What is the fine for lack of technical inspection in 2021?

In Russia, since 2012, the technical inspection ticket has been abolished - drivers no longer receive such a document and do not carry it with them. Let's look at what else a fine is possible for.

Fine for failure to pass technical inspection. There is no fine for driving without a technical inspection in 2021 on passenger cars. But without a technical inspection, the driver will not receive an MTPL policy. For driving without a policy, you are fined 500–800 rubles.

From March 1, 2022, the law will impose a fine for driving without a diagnostic card. For this violation you will be fined 2000 rubles. The fine will be sent from the camera no more than once a day.

For taxis, regular buses and trucks, the fine for lack of technical inspection is already in effect - from 500 to 800 rubles. From March 2022, this fine will be abolished, and instead all drivers will pay 2,000 rubles for driving without a diagnostic card.

Separately, companies are fined up to 50,000 rubles for releasing vehicles onto the line without technical inspection. This penalty remains unchanged.

Penalty for late technical inspection. There is no such fine for passenger cars yet. The inspection period in 2021 does not matter if the MTPL policy is in force. The main thing is that the diagnostic card is valid at the moment when you contact the insurance company for a policy.

From March 2022, the validity period of the diagnostic card will be important; an expired card will be fined 2,000 rubles.

For taxis, buses and trucks, the fine for an overdue inspection is the same as for a failed inspection - from 500 to 800 rubles.

The new fine for failure to pass a technical inspection will be 2,000 rubles.

A corresponding change is being introduced to Article 12.5 of the Administrative Code, which contains a list of sanctions for vehicle malfunctions. In particular, it is supplemented by a new part 11, which, after entering into force, will literally look like this:

11. Driving a vehicle for which a diagnostic card has not been issued in accordance with the established procedure, confirming the vehicle’s admission to participation in road traffic, shall entail the imposition of an administrative fine in the amount of two thousand rubles.

At the same time, Part 2 of Article 12.1, which previously provided for a fine of 500-800 rubles for driving without a technical inspection for drivers of taxis, trucks and buses, is excluded.

Conditions for passing technical inspection

Whether a technical inspection is required and how often depends by law on the type of vehicle and year of manufacture. The year is indicated in the PTS or STS.

For cars, trucks up to 3.5 tons, trailers and motorcycles. All this transport requires maintenance depending on the age of the car:

  • up to 4 years - no technical inspection required,
  • from 4 to 10 years - once every two years,
  • over 10 years old - every year.

For passenger cars for commercial purposes. These include training vehicles and regular buses:

  • up to 5 years - every year,
  • over 5 years old - once every six months.

From October 1, 2021, technical inspection of buses takes place with the participation of a traffic police officer. The police officer must sign the diagnostic card together with the service station employee.

For taxi service vehicles. Such cars undergo technical inspection every year.

For trucks heavier than 3.5 tons. The frequency of maintenance depends on age:

  • up to 5 years - every year,
  • over 5 years old - once every six months.

The owner is not obliged to wait until these deadlines to undergo technical inspection - this can be done earlier. For example, if it is necessary to travel abroad.

A matter of technology

Let us remind you that the State Duma adopted amendments to the law on compulsory motor liability insurance, which provide for the possibility of selling policies in the period from March 1 to September 30 without diagnostic cards. This was done simply because during the period of self-isolation, most inspection points are not working. Therefore, a problem arose with the preparation of diagnostic cards.

However, this does not mean that technical inspection is not necessary at all. Within a month after this period, that is, until October 31 inclusive, car owners must submit a diagnostic card to the insurer. So you can buy a policy now and undergo a technical inspection later.

If the car owner does not pass the technical inspection, then his policy will still be valid. No one will stop him on the road or hold him accountable for driving a car without compulsory motor insurance. With it you can perform registration actions at the traffic police. And in the event of an accident due to the fault of such a driver, the victim will receive compensation from the insurance company of the culprit. But at the same time, the insurer will impose recourse claims against its client. Igor Yurgens also noted that RSA will lobby for the complete decoupling of the MTPL policy from the diagnostic card.

By the way, the information systems of the Russian Union of Auto Insurers are ready to launch checks for the availability of compulsory motor liability insurance policies through traffic cameras, RSA President Igor Yurgens also announced this earlier. But, as the State Traffic Inspectorate reported, now is not the time to launch them. Inspections will begin after the end of quarantine measures.

Let us recall that last year in Moscow an experiment was carried out to identify cars that are driving without insurance, using cameras that automatically record violations.

Car owners were not sent fines by mail, but notices that they did not have insurance, and a reminder of the need to draw up a compulsory motor liability insurance agreement. Moreover, the system has shown its effectiveness. Car owners who received such a notification began to contact RSA.

It turned out that half of those who applied did not even suspect that their policy was fake. As a rule, they bought them from dubious agents right near the traffic police departments before registering the car. Some policies were simply “drawn” on a computer and had nothing in common with official forms. Others were printed on real forms that were stolen from insurance companies. According to experts, currently about 2-3 million cars are moving around the country without compulsory motor liability insurance policies. These motorists create problems for decent drivers.

Diagnostic inspection card in the Russian Federation

A diagnostic card is a document issued by a technical inspection point if the car is in good working order. It contains information about the car, PTS data, a conclusion and a stamp. You can get a maintenance policy using the card.

Electronic card - from October 1, 2021. Paper cards become optional, all information is now entered into the Unified Automated Information System (UAISTO). At the driver’s request, they can issue a paper document, but you can get an insurance policy without it - just give the number.

How to get a. To get a diagnostic card:

  • select the inspection item. Find the nearest accredited organization on the website of the Russian Union of Insurers;
  • come to the service center with two documents - a passport and a document for the car - STS or PTS;
  • pay for technical inspection services. They usually cost about 800 rubles for a passenger car;
  • stop by the service line and get checked. If a fault is found, a repeat technical inspection from October 1, 2021 can only be done by the same operator;
  • receive an electronic card - they will not give it to you, the data will be entered into the system.

Cancellation of cards - from October 1, 2021. The traffic police has the right to cancel diagnostic cards that were issued without a technical inspection. This can happen if the inspector finds out that the car was not taken for inspection, or faults are found in it that are not on the card.

The cancellation of the card will be noted in the EAISTO, and the inspection operator will be fined. The insurance company that issued the policy will also be notified that the card is fake. In the event of an accident, the insurance company will be able to request a recourse claim, that is, to sue the car owner for money.

This card is filled out by an employee of the service point; from March 2022 - in electronic form.

How will they be punished?

Everything is very simple! A sanction can be issued either by a traffic police inspector on the road in the absence of a diagnostic card, or on an auto-fixation camera when a technical basis for this appears.

But please note that clause 2.1.1 of the traffic rules contains an exhaustive list of documents that must be submitted to a traffic police officer for verification. And there is no diagnostic card here. Therefore, the driver has no obligation to carry a diagnostic card with him, and a new fine will be issued not for its absence, but for the absence of a completed technical inspection.

That is, the traffic police inspector will check the database for the presence of maintenance, and only then will he issue a fine.

How many times can you be discharged per day?

No more than once. The new law introducing a fine also adds a note to Part 12.5 of the Code of Administrative Offences, according to which drivers cannot be fined again within 24 hours after the first decision is issued.

Note. A person who has committed an administrative offense provided for in Part 11 of this article shall not be held administratively liable for the second and subsequent cases of detection of such an administrative offense within twenty-four hours from the moment of the first detection of such an administrative offense.

For example, if you were fined for the first time at 12:00 on May 27, 2021, then they will not be able to issue a second fine until 12:00 the next day, and at 12:00:01 onwards they are already entitled to do so.

Meanwhile, repetition of this violation will not provide for a more severe sanction, as, for example, there is one for repeated speeding.

When and how can you appeal a fine?

When can you appeal? It happens that a fine for driving without compulsory motor insurance is issued illegally. For example, the inspector refused to look at the electronic policy on the phone screen and drew up a report on the absence of the policy. When cameras start recording fines for driving without a diagnostic card, there will probably be technical errors.

How to dispute. In the first 10 days from the date of the decision, write a complaint according to the sample.

Send it to the traffic police by mail or bring it to the department in person. The inspection must respond within 10 days. If he refuses, the driver can go to court.

In addition to the complaint, you will need evidence, such as a DVR recording.
