to make any changes to the rate until new amendments come into force.
