4. The Rules clearly state that parking at a distance of 15 meters from the markings indicating a public transport stop is prohibited. You can stop in this area to pick up or drop off passengers. 5. Only disabled people or those who are currently transporting them can park their cars in the disabled parking lot. In this case, the car must, in accordance with the Traffic Rules, be equipped with the appropriate “disabled person” sign. The driver must also have a document (any document) confirming his disability. This is the only and sufficient condition. In Moscow they also require that such a car be included in the register of disabled cars. However, there is a fairly large number of foreign cars in the city. And their owners do not have the opportunity to get into this capital register. Therefore, the presence of signs and a certificate is enough to use parking for the disabled. At the same time, it is worth recalling that for the illegal use of a “disabled person” sign, a fine of 5,000 rubles is provided with confiscation of this sign.

6. Markings with red and white stripes indicate parking spaces for special vehicles. Namely for fire fighting equipment. It is believed that stopping and parking at such markings is prohibited for all other vehicles. But this marking is also not in the Traffic Rules. Therefore, they can evacuate from it only if there is a sign in front of such markings prohibiting stopping or parking.

7. This situation also occurs quite often. It is impossible to understand which street this sign refers to. In order not to be left without a car, it is better not to park it here or there.

8. Also a fairly common trap. A parking pocket with appropriate markings, and in front of it a sign prohibiting stopping. But if the markings do not comply with the signs, the driver must be guided by the requirements of the signs. This is stated in the Traffic Rules. Therefore, in such a situation, the car will definitely be taken away by a tow truck.

For those who are faced with this for the first time, the main thing is not to panic. First you need to find out where the car was taken. There they will explain to you where to go and what to do to rescue your car. First, you will have to go to either the traffic police or the Moscow administrative road inspection, depending on who towed your car.

For example, MADI can evacuate from under a sign prohibiting stopping or parking. And the State Traffic Inspectorate can evacuate from a parking lot for the disabled or from the sidewalk.

You need to go to one of these organizations to formalize a fine and obtain permission to issue a car. It is enough for the owner of the car to have a PTS or STS in his hands. And for any other driver, documents confirming the right to drive a car. Including MTPL policy. Many car owners store it in their car. Having completed all the documents, the driver must pay for the services of a tow truck. In Moscow it is five thousand rubles. And after that, go pick up the car. Appealing a decision for parking on an arc

  2. File a complaint with MADI. The best way to do this is through the official website of the Moscow Mayor. Photos of the place where the car was towed must be attached to the complaint. They will confirm that sign 3.27 prohibiting stopping was not in place.
  3. Request from MADI a diagram according to which traffic is organized at this place (SODD). The request must necessarily refer to Part 2 of Art. 24 of the Constitution of the Russian Federation, which gives a citizen the right to demand from authorities to provide copies of documents that affect his rights and legitimate interests. The fact is that the SODD refers to documents for official use, and they will not simply give it out. A copy of the Traffic Regulations is obtained from the supervision department of the traffic police unit in whose territory the decision was made to violate the traffic regulations and place them in a special parking lot.
  4. Then you need to look at the traffic police to see if there is a mark indicating approval from the traffic police for the placement of signs 3.27 “Stopping is prohibited” and 8.24 “Tow truck operating.” If there are no signatures and seals of officials, the problem is now not with the driver, but with the Traffic Management Center. Unauthorized placement of a sign is a serious abuse of authority and a direct violation of the law.
  5. An application is submitted to the prosecutor's office with a demand to prosecute the inspector who made the decision on the administrative case. If the prosecutor's audit shows that he exceeded his authority, he himself will face a fine of 20 thousand rubles.
  6. On the appointed day, you must appear at MADI to have your complaint examined. During the analysis, you must insist on your arguments and show photographs from the place from which the evacuation took place.
  7. If MADI refuses to satisfy the complaint, you need to contact the Meshchansky District Court (MADI is registered on its territory). The complaint is filed according to the rules provided for by the CAS of the Russian Federation (it is better to familiarize yourself in advance: administrative proceedings are somewhat different from civil or criminal proceedings).

The same algorithm can be used in other cities, if they have markings in the form of a semicircle - adjusted for the structure of local authorities. However, the main chain “SODD – prosecutor’s office – complaint to court” will remain unchanged. However, semicircles are practically never found outside of Moscow.

All these measures only work if there is no sign 3.27 or it is installed illegally. If the placement was agreed upon, alas, the fine and evacuation turn out to be absolutely justified, and it will not be possible to challenge them.

Marking parking in a semicircle on the streets is one of the controversial innovations with an unclear legal status.
