What is the new law about the “Disabled” sign?

This is not the law. That's an order. Its official name is “On approval of the Procedure for issuing the identification badge “Disabled” for individual use.” Number 443N. This order was developed on August 24, 2021 and came into force on September 4 of the same year. The regulatory act appeared against the backdrop of changes in the Federal Law “On Social Protection of Disabled Persons,” which also underwent changes.

The full official text of Order No. 443-N, current for 2021, is given below, and now we will explain what’s new with the entry into force of this legal act.

To obtain a disabled sign, you will need a passport and a certificate confirming the person’s disability. When submitting an application through the State Services portal, you must make scanned copies of the specified documents. If the application is sent by a citizen who does not have Russian citizenship, then in this case a temporary residence permit, or a residence permit, or a refugee certificate must be added to the general package of documents.

An application for a preferential “disabled person” badge is available only after passing the MSEC through the State Services portal. The response received as a result of the commission will be the basis for granting a special sign or refusing to grant it.

A preliminary medical examination is required for registration.

To complete the procedure, it is recommended to follow the following instructions.

Step 1

Go to the official State Services portal and click on the “login” button.

Enter your username and password and click on the “login” button.

The login may consist of a phone number, email address or SNILS number.

Step 2

Select section ".

Select the “disability” subsection.

Step 3

Click on the line “Determining disability”.

Step 4

Select the item “medical and social examination”.

Click on the line “conducting a medical and social examination to establish disability.”

Step 5

Click on the “get service” button.

Then fill out the proposed application form. Personal data and contact information are transferred automatically from the personal account account on the State Services portal. The remaining information must be filled out yourself. The latter includes: address of residence, name of department department, purpose of the examination, type and name of the organization that issued the referral, date of issue of the referral, etc.

Once the form is filled out, it is processed. If the form is correct, it must be sent to the government department. Next, the department reviews the appeal and issues a response. A positive response is expected if all the information is reliable and the information provided is comprehensive.

After this, the portal user will be able to submit an application for a special “disabled person” badge. When submitting an application, fill out an online form, which includes:

  • information about the organization to which the application is being submitted;
  • user personal information;
  • his address;
  • passport details;
  • information from the disability certificate;
  • Goal of request.

. After filling out the form, the user consents to the processing of data.

In the response notification, the user will receive information about when and where he can receive a special “disabled person” badge. The government agency has 30 days to produce the sign.

Who can receive the badge?

Disabled people of groups I and II, as well as, in some cases, disabled people of group III with a confirmed disability can hang a corresponding sign on their car.

If a disabled person does not have a car

In this case, he can still receive a badge - the Order does not link the receipt of this identification badge to a specific vehicle, but only to a specific person.

In this case, the person can simply carry it with him and hang it on any car that transports it. The order, of course, takes into account the subtlety when the “Disabled Person” sign can be equipped not only with a car belonging to this person, but also with any car transporting a disabled person (clause 1 of the document). This is especially true, for example, for disabled children.

Visual changes

The innovations affected not only the registration procedure, but also the appearance of the information sign. The following visual changes take place:

  • the front side of the sticker, where information about the validity period has been added, as well as the registration number of the mark (instead of the validity period, the inscription “Indefinite” is possible);
  • the back side, where the personal data of the citizen for whom the sign is issued is now written (last name, first name, patronymic, disability group, date of birth, etc.).

Where to get it?

In a special institution called the “Bureau of Medical and Social Expertise” (hereinafter referred to as the ITU Bureau). The institution itself is presented in the form of 3 specific organizations:

  1. branches of the bureau in regions and cities, where on May 28, 2021 you can receive the identification badge “Disabled” in normal situations and where you should contact first,
  2. the main bureau - contact here when appealing decisions by branches and if additional examinations are required,
  3. Federal Bureau - here you can get a “Disabled Person” badge if you need to appeal the decision of the main branch of the institution, or in particularly difficult cases of establishing disability.

You can receive the badge at your place of residence - that is, at any branch, regardless of the place of registration.

How and where to get a badge

If previously the “Disabled” sign was available to buy on the open market and it did not have a registration number and did not contain any personal data, now, according to new regulatory documents, the provision of new stickers is the responsibility of the territorial representative office of the medical and social examination in Ryazan, which confirms and assigns disability groups.

The paperwork is completed at the place of permanent registration of a person with a disability; the entire process is allotted a period of up to one month from the date of registration of the submitted application. You can receive the sign directly within 1 business day from the date of registration of the permit.

The decision to remove the sign from retail outlets is intended to reduce the number of violations related to the misuse of the benefit.

How to get a?

To do this, as we mentioned above, you need to contact any branch of the ITU Bureau with a written application. The application contains all the standard information - from the full name of the disabled person and his residential address to the insurance policy number.

Also, when applying, a disabled person will need:

  • passport or birth certificate,
  • certificate of disability.

After submitting the application, a sign is produced and issued, according to the regulations, no more than within one month. But it also takes time to register the application itself.

Applications for obtaining a disabled sign

There is no standard for writing an application. Applications are made in free form. However, the following items are required:

  • Name of the authority to which the application is submitted;
  • Personal information of the applicant. Full Name. (It is not necessary to provide a middle name if it is not indicated due to the influence of national and cultural traditions);
  • Initials of the person's authorized representative (if registration is made by power of attorney);
  • Insurance number and SNILS;
  • The applicant's registration address or the address of his actual residence;
  • Passport details or birth certificate. Indicate the series and number of the document, department code, date and place of issue of the document;
  • Sign language interpreter or sign language interpreter (if necessary);
  • The applicant’s consent to the processing of personal data;
  • The reason why the application is being made;
  • Applicant's email or mobile phone;
  • Date and deciphered signature;

What does the new “Disabled” sign look like?

Just like the old one, but with a number of changes. So, now the sign is written in handwriting on the front side:

  • sign number,
  • the date of expiration of the disability,
  • region of issue.

And on the back:

  • Full name of the disabled person to whom the badge was issued,
  • date of birth,
  • disability certificate number,
  • group,
  • period of disability,
  • date of issue of the sign.

The disabled sign is lost

If the disabled person badge is lost, you can get a duplicate of it. You can get a new designation based on the entry made in the journal. This entry is made immediately after the sign is issued. A note is made on the sign indicating that a duplicate of the lost sign was issued. The date the copy was issued is also indicated.

Once again, an ITU act should be drawn up. It will contain information that the sign has been reissued. If a disabled person has changed his place of registration, he can submit an application to the branch located next to him.

Fulfills the request of the bureau that provided the first sign. The decision is issued within five days. After the decision is made, the disabled person is given a copy of the previous sign.

If you lose your sign

Nothing will happen. The current legislation for 2021 does not provide for a penalty for loss. In this case, the bereaved person should contact the ITU Bureau for a duplicate of the “Disabled Person” sign. Then, in the corner of the new sign, replacing the lost one, the signature “Duplicate” is placed, and the old one is declared invalid.

Also, a new sign will have to be obtained if the disabled person changes his place of residence.

Some prohibitory signs are not valid if they concern vehicles driven or transported by disabled people, including children of this category of citizens. The main condition is the presence of an appropriate sticker on the car; the corresponding decision was made in 2021 and included in Section 3 of the 1st Appendix to the Traffic Regulations. Previously, a sticker was only needed when stopping in a disabled parking lot.

Please note that the driver is required to have a certificate confirming his disability; the document must be presented upon request of the traffic police officer.

This is due to the fact that there have been cases where the distinctive sign was used illegally. Now, if such use of a sign is detected, a fine of 5,000 rubles and confiscation of the sign are provided.
