The traffic police will create a specialized register of car dealers who have the right to register new cars

Good afternoon, dear reader.

This article will discuss the state register of vehicles, which has existed in Russia since January 1, 2020 , as well as obtaining an extract from this register.

Let me remind you that from January 1, 2021, a new law “On State Registration of Vehicles” is in force, and in addition to it, rules for maintaining the state register of vehicles have been issued. It is this regulatory document that will be discussed today:

  • What information is contained in the vehicle registry?

What information is contained in the vehicle registry?

Let's consider paragraph 7 of the rules for maintaining the registry:

7. The state register contains the following information:

a) information about the vehicle:

  • details of the vehicle passport (electronic vehicle passport);
  • state registration number;
  • identification number (VIN);
  • brand and (or) model (commercial name);
  • category (subcategory) of a vehicle established by the technical regulations of the Customs Union “On the safety of wheeled vehicles” and the Federal Law “On Road Safety”;
  • type;
  • year of issue;
  • model, number, type, power and engine displacement;
  • identification number of the main component of the vehicle (body, frame, cabin);
  • chassis number;
  • body (cabin) color;
  • environmental class;
  • equipped with equipment to supply the engine with gaseous fuel;
  • steering wheel location;
  • curb weight (weight without load) and technically permissible maximum weight (gross weight) for a vehicle intended for the transport of goods or equipment installed on it;
  • manufacturer;

b) information about the registration action:

  • date and name of the registration action;
  • details of the registration document;
  • the division of the State Road Safety Inspectorate of the Ministry of Internal Affairs of the Russian Federation that carried out the registration action;

c) information about the owner of the vehicle:

  • for legal entities - full and abbreviated (if any) name of the organization, main state registration number of the entry in the Unified State Register of Legal Entities, reason code for registration with the tax authority, taxpayer identification number, registration address;
  • for individual entrepreneurs - last name, first name, patronymic (if any), date and place of birth, taxpayer identification number, insurance number of an individual personal account, main state registration number of the entry in the Unified State Register of Individual Entrepreneurs, registration address;
  • for individuals - last name, first name, patronymic (if available), date and place of birth, taxpayer identification number (if available), number of the main identification document, insurance number of an individual personal account, registration address at the place of residence and (or) place of stay;

d) information about changes in information contained in the state register.

So, the state register of vehicles is a database that contains information about all cars in the Russian Federation. The registry stores information about both the car itself and its owners.

Note. Information about cars registered with the State Traffic Safety Inspectorate before January 1, 2021 should be transferred to the register automatically.

The operator of the registry is the State Traffic Safety Inspectorate.

9. Information contained in the state register is subject to permanent storage; its destruction or seizure is not allowed. If the information contained in the state register changes, the previously entered information is retained.

Paragraph 9 of the rules states that the register contains information not only about the current state of affairs in relation to the selected car, but also the entire previous history of this car.

For example, if the previous owner completely repainted the car and changed its color, then information about this will be stored in the registry.

Which vehicles are subject to categorization?

First of all, let’s turn to Article 1 of the Law “On Transport Security”, which defines the basic concepts. Including the concept of vehicle:

11) vehicles - devices intended for the transportation of individuals, cargo, baggage, hand luggage, personal belongings, animals or equipment, devices installed on said vehicles, in the meanings determined by transport codes and charters, and including:

a) road transport vehicles used for regular transportation of passengers and luggage or transportation of passengers and luggage on order, or used for the transportation of dangerous goods, which requires a special permit;

Thus, 3 groups of vehicles are subject to categorization:

  • used for regular transportation (public transport);
  • used for transportation on order;
  • used for the transport of dangerous goods.

Moreover, at this point, vehicles are not divided into cars, trucks and buses. That is, it follows from the law that categorization is also necessary for passenger cars. In fact, this is not the case and a clarifying regulatory document will be discussed below.

Please note that the above list does not include transportation for the organization’s own needs. That is, if a bus carries passengers for its own needs, then it needs to be licensed, but categorization is not required.

What status can an entry in the registry have?

10. In the state register:

  • the “valid” status is assigned to a registry entry containing information about a vehicle registered with the state;
  • the “archival” status is assigned to a registry entry containing information about the removal of a vehicle from state registration, or about termination of state registration due to invalidation of registration, or about a technical error;
  • the status “suspended” is assigned to a registry entry containing information about the temporary termination of a vehicle’s permission to participate in road traffic.

The very first field that contains an extract from the registry (we will discuss obtaining an extract below) is the status of the record, which can take the following values:

  • active;
  • archival;
  • suspended.

Only a vehicle whose entry has the status “ valid ” can be operated normally.

In principle, the “archived” and “suspended” statuses also do not contain anything criminal. However, when buying a car, it makes sense to find out from the seller the reasons why such a status is established.

For example, if the seller stopped registering a car in order to retain a nice license plate, then renewing the registration of the car will not pose any special problems.

What extracts from the register can I get?

13. Access to information contained in the state register (except for information with limited access) is provided by the operator of the state register upon request for an extract (hereinafter referred to as the request).

Depending on the composition of the requested information, as well as the subject requesting it, the extract may contain an expanded list of information about the vehicle (hereinafter referred to as the extended extract) or a shortened list of information about the vehicle (hereinafter referred to as the abbreviated extract).

The statement is issued on paper or in the form of an electronic document using the Internet information and telecommunications network, including the federal state information system “Unified Portal of State and Municipal Services (Functions)” (hereinafter referred to as the Unified Portal), the official website of the operator of the state register, as well as through a unified system of interdepartmental electronic interaction and other technical means of communication.

There are 2 options for statements:

  • shortened - anyone can get it;
  • extended - it is issued only to a limited number of people (more information about this is given below).

You can get an extract:

  • on paper (if you contact the traffic police in person);
  • in electronic form (via the Public Services portal, the traffic police website, etc.).

Necessary documents for the procedure

In order to carry out the procedure for categorizing a car, you will naturally need a certain package of documents that should be submitted to the authorized body.

In order to help avoid any difficulties in collecting papers, it is worth providing a detailed list of them:

  1. A copy of a document confirming the existence of a specific carrier, i.e. certificate of registration of an individual entrepreneur, or a corresponding package of documents for a legal entity.
  2. A copy of the technical equipment passport
  3. A copy of the vehicle registration certificate
  4. All documents related to the vehicle, which reflect as much information about it as possible. Such as: cost, hazard class of the car, capacity (or, more simply, the maximum number of passengers that it can carry according to information from the manufacturer).

Individually, the package of documents undergoes changes depending on who applies to the authorized body, the direct owner of the car or its lessee.

If the initiator of the appeal is the direct owner, then the following items are added to the list:

  • A copy of state registration, certified by a notary
  • Extract from the cadastral passport about the transport infrastructure facility

If the submission of papers is carried out by the tenant, then he will be required to:

  • A copy of the agreement between the owner and the applicant on hiring or renting a vehicle
  • An extract from the cadastral passport will also be required.

Abbreviated extract from the register

Clause 22 of the rules for maintaining the register:

22. An abbreviated statement in the form according to Appendix No. 2 is issued based on requests from any person.

An abbreviated statement is issued upon request containing the vehicle identification number, or the identification number of the main component of the vehicle (body, frame, cab), or chassis number.

Anyone can receive an abbreviated statement about the car . To do this, he will need to know the VIN number of the car or the number of the body, frame, cab or chassis.

The extract form is given in Appendix 2 to the rules:

Appendix 2. Abridged statement

This is exactly the type of statement you can get if you want to check the car before purchasing.

The abbreviated statement does not contain information about the personal data of the car owner and other personal information.

Note. The contents of the abbreviated extract almost completely coincide with the information that can be obtained using the “Checking registration history with the traffic police” service.

The abbreviated statement additionally contains information about the environmental class of the car, as well as the status of the entry in the register.

Extended extract from the register

14. An extended extract in the form according to Appendix No. 1 is issued:

a) the owner of the vehicle in respect of whom an extended extract is requested, his legal representative or representative acting on the basis of a power of attorney;

b) courts, prosecutorial authorities, investigators, inquiries in connection with criminal, civil cases, cases of administrative offenses in their proceedings, bailiffs in connection with the exercise of their functions of executing judicial acts or acts of other bodies, as well as tax authorities, customs and other authorities and persons in cases and in the manner provided for by the legislation of the Russian Federation, or on the basis of agreements concluded with the operator of the state register to perform the functions assigned to them;

c) law enforcement agencies of foreign states and international police organizations in accordance with international treaties of the Russian Federation.

Unlike a shortened statement, an extended statement can only be obtained by the owner of the vehicle , as well as representatives of some government organizations. This is not surprising, because the extended statement contains much more information about both the car and its owners:

To receive an extended statement, it is not necessary to indicate the vehicle’s VIN number:

15. An extended statement is generated based on one of the following information:

a) the name of the legal entity, or the main state registration number of the entry in the Unified State Register of Legal Entities, or the taxpayer identification number - for the owner of the vehicle - a legal entity;

b) insurance number of an individual personal account or last name, first name, patronymic (if available) and date of birth of the owner - for the owner of the vehicle - an individual or individual entrepreneur;

c) vehicle identification number, or identification number of the main component of the vehicle (body, frame, cabin), or chassis number;

d) state registration number of the vehicle.

Subparagraph d says that an extended statement can be obtained simply by car number .

How long does it take to issue an extract?

24. The operator of the state register issues an extract:

  • in the form of an electronic document - within no more than 3 working days from the date of receipt of the request, unless a different period is established by the legislation of the Russian Federation. Upon request sent in electronic form in an automated manner using the Unified Portal, an extract is issued in the form of an electronic document immediately, but no later than the next business day after the day the corresponding request was sent;
  • on paper - within no more than 10 days from the date of receipt of the request, unless a different period is established by the legislation of the Russian Federation.

Dates for issuing statements:

  • 10 days - on paper;
  • 3 working days - electronically without using the State Services portal;
  • immediately , but no later than the next working day - through State Services.

How to obtain an extract from the register through State Services?

The fastest way to receive an extract is to order it through the Public Services portal. However, at the time of publication of this article (February 5, 2021), such a function has not yet been implemented in State Services, that is, it does not work.

3. The Ministry of Internal Affairs of the Russian Federation, together with the Ministry of Digital Development, Communications and Mass Communications of the Russian Federation, within 6 months from the date of entry into force of this resolution, ensure the opportunity for citizens to obtain information contained in the state register of vehicles through a personal account in the federal state information system “Unified portal of state and municipal services (functions)”.

Paragraph 3 of Government Decree No. 1874 states that the function will be implemented in public services within 6 months, that is, until July 1, 2021 . As soon as this happens, this article will be updated.

Why was the state register of vehicles introduced?

Why was it necessary to introduce a new concept - the state register of vehicles? Obviously, it was necessary to structure existing and new information differently in order to quickly obtain extracts from the register.

At the moment, information about the dates of changes in ownership and some information from the car’s title is available to anyone on the State Traffic Inspectorate portal gibdd.ru. After the full implementation of the register, such information about any car can be obtained by sending a request through the public services portal.

Now, if necessary, many government bodies have the right to send a written request to the traffic police to obtain information about registered vehicles for the owners of interest. The period for consideration of the request is up to 30 days.

When switching to the procedure for obtaining information on motor vehicles from the state register, requests can be sent electronically and responses can be received more quickly (the response must be generated within 3 days).

In addition, you need to understand that vehicles are not only motor vehicles, but also water transport, the database of which is maintained by GIMS, and agricultural machinery, along with snowmobiles and ATVs, the database of which is supervised by the Ministry of Agriculture. The new registry will eventually allow these databases to be combined and information about all registered vehicles in one registry.

At the moment, the operator of the registry is the State Traffic Safety Inspectorate; obviously, it is the information from this department that will become the main one in the new registry of vehicles.

Storing information about statements in the registry

33. Information about all requests received and extracts issued on their basis is stored in the state register.

In addition to information about the vehicles themselves, the register also stores information about all issued extracts. That is, if someone requested information about your car, a corresponding entry will appear in the registry.

However, even the owner of the car cannot obtain information about this. Apparently it will be kept for official purposes.

The traffic police will create a specialized register of car dealers who have the right to register new cars

On January 12, the public discussion of the draft order of the Ministry of Internal Affairs with a description of the register of “specialized organizations” that have the right to independently register vehicles with the State Traffic Safety Inspectorate ended on the Federal Portal of Draft Regulatory Legal Acts. We would like to remind you that this possibility is provided for by the law “On State Registration of Vehicles”, which comes into force on August 4, 2019.

Car dealers and car showrooms (in the law they are united by the term “specialized organizations”), when selling new cars, will independently prepare documents, inspect cars and transmit information about the car “in the prescribed manner” to the traffic police. That is, the client does not need to register the car with the department . The numbers can also be printed directly at the car dealership (if you have the appropriate permission). A company can receive all these powers only if it is included in a special register .

Its administrator will be the Special Purpose Center for Road Safety of the Ministry of Internal Affairs (this structure is engaged, in particular, in the purchase of special products - license plates, license forms, STS, etc.), it follows from the draft order. The car dealer will have to send an application to the traffic police with the name, form of ownership, details, and address. It will also be necessary to provide information about the contract with the “vehicle manufacturer” and the brands of cars sold. The package of documents includes copies of contracts confirming that the car dealership (owned or leased) has a building or premises where cars are sold, as well as information (including passport data) about employees who will have the right to inspect the car. They will be subject to special “qualification requirements” - they will be approved by a separate order of the Ministry of Internal Affairs, which was subject to public discussion at the end of the year.

A car dealership employee must know the design features of cars, the classification and designation system of vehicles, labeling rules, methods and rules for identifying vehicles. Must be able to identify “signs of altered identification” of vehicles, as well as signs of technical malfunctions. At the same time, it is mandatory for him to have a secondary or higher education and a document confirming his “qualification for inspecting a car.”

The register of car dealerships admitted to the new service will be published on the traffic police website . The order will also formulate the grounds for excluding a company from the register : for example, if two or more cases are identified when, when registering a car, “knowingly false” or “inaccurate information about the identification marking or the design of the vehicle” was provided.
