What is important?

When deciding to document an accident by drawing up a European protocol, you should know: according to the procedure, compensation for damage is provided in an amount not exceeding 50 thousand rubles.

There is a caveat: if the incident occurred on the highways of federal cities or their regions, the amount increases to 400 thousand rubles (the international limit for compulsory motor liability insurance).

Conditions for drawing up a report without the police

The law provides for a number of road situations when, during a transport incident, you can do without the intervention of a police officer. What are these situations? Everything is quite simple. A European protocol can be drawn up when the cars have a compulsory motor liability insurance policy and the drivers are not under the influence of alcohol, drugs or medications. In 2021, the form has the same form that was approved in 2011 by Order No. 155.

How to fill out the European protocol?

Before you start filling out, make sure that you have the necessary pages of the form, take a regular ballpoint pen (fountain pens can smear and do not apply enough pressure to copy what is written onto the second page). Do not fill in with a pencil - it is easily erased.

The question often arises: does each driver have to fill out the form or will it be common for both? Only one form must be completed. It makes no difference which driver provides the original.

On the special fields of the front half of the form, space is allocated for describing the traffic accident. The circumstances, place of the event, date, time of recording, type, and nature of the injuries received must be clearly indicated.

Clause 14 must contain the availability and description of the technical condition of the car after the fact. The description is carried out specifically, clearly, indicating the main and secondary facts. The presentation is concise and literate. The speech of the presentation should not contain common terms; technical breakdowns and damage are described in detail and clearly.

Detailed guidance on completing the Europrotocol in 2018

The first 8 points of the Europrotocol contain general information about road accidents. These include:

  1. Place of the incident. You must enter the exact address.
  2. Date of. It is necessary to indicate not only the date, but also the time of the accident.
  3. Number of vehicles that were damaged. A specific number is written down.
  4. Number of people whose health was damaged. First, the number of wounded is recorded, then the number of dead.
  5. Data on testing participants in the accident for alcohol intoxication. The corresponding box indicates whether such a check has been carried out.
  6. Material damage caused to other vehicles or property. The answer is marked as affirmative or negative.
  7. Witnesses to a traffic accident. This field contains the name and address of the person who saw the details of the incident.
  8. Was the document drawn up by a traffic police officer? A negative answer is marked.

The remaining points (from 9 to 15) are filled out by drivers separately. Each of them writes down information about themselves and their vehicle, and also indicates information about their existing insurance policy. Let's look at this in detail:

  6. After filling out the form, drivers sign it. Before doing this, it is important to carefully review both columns. This check will help prevent unpleasant misunderstandings in the future. After signing, the document is divided between the drivers. The signature on each of them means that the participant in the accident has read all the information and agrees with its authenticity.
  7. The reverse side of the document is filled out after dividing the form. This is done by each driver individually.

What should be shown on an accident diagram?

Road accident diagram is a section of the description of the place that maximally reflects the clarifying circumstances. The current situation may be affected by unnoticed signs, parking, signs, markings or signs. It’s difficult to describe, but to depict it schematically on paper is clear and expedient.

There is no concept of the Europrotocol in Russian legislation. The word is borrowed from European practice, where drivers report accidents without involving the police in 80% of cases. Europrotocol

Drivers who have issued an MTPL policy before October 20, 2017, for the duration of its validity, can use the forms issued by the insurance company at the conclusion of the contract - the form approved by Order of the Ministry of Internal Affairs of the Russian Federation No. 155 of 04/01/11. Payment limit under the European protocol

The European Protocol provides for payments to victims of road traffic accidents of a certain size. The maximum amount since August 2014 was 25,000 rubles. Later amendments introduced changes in the amount of payments up to 50,000 rubles. The amount remains limited and is not subject to independent correction by the insurance company. The norm is confirmed by part 4 of article 11.1 of the Federal Law of April 25, 2002.

There is a significant exception. Applies to road accidents registered on the roads of Moscow, St. Petersburg, Moscow, Leningrad regions. Instructions for filling out the Europrotocol

The European protocol consists of 2 sheets; on the first side, participants in an accident enter the following data:
  • the location where the collision occurred and the exact date of the incident. If this happened in a populated area, you must indicate the actual address where the emergency occurred. If this happened on the highway, the kilometer number and its name are recorded. The time of the transport incident must be entered into the protocol with maximum accuracy;
  • information about the number of vehicles damaged during an unsuccessful maneuver. Points 3 and 4 of the document are completed. According to the rules, there cannot be more than two such cars. As for the victims, such people should not exist at all. If the accident that occurs does not meet these criteria, you need to call the police;
  • information about witnesses. If there are citizens who saw the accident, you need to enter into the protocol the name of the witness, place of residence and get his phone number;

IMPORTANT !!! Next, both participants in the transport adventure fill out information about themselves, their vehicle, and indicate information about the insurance company. First, the road is drawn, the names of streets, houses, and other identification marks are indicated, with the help of which you can easily determine where the collision occurred. What to do after completing the European protocol?

The completed, verified protocol must be sent to the insurance company in a timely manner. It is not necessary to appear in person. Corresponding postal services are acceptable.

During the 15 days following the incident, you cannot begin to repair the damaged vehicle. Did a representative of the insurance company want to verify what happened or check the accuracy of the facts presented? The law allows for appropriate actions to be taken within 15 days.

Does the insurance company want to conduct a professional examination of the car? An official request is sent to the address of the participant in the accident. The interested party is obliged to provide the car to the place designated for examination no later than 5 days.

If the owner of the car fails to comply with the conditions, the insurance company has the right to apply the indicated sanctions and issue a refusal to pay.

Is it possible for the person responsible for the accident to further challenge the Notice that he signed earlier?

It happens that during an accident a person gets nervous, tries to concentrate, remembers, analyzes, missing important, significant nuances.

While filling out the protocol, he thinks about how logical and correct the presentation of the circumstances of the incident is. May make mistakes when describing details, forget to indicate important points. Anxiety is a bad helper.

When morale stabilizes, a person may remember additional facts and want to adjust the protocol.

When can you use the Europrotocol?

The practice of independently resolving conflict situations on the roads has long been widely used in Western countries. This method of handling minor accidents is very popular with many drivers who know their rights and know how to exercise them.

To use the new form of registration of a traffic accident, you must meet certain conditions:

  • only two vehicles were involved in the accident;
  • both drivers have active MTPL policies;
  • no casualties;
  • infrastructure elements are not damaged;
  • the amount of compensation for damage does not exceed 50 thousand rubles;
  • There are no disputes between the drivers; the culprit admits his guilt.

Important! At the slightest disagreement, the police should be called. Only they are authorized to resolve disputes between drivers in road accidents.

It is impossible to draw up a Europrotocol in cases where at least one of the road users has received some kind of damage. Even if the damage is extremely small, it is better to refrain from drawing up the Euro Protocol. In this case it will be illegal.

It is impossible to fill out a Euro Protocol (the form and sample form can be downloaded below) if only one vehicle was involved in the accident. For example, the driver lost control and flew off to the side of the road or hit a lamppost. In such cases, the law on a simplified procedure for registering a traffic accident does not work. Calling the police is mandatory.

If both drivers have their documents in order and have reached an agreement, you can quickly solve this problem by filling out the Europrotocol. After this, you can go about your business without even waiting for the traffic police to arrive. They may not be informed about the accident at all.

After the document has been drawn up, you must present it to your insurance agent, having first collected a complete package of papers. No more than 5 working days are allotted for this.

If at least one of the participants in the accident was physically injured, his health was harmed (even to a minor degree), drawing up a European protocol is not an acceptable option. Is it possible to use the Europrotocol if more than 2 vehicles are involved in an accident?

According to the law, such European protocols will not be accepted for consideration by insurance companies. These are mandatory requirements stipulated by regulatory documents.

Is it possible to issue a “Europrotocol” if one of the vehicles is not registered in our country?

The place of registration of the car does not matter for resolving issues regarding insurance payment. It is important that the motorist of a foreign vehicle has a compulsory motor liability insurance policy or a Green Card. With their presence, the regulations for completing the European protocol are no different than with the participation of two domestic cars. European protocol for non-contact road accidents

What is the form

The standard form that comes as an attachment to the insurance contract is a sheet with an insert. When filling out the front page, all information is copied onto the attached sheet, so drivers receive two similar copies. Each participant is assigned their own column to fill out.

It does not matter which column “A” or “B” the participant chooses, or whether he takes the original or a copy for himself.

How to fill it out correctly

The European accident report, a sample of which will be offered on our website, must be filled out according to the following rules:

  1. Use regular ballpoint pens with blue ink.
  2. A pencil cannot be used, as there is a risk of abrasion of information and its spontaneous correction.
  3. Gel fillers and other inks that are prone to smudging should not be used.
  4. You can use a ready-made form from the insurance company or a printed 2021 form.
  5. You only need to fill in those fields that comply with the rules of the European protocol.
  6. The first page must contain identical information on both copies, the back side is filled out by each participant separately.
  7. The notice must not contain corrections. Each adjustment is agreed upon by the participants and confirmed by two signatures.
  8. If the information that the participant wants to present on the back of the form does not fit on printed media, then an ordinary blank sheet is taken. It must be indicated on it that this is an addendum to the notice, and in the form itself it must be stated that there is an addition to the protocol.
  9. The form must be cut after each driver has filled out their column and entered general information and signed.
  10. The back of the form can be completed at any time prior to submission to the insurance company and does not require two signatures.

If there are inaccuracies or uncertified corrections in the form, then additional investigation may be required and even a denial of payment.

What to fill out

As noted above, you only need to enter information in those fields that the warriors have the authority to fill out. In particular, they cannot determine the degree of intoxication; a dash is placed here. So, let's pay attention to the mandatory information on the title page:

  1. Place. The address near which the collision took place is indicated. If this is a route, then the kilometer number is written down.
  2. Date and time. The current date and minute-by-minute time are indicated.
  3. Number of vehicles. We set the value to “2”, because if there are 3 or more cars, then you need to call the traffic police.
  4. Number of wounded and dead. It is necessary to put a dash, because if there are victims, then the simplified scheme cannot be used.
  5. Medical examination. We write “no”, since only inspectors have the authority to carry it out.
  6. Damage to other vehicles and other property. Oh, since more than 2 participants are not allowed to register under the European protocol.
  7. Witnesses. If there are eyewitnesses, then we indicate their full name + phone number + address.
  8. Information about traffic police officers. There should be a tick next to the answer “no”, because this scheme does not provide for the participation of inspectors.

Starting from the 9th point, the sheet is divided into two columns, which each participant must fill out independently. It doesn't matter who enters the data first.

  1. In paragraphs 9-11 you need to provide information about the car, owner and driver.
  2. In line 12, information about the insurer is entered: name, validity period and date of issue.
  3. Location of the first collision. In the picture, an arrow is placed near the part of the car where the first blow occurred.
  4. List of damaged parts. It is necessary to describe all parts of the body that were damaged (broken off and damaged).
  5. Notes. The party at fault for the collision is indicated if this is obvious and the driver agrees with the offense.
  6. Circumstances of the accident.
  7. Scheme. This is a very important part of the notice. It needs to be presented in the form of a graphic diagram. Streets, buildings and other stationary objects are drawn. The arrows indicate the direction of movement, and the cars themselves are indicated by rectangles. Each schematic image must be deciphered at the bottom of the diagram.
  8. Signatures of the parties.
