What numbers are worth mentioning here?

  • 10-20 km – no penalty applies.
  • 20-40 km – a fine of 500 rubles.
  • 40-60 km – 1,000 -1,500 rub. If this is a repeated violation, the amount increases significantly and can range from 2,000 to 2,500 rubles.
  • More than 60 km – 2,000 and 2,500 rubles, in the second case 5,000 rubles.
  • More than 80 km – 5,000 rubles.

2. No child seat. The law stipulates that small passengers must be in special car seats that are properly secured and can save the child’s life in case of unforeseen situations. What types of punishment can be noted here?

  • Driver – 3,000 rub.
  • Manager, this also includes a taxi - 25,000 rubles.
  • Carrier company – 100,000 rubles.

3. Seat belt. Agree, if you have not fastened your seat belt, the risk of injury in an accident increases several times, which can sometimes be fatal. That is why in this matter it was decided to increase and increase the amount of the fine in order to at least somehow protect drivers and teach them to be more careful and attentive to their lives. What numbers are written and established here?

  • Unfastened seat belt – 1,000 rubles.
  • Unbelted child – 3,000 rubles.
  • Unbelted adult passenger – 1,000 rubles.

4. Driving while intoxicated. Agree, this is one of the problems that our authorities have been struggling with for many years, increasing the punishment every year. After all, it is precisely such a driver who poses a terrible danger on the road, which can subsequently lead to the death of innocent people. Today, according to the law, the inspector has every right to ask to undergo an examination if the driver shows signs of drinking alcohol, that is, unclear speech, the smell of alcohol, excessive aggressiveness, and if this is confirmed, the motorist may even lose the right to drive a car. As for punishment, the following changes are noted.

Driving a car by a drunk driver or transferring control of a car to a drunk driver - 30,000 rubles, if this is a repeated violation, then 50,000 rubles. Driving by a drunk driver without a license or deprived of one - 30,000 rubles or arrest for 15 days. Drinking alcohol after an accident – 30,000 rubles or deprivation of rights for 2 years.

5. Transportation of goods. According to statistics and available data, there are also a large number of persistent violators in this direction. Why? The answer is simple and obvious, since sometimes there is simply no time to follow all the nuances and procedures, and this entails certain types of punishment. Which ones exactly?

  • Driving a truck or bus without a tachograph – 2,500 rubles.
  • Violation of the rest schedule by a truck driver – 500-1,000 rubles.
  • Cargo transportation without a transport document – 200-500 rubles.
  • Transportation of international cargo without permission – 4,000 – 5,000 rubles.

Traffic fines 2021, new traffic police fines 2019

About discounts on fines

They are provided in accordance with Article 32.2 of the Code of Administrative Offenses for most traffic police fines and amount to 50% of the amount of the sanction. The discount does not apply mainly to fines for repeated violations, as well as gross ones.

The deadline for paying a financial sanction with a discount is 20 days, and here lies an important difference from most other deadlines in administrative law. The fact is that the discount period begins to count from the date of the decision (and other periods, as a rule, from the date of entry into force). The beginning of the deadlines in the Code of Administrative Offenses is dated the next day, so 20 days should be counted from the next day after the decision was made.

For example, you were caught on camera on January 1, 2021, the decision was made on January 2 and sent to you by mail. You received a letter on January 12. So, the discount period still lasts until January 22, 2021 inclusive.

If the letter from the camera took longer than 20 days, then this period, alas, will be missed, although the Constitutional Court declared this illegal, and it can be restored upon petition to the body that issued the decision or to the court.

Discounts on traffic police fines

Will there be new traffic police fines in 2021?

Among all the amendments being introduced, a special role should be given to the following significant and important issues. What are we talking about?

1. Speeding. This violation is considered one of the most common on the roads of the Russian Federation. After all, modern cars allow you to accelerate to high speeds, which of course is prohibited by the limits. Moreover, the excess can be recorded both directly by traffic police officers and by auto-recording cameras, which are installed in most populated areas and busy highways.

Changes in traffic rules from January 1, 2021

Details Category: Traffic rules Published 08/27/2018

What changes in traffic rules and other regulatory documents await Russian drivers from January 1, 2021?

Register of driving school graduates from January 1, 2019

From January 1, 2021, a unified register of driving school graduates will be launched.

From January 1, 2021, the federal register of Rosobrnadzor (FIS FRDO) will begin collecting information on completion of driving school.

This information base was created in 2013. Its goals are to combat fake education documents and reduce the number of violations and corruption in educational institutions.

Previously, only schools and universities loaded data into the system, but now driving schools will be added to the list.

Driving schools will have to send data on the certificates of completion of training issued and support them with their electronic digital signature. Regional relevant ministries and departments will be entrusted with monitoring this process.

For entering false information, legal entities will be punished with fines of up to 5,000 rubles. Once information from driving schools begins to enter the register, both inspectors and ordinary citizens will have access to it.

Rosobrnadzor will provide information upon request (you will need to provide your full name and certificate number). As Kommersant reports, the traffic police supported the introduction of a special register for novice drivers, because this system will reduce the burden on service employees who will be able to check certificates from driving schools online.

Transport tax on gas vehicles from January 1, 2019

From January 1, 2021, owners of gas-powered cars will be able to save on transport tax.

True, so far we are talking about only one region - the Leningrad region, reports.

The corresponding regional law was signed by the regional governor Alexander Drozdenko, the press service of the regional government reports.

Drivers who own vehicles running on gas engine fuel will be able to pay 50% of the established transport tax rate from January 1, 2021.

The benefit is established until 2023.

“Both owners of passenger cars and companies operating gas-powered buses can take advantage of the reduced tax rate. In parallel, we and gas supply structures are creating a developed network of gas filling stations in the region,” explained Alexander Drozdenko.

From January 1, 2021, passenger transportation will be exempt from VAT

Russian President Vladimir Putin signed a law that, from January 1, 2019, provides for an exemption from VAT for work related to the regular transportation of passengers and luggage by road and urban ground electric transport at regulated tariffs on the basis of a state or municipal contract. The corresponding subclause will supplement clause 2 of Art. 149 of the Tax Code.

We would like to remind you that currently these services are subject to VAT. According to the Government of the Russian Federation, this contributes to an unreasonable increase in budget expenditures on a monthly basis in the amount of VAT accrued and paid by executors of government contracts, which are included in the price of these contracts.

Federal Law No. 392-FZ of October 30, 2021 “On Amendments to Article 149 of Part Two of the Tax Code of the Russian Federation” will come into force on January 1, 2021.

In pilot mode, the project begins to be implemented from September 1, 2021, and full-scale operation is planned from January 1, 2019.

System "Platon" from January 1, 2019

The government proposed using the Platon system to control international transport across Russia. Violations will result in a fine of 1.5 million rubles and confiscation of cargo.

The government has submitted two bills to the State Duma aimed at introducing navigation seals during transit international road and rail transportation through Russian territory and fines for violating the rules of their use.

The first document (draft bill No. 457178-7) plans to create an electronic identifier service for transit road and rail transportation on the infrastructure of the Platon state system. The specified identifiers (navigation seals) mean devices that operate using GLONASS technology and ensure the transfer of information about the route of the vehicle, as well as the safety (opening) of the device to the system for tracking transit international transportation of goods. It is expected that the innovation will come into force on July 1, 2021, but not earlier than 30 days after the official publication of the adopted law.

And from January 1, 2021 (bill No. 457554-7) it is planned to begin to apply the rule that, by decision of the Government of the Russian Federation, the system for ensuring the tracking of transit international transportation of goods through the territory of Russia will be used to control the transportation of goods carried out for the purpose of importing goods into the country according to the list determined by the Cabinet of Ministers. The punishment will be established in the form of an administrative fine:

Bill No. 463847-7 “On amending Article 358 of Part Two of the Tax Code of the Russian Federation” was submitted to the State Duma by a group of deputies of the lower house of parliament led by Vladimir Sysoev, reports.

The document proposes to expand the list of vehicles that are not subject to transport tax by including vehicles with electric traction (electric vehicles), regardless of engine power. Deputies consider the transition to an environmentally friendly mode of transport one of the key tasks for the development of the automotive industry in Russia.

Such benefits have justified themselves in a number of constituent entities of the Russian Federation (including Moscow and St. Petersburg). However, the proposed measure is not considered permanent - the bill provides for a six-year period (from January 1, 2021 to December 31, 2024) for including electric vehicles in the list of vehicles not subject to transport tax. It is assumed that such a period will be sufficient to achieve the incentive goals of the bill. From 2025, electric vehicles are planned to be subject to transport tax on a general basis.

Fines for truckers from January 1, 2019

The Ministry of Transport plans to introduce a fine for unpaid passage of trucks on roads of all levels: federal, regional or intermunicipal, local.

The corresponding draft law was presented by the Russian Ministry of Transport for public discussion. For this purpose, the Code of Administrative Offenses is planned to be supplemented with Art. 11.22.1 It is assumed that within 20 days the fine can be paid with a 50% discount on its amount, for which it is planned to amend Part 1.3 of Art. 32.2 Code of Administrative Offenses of the Russian Federation. Fines for underfilling fuel from January 1, 2019

The bill, which provides for the introduction of turnover fines for underfilling fuel at gas stations, was approved by the State Commission for Combating Illegal Traffic in Industrial Products.

Now the document must be approved by the Russian government, after which it will be sent to the State Duma for consideration. The project may end up in the autumn session, but if it doesn’t make it in time, the deputies will consider it in the spring. Accordingly, the changes will come into force either on January 1, 2019, or in the middle of next year. Earlier, the Minister of Industry and Trade spoke about the punishment awaiting gas stations that underfill fuel: a fine of 1% of revenue for the previous year, but not less than 500,000 rubles. And this is only for the first detected violation. Repeat offenders will have to part with 3% of the proceeds (but not less than 2,000,000 rubles).

Benefit for "Plato" from January 1, 2019

From January 1, 2021, the transport tax benefit for vehicles weighing over 12 tons registered in the Platon system register will cease to apply, reports.

This provision is provided for in Art. 2 of the Federal Law of July 3, 2016 No. 249-FZ, according to which the provision of clause 2 of Art. 361.1 of the Tax Code of the Russian Federation is valid until December 31, 2021 inclusive.

The benefit was applied from 2021 and provided for a reduction in transport tax by the amount of payment under the Platon system.

The main complaint from owners of heavy vehicles against the Platon system was that the amounts paid were used for the same purposes as the transport tax. Thus, motorists had to pay twice for damage to roads. Until mid-2021, two payments were in force in Russia:

  • transport tax;
  • toll on federal highways.

Both fees have the same goal - to keep roads in acceptable condition, that is, their maintenance and repair. The only difference was that the fee for owning a vehicle went to the regional budget, and “Plato” payments were made to the federal budget. The Constitutional Court, after many appeals, came to the conclusion that making payments under the Platon system does not have signs of a tax levy, so it is impossible to compare these contributions. However, despite this, the life of heavy truck owners has been made easier - a tax break has been introduced for them.

It is this benefit that will be canceled from January 1, 2021.

About repetition

The violation is considered to be committed again according to the letter of the law if you are caught on camera or in the formidable hands of a traffic police inspector within a year after the execution of the first order. You also need to understand what execution is. This:

  • full payment of the fine (with or without a discount),
  • expiration of the period of deprivation of rights,
  • expiration of the period of administrative arrest.

For example, a driver was caught in a state of intoxication on January 1, 2019, and the court deprived him of his license for 1.5 years and also imposed a fine of 30,000 rubles under Part 1 of Article 12.8 of the Administrative Code. The court ruling was made on January 15, came into force after 10 days - on January 26, and the period of deprivation began (provided that the driver submitted his license to the traffic police on time). The driver paid the fine on April 1 of the same year.

In this example, the repetition will last from the end of the period of deprivation of rights - July 26 of the following year and for another year after that. If the driver is caught drunk again under the same article of the Code of Administrative Offenses, then he will face criminal punishment.

List of repeated fines for traffic violations in the table

What changed last year?

The latest innovations in the Code include the following:

  1. On July 3, the possibility of deprivation of rights not only for the presence of alcohol in the exhaled air, but also in the blood, came into force.
  2. On April 28, a definition and corresponding instruction about waffle markings appeared in the traffic rules, and therefore it became possible to fine for stopping at a “waffle iron” in a number of cases.

And it's all! All important changes that have occurred and only those planned can be tracked in our convenient timeline.

Amount fork

In the table of fines you can see that for certain violations there is a range of fine amounts. This means that the person hearing the case decides, at his own discretion, what amount to assign to the specified person. The most important role in this is played, as a rule, by the presence of other traffic police fines for the driver, especially under the same article of the Code.

The following circumstances will help you set a minimum amount threshold:

  • driver's remorse
  • their admission of guilt,
  • presence of dependents.

But the following can lead to a maximum fine:

  • the presence of harm caused by traffic violations,
  • the presence of other fines during the last year, especially similar to the current one.

A simplified system for collecting fines through the bank is being introduced

For violators of the rules, from mid-2021 it will be possible to operate a new, so-called simplified system for collecting traffic police fines, the amount of which does not exceed 3,000 rubles. It will affect offenses recorded by cameras and should “unload” the bailiffs.

In case of late payment, the bailiffs will send a notification about the issuance of the order for execution and at the same time send a request to the bank for the details of the violator’s bank accounts. If the amount is not repaid within 2 days, it will be automatically debited from the bank account. In addition, a minimum of 1000 rubles will be added to it. executive fee. If within 20 days it is not possible to collect the required amount through the bank, then full-fledged enforcement proceedings will follow with the right of the bailiff to use other restrictive measures (for example, seizure of property, etc.).

The only advantage for debtors will be the absence of their names in the FSSP database, which employers often check when hiring. An important innovation for 2021 will be the redirection of all funds received from traffic police fines for road repairs in the country. If previously they went to the regional budget, but were used for different cost items, then from January 1, new fines paid by drivers in full will go to regional road funds and exclusively for road repairs, so car owners can count on a widespread improvement in the quality of the surface in the near future. future.

How to appeal?

You will always find the procedure for appealing a traffic police fine on the back of the decision. According to the law, this cannot be done officially via the Internet, although the traffic police website accepts complaints as a gesture of goodwill, but some are refused and asked to be addressed officially. Therefore, you should always remember that according to the law you are given 10 days to file a complaint, the period for consideration of electronic appeals is 30 days (plus 3 days for receiving appeals). This means that if the traffic police refuses to consider your complaint (and does so on a legal basis), then the period for the general appeal procedure will have already passed.

A few lines about new fines for traffic violations in 2019

New Year is a time not only for pleasant gifts and anticipation of a holiday miracle. The onset of the new calendar year is also associated with a less pleasant side - the entry into force of new restrictions, fines and responsibilities in all areas of life. Motorists are no exception. In the new year 2021, car owners and drivers for hire will not have to be bored - deputies of the lower house of the Russian Parliament (State Duma of the Federal Assembly of the Russian Federation) have introduced new penalties and new areas of responsibility for photo and video recording systems. The life of a Russian motorist today is like in a fairy tale - the further it goes, the more exciting it becomes. Many sanctioned innovations from the traffic police are planned for 2021.
