Actions after registration termination

Many drivers are interested in what to do if their car registration has been cancelled. There is no definite answer, since it all depends on what served as the basis for the suspension of registration. The following is a list of potential causes and next steps:

  1. Loss of the vehicle. For example, as a result of damage after an accident. In this case, it is necessary to carry out repairs and return the vehicle to full operation.
  2. Car theft. You need to fill out a statement and submit it to the police department. If the vehicle is found, you can restore the registration.
  3. The temporary registration of the car in the Russian Federation has ended. An application is submitted to the traffic police department, which indicates a request to extend the permit to operate the imported car. If the verdict is positive, then it will be possible to restore the vehicle registration.
  4. Forgetfulness of the new owner of the vehicle when he did not re-register the vehicle in his name within the allotted time (10 days). In this situation, you need to contact the traffic police for this procedure.
  5. End of the lease agreement period. To restore registration, you need to either draw up a new agreement or renew the old one.

What is vehicle registration in the traffic police?

Who has the right to register a vehicle in the Russian Federation?

Vehicle registration may be carried out by persons who have rights established by law and confirmed by relevant documents.

These can be individuals and legal entities:

  1. Citizens or residents of the Russian Federation;
  2. Citizens or residents of foreign countries;
  3. Individuals who do not have citizenship.

The possibility of temporary registration is also provided for vehicles registered in other states (if the period of their temporary import exceeds 6 months).

Registration actions regarding a car can be carried out by:

  • Owners – having a document of ownership of the vehicle;
  • Owners – this means the main owners of the vehicle who do not have ownership rights to the car;
  • authorized by the owners or principal owners.

The main registration documents are:

  1. PTS – Vehicle Passports;
  2. STS – Certificate of Registration.

You should also understand two important points:

  • Ownership of a car can be collective.
  • registration cannot be collective - it is allowed only for one person (individual or legal).

Attention! Registration of cars is not a procedure for approving transactions for their purchase and sale, as is practiced in the real estate industry. Purchased cars can be fully used by their owners without a control device, outside public roads, if this does not contradict other laws of the Russian Federation.

Registration restoration

To restore your registration, the first thing you should do is fill out an application, the form of which can be found on the government services website, or you can ask the traffic police officers. After filling out the application, you can take it in person, or you can submit it online. There is another way - through an official representative, which is provided by all law firms today.

As noted earlier, suspension of registration does not require state duty, but restoration does. The final price will be influenced by exactly what actions need to be performed:

  • A brand new registration certificate will cost 500 rubles;
  • Making changes to the PTS will cost 350 rubles.
  • To obtain new numbers you will need to pay 2 thousand rubles.

A change of rights is not required if the previous ones are retained. But the remaining 2 points are mandatory. The final minimum amount for restoring registration is 850 rubles. In some cases, other operations may be necessary, such as issuing license plates for trailers or issuing a new vehicle title. This requires additional costs. If you use the help of an official representative, you will have to pay for his services.

Difference between deregistration and termination of registration

The process of deregistering a vehicle is completed by deleting it from the traffic police database and archiving the information. This usually means:

  • complete recycling;
  • travel outside the country.

At the same time, the car does not have the right to drive on Russian roads. Termination of registration is a temporary preventive measure; the machine is not deleted from the database, but receives the status “Awaiting decision.”

Which organization prepares the documents?

The traffic police MREO works with papers for vehicles. Employees have the right to register cars, change the database, stop registering and remove a car from the lists. The citizen comes to the department with an application and documents and hands them over to the MREO employee.

Documentation

To activate the registration process you need to prepare the following documents:

  • Vehicle passport;
  • Car owner's passport;
  • Statement;
  • OSAGO (issued after the expert declares that he has successfully passed the technical inspection);
  • Vehicle registration certificate (if available);
  • Power of attorney to act as a representative on your behalf (if you contact a lawyer).

Among the additional documents that you may sometimes be asked to present are a donation agreement (if the car was received as a gift), a purchase and sale document. In both cases, copies of these papers are provided.

Recovery process

As a result of the inspection, a conclusion will be issued; it must be added to the certificates already provided.
  4. Next you need to wait for the verdict of the State Traffic Inspectorate. If the decision is positive, the motorist will be issued license plates (if necessary) and registration papers.

Drivers often wonder how to register a car if the old owner stopped registering, and the 10-day period allotted for this was missed. In this case, the process will not be different, the only thing is that the new owner of the car will need to pay a fine for such a delay.

When is registration suspension required?

According to Art. 18 of Law No. 283-FZ, temporary suspension of registration or, more precisely, termination of state registration of a vehicle with the right to renewal is carried out in the following cases:

  • According to the vehicle owner. This can happen, for example, when long-term repairs are required or during theft (theft). In the first case, the machine cannot be used for a long time. By ceasing its registration, the owner will not have to pay transport tax. And after repair it can be resumed again. In the second case, while law enforcement agencies are searching for the car, attackers can use it to do a lot of different things. Therefore, in order not to be held responsible for offenses that he did not commit, the owner of the car temporarily stops registering it. To do this, you need to bring a certificate of theft to the traffic police. When the vehicle is found, registration can be resumed.
  • According to the former owner of the vehicle. In accordance with current legislation, the new owner of the vehicle is required to register it in his name within 10 days after purchase. However, due to various circumstances this may not happen. Therefore, so that the former owner of the car does not receive receipts for payment of fines from cameras, transport tax, and so on, he can stop recording the sold car by presenting his passport and the sales contract.
  • Expiration of the state registration period.
  • If there is information about the death of the owner of the vehicle.
  • Upon liquidation of a legal entity or termination of the activities of an individual entrepreneur, if a vehicle was registered on them.
  • When guardianship over a minor owner of a vehicle is terminated, if it was registered in the name of a guardian, as well as when the child owner of a vehicle reaches the age of 16, if it was registered in the name of one of the parents or a guardian.
  • If the vehicle was previously registered with the state on the basis of documents that were subsequently found to be counterfeit or invalid.

The difference between suspension of registration and deregistration

Suspension of registration (termination of registration) of a car has a number of differences from deregistration of it. The latter applies only in three cases:

  • After disposal of the vehicle. In this case, the basis for the procedure is a certificate (act) of disposal.
  • Removal of a vehicle abroad in the event of its alienation with the transfer of ownership to a foreign person.
  • If the state registration of the vehicle was terminated due to the expiration of its term and was not renewed by the owner after one year after the date of termination.

Accordingly, the traffic police authorities, when deregistering and terminating (suspension) carry out various registration actions. As already mentioned, in the first case, information about the vehicle is transferred to the vehicle register archive, documents and signs are submitted to the MREO (when the vehicle is exported abroad, the owner is issued transit signs and the STS is returned with a mark).

When registration is terminated, information is only entered into the vehicle register about the temporary termination of the vehicle’s permission to participate in road traffic, and documents and license plates are invalidated and entered into the corresponding search registers of lost special traffic police products.
