The updated Code of Administrative Offenses gives judges the opportunity to hold people accountable for intoxication, not only caused by alcohol, psychotropic substances and drugs, but also when “the presence of other intoxicating substances in the human body.”
According to Kommersant, we are most likely talking about medicinal substances, the detection of which cannot now punish drivers. A ban on the use of “new potentially dangerous psychoactive substances” is also being introduced, but this concept is not defined.

There have been no legislative innovations regarding penalties since this year on January 1 or March. By March, the traffic police and the Ministry of Transport of the Russian Federation were supposed to make proposals to develop changes to penalties for speed violations. We are talking about the possible return of the article, according to which fines were established when exceeding 10 km/h. Currently, such violations are not punishable by penalties.
Since the decision on such changes has not been made, it is too early to say when it will start working. Although there have been repeated attempts to return this administrative punishment:
- In 2013 (summer), the money for increasing the speed limit by 10 km/h was abolished.
- A year later it was proposed to return this punishment.
- Six months later there were again proposals with the initiative to return the punishment.
- Since 2015, numerous attempts have been made to return traffic police fines for speeding over 10 km/h, but everything ended in failure. Drivers today can violate speed limits while driving with impunity, exceeding them by 20 km/h.
Drivers will face new fines in 2021
It is unknown when the changes will come and how much the punishment for violations will be. Now there is no exact information, because changes still need to be made through the adoption of the Federal Law. And yet it does not exist even in plans.
First, the law needs to be developed, registered, and then only it will be considered in the Duma, where it must go through three readings. Then the new changes are approved by the president, and only then they go into effect. As for other fines, there were rumors that they would be increased by 6 times. But for now, these innovations are just being developed.

Fines for speeding in 2021 – table and amount
Speaking about the dependence of the method of applying penalties to a violator who has exceeded the speed limit, let’s consider the case of a traffic police inspector recording a violation on the road. Liability applies as follows.
A traffic police officer uses a mobile radar to measure the speed of cars moving on the roadway. When it is detected that the limit established in a given area has been exceeded, the inspector stops the vehicle.
He is obliged to familiarize the driver with the radar readings, and also present a certificate for it upon request.
It records the date the device was tested and the measurement error. Often, indicators of error can help avoid or mitigate punishment.
A resolution on the offense committed is drawn up and a copy is given to the driver against signature. If on-site receipt is refused, a copy is sent by post within up to three days from the date of the decision. The procedure for serving a decision is the same for administrative penalties in the form of a fine and for deprivation of a driver’s license.
The violator has the right to challenge the fact of committing an administrative offense and the punishment for it. In this case, the inspector draws up a protocol, which becomes an annex to the issued resolution.
In most cases, speeding on the road, recorded by an inspector using radar, is referred to the police. The exception is those moments that require transferring the case to court (according to Parts 1 and 2 of Article 31.1 and Article 23.3 of the Code of Administrative Offenses):
- in case of a repeated offense associated with exceeding the speed limit of more than 60 km/h from the established speed limit on this section of the road;
- in case of exceeding the speed limit by more than 60 km/h, when the inspector sent the case to court.
Few city residents who have not traveled outside the region understand that somewhere in the neighboring region, conditions on the roads may be completely different. The unpleasant traffic jams in Samara and the drivers forced to languish in them with their restraint cannot be compared with the rudeness on the roads in the Krasnodar Territory and the Republic of Adygea. Here, drivers simply ignore many rules, not turning on their turn signals, not allowing pedestrians to pass, brazenly driving through a red light, or turning around through a double line. Kazan drivers also feel differently - the quality of roads and the internal policy of the republic are changing behavior on the roads for the better.
There is currently no opportunity to buy a traffic rules book and use it for years - the rules change very often. Recently, the maximum number of changes concerns the introduction of all kinds of penalties and increasing the size of existing penalties for motorists who have violated the rules.
Every year there is talk about depriving people of their license for a long period for speeding twice as high as the speed limit on a given section of the road. Current rules only allow for a fine or deprivation of the right to drive a vehicle for up to 6 calendar months. This does not scare all drivers - they continue to regularly exceed the speed limit. Probably the increased period of deprivation of a driver's license will have a stimulating effect on them.
Officially, information on the new amounts of financial punishment for drivers is still under consideration. At the same time, drivers should not expect that as a result of the review, fines will become smaller - they will definitely increase. Moreover, it is already obvious that additional types of punishments will appear for previous offenses, as well as new ones will be introduced, in particular, for dangerous driving.
Plans to introduce such a system have been announced several times. In 2016, the corresponding law was adopted in the first reading, but since then nothing has changed in this area. Now, in addition to the fines received for this or that offense, the offenses themselves will accumulate. If a driver commits 3 violations of the same type of rules, then in addition to the corresponding fine, he may be deprived of his license for up to 1.5 years.
Currently, this rule applies to the following violations of the rules committed three times:
- running a red light;
- Unreasonable driving into the oncoming lane;
- exceeding the speed limit by 60 km/h;
- driving in reverse in prohibited places;
- ignoring the advantage of pedestrians while driving;
- turn/turn around in places marked with a prohibitory sign;
- failure to provide passage to a vehicle having priority;
- crossing railway tracks with a closing barrier/forbidden signal.
In 2021, it is the cameras that record the largest number of excesses, so I propose to consider the features of imposing fines using automatic means.

- For a violation recorded by a camera, the driver cannot be deprived of his license or receive a warning.
- The maximum fine is imposed on the driver if the relevant article provides for deprivation of rights.
- The minimum fine is imposed on the driver if the relevant article does not provide for deprivation of rights.

The punishment practically coincides with what is charged to the person driving the vehicle by the traffic police (exceeding up to 60 km/h). If you exceed 60 km/h, the sanctions will be softer than if the car is stopped by a traffic police officer.
No matter how much the speed limit is violated, the driver will not be deprived of his license, he will simply receive a decision on a fine of 5,000 rubles. – both for the first time and for subsequent times.
The rumor was based on the fact that before March 1, 2019, the Ministry of Transport and the Road Safety Inspectorate were tasked with drawing up a project to reduce the “penalty-free” speed to 10 km/h.
However, when the specified date arrived, nothing happened, which is completely logical. The issue is in the status of an initiative, not a bill. In addition, it would be technically impossible to fully develop the project and implement it in such a short time. Consideration of the initiative has now been postponed until 2021.
The difficulty is that the minimum fine, according to Part 2 of Art. 3.5 of the Code of Administrative Offences, is 500 rubles and is already due for speed exceeded from 20 to 40 km/h.
Consequently, the introduction of a new punishment will lead to tougher measures in relation to other offenses. You will also have to reconfigure or change all photo-video recording systems for traffic violations.
The state believes that reducing the fine will guarantee its payment. Indeed, when it comes to small amounts, it is easier to give them away - both physically and psychologically.
Therefore, starting from 2021, there is a law on the basis of which you can pay a fine within 20 days and receive a 50% discount. Moreover, it does not matter whether it was obtained on the basis of an inspector’s decision or recordings from speed cameras.
However, the discount is valid only in special cases when the violation is minor and the driver does not regularly disregard traffic rules:
- the speed limit was exceeded by no more than 40 km/h (including repeated);
- the violation occurred for the first time.
Traffic police fines with photo recording
Photographic recording of traffic violations was introduced for the safety of pedestrians and vehicle drivers.
Now, along with traffic police officers, special cameras monitor the situation on the roads.
The procedure for monitoring and imposing fines using cameras is regulated by current regulations:
- Code of Administrative Offenses - Art. 2.6.1, 26.8, 28.6 p.3, 29.6 p.1;

In order to relieve the workload of the courts, minimum penalties in the form of fines are applied for violations detected using special cameras.
If a violation is punishable by deprivation of rights or administrative arrest, then when the violation is recorded by a camera, a fine of 5,000 rubles is applied . If a violation is recorded by a traffic police officer, the punishment will be different.
For example:
- speeding by 60 - 80 km/h - a fine of 2,500 rubles is imposed; repeated – 5,000 rubles;
- speeding over 80 km/h – 5,000 rubles, both for the first time and again.

The driver needs to send an application to one of three authorities:
- traffic police;
- the court located at the place where the offense was committed;
- the operator responsible for the means of recording violations.
The statement should succinctly and briefly state the arguments why, in your opinion, the fine was issued illegally. It is advisable to attach evidence, for example, a recording from a video recorder, which will illustrate that you are not involved in the commission of an offense, or testimony of witnesses.
If the attached evidence turns out to be convincing, penalties will be lifted from the driver. In the worst case, the complaint will be left unsatisfied.
As statistics show, it is the camera that is the most common detection of speeding. Inspectors rarely punish precisely for these acts.
And there are several positive points here:
- if the fact is recorded by a video surveillance camera, then the driver cannot be left without the right to drive the vehicle in case of any excess. Documents are not taken away;
- if, according to the regulations, the subject exceeded the speed limit by such an indicator that implies deprivation of rights, then the maximum possible monetary penalty automatically becomes the penalty;
- if the excess is equal to the range for which only a penalty is due, then the minimum penalty is applied.
In total, we find that the minimum punishment is 500 rubles, the maximum is 5000 rubles.

You can calm down, the news about the abolition of the permissible range of 20 km/h is some kind of fake. Of course, deputies periodically introduce amendments, developments, etc. for consideration. But so far this is only an initiative of individual officials. No one accepted or approved such amendments to the current legislation. Therefore, you should not believe rumors.
Although it is impossible to say that such an initiative will not become a reality. Back in 2021, there were various instructions from the police and the Ministry of Transport to limit speeding to 10 km/h. But so far such orders have not been fulfilled.
The government voices, of course, other arguments. Among which are:
- the permissible range of 20 km/h is not always safe, especially within the city. For example, if in an emergency area you need to move at a speed of 40 km/h, and add the same permissible 20 to it, you will get 60 km/h. Do not forget about the permissible errors of 3 km. This leads to emergency situations on the roads;
- According to police representatives, the same 20 km/h plays a big role for a pedestrian involved in an accident. If a car is traveling at a speed of up to 60, then the subject’s chances of surviving are many times greater than if they are hit by a car at a speed of more than 60. Such words are not confirmed by statistics, but there is common sense in them.
But we shouldn’t forget about European driving experience, where there is no such range of excess. Of course, 20 km/h is not the optimal range, but everyone is already accustomed to it. And it will be difficult to switch to another mode. There will be many opponents.
The specificity of domestic lawmaking is its unpredictability
. First, the very possibility of adopting this or that norm is denied for years, and then it is ratified in a matter of days. I won’t give examples – you know it yourself. Therefore, in relation to such a sensitive area as road traffic, decisive measures can be taken instantly.

(abandoned cars), vehicle washing on the lawn, playground, etc. Some experts believe that a new type of penalty may be introduced - confiscation of the vehicle. When studying the new edition of the codes, I did not find this, but the idea looks feasible. And tempting.

But experienced drivers remember that conversations on this topic have been going on for twenty years, and things are still there. “Dangerous driving” has not been regulated at the legislative level. There are also rumors that there will be separate fines for Yandex.Taxi and car sharing drivers. But these are definitely rumors.
Fines from cameras
Typically, video surveillance systems are installed on dangerous and busy sections of the road. Therefore, the likelihood of receiving “chain letters” is relatively low. In accordance with the Code of Administrative Offenses of the Russian Federation, Part 3 of Art. 1.5, the driver is not required to prove his innocence in the event of an administrative violation. But in the same regulatory legal act there is a clause that states that the presumption of innocence does not apply if the violation is recorded by a camera or other licensed equipment.
Dimensions
There is a difference between fines that are issued by traffic police officers and those that are recorded by a video surveillance system. The following rules apply to security cameras:
- Regardless of the seriousness of the violations, the driver is not deprived of his right to drive a vehicle;
- if the article provides for the deprivation of a driver’s license, the offender is issued the maximum fine;
- For relatively minor violations, a minimal fine is issued.

Many drivers do not like the innovations associated with the installation of security cameras. But in reality, none of the violations recorded by the camera threaten the car owner with deprivation of his driver’s license.
How is a decision made?
When a violation is recorded by a camera, traffic police officers determine the vehicle number in the traffic police database. Then an administrative violation report is drawn up, after which the car owner receives a notification from the traffic police. It contains information about:
- car model and make;
- vehicle registration number;
- photo of the offense;
- the amount of the fine;
- the essence of the violation, indicating the article of the Code of Administrative Offenses of the Russian Federation.
In accordance with current legislation, the fine must be paid within 60 days. If the letter is ignored, the owner of the vehicle will be prosecuted or the fine will be increased. It is paid in different ways:
- On the State Services website. A personal account is created on the website indicating all the necessary information - passport details, phone number, etc. The fine is paid electronically from an online wallet or bank card.
- In offline branches of Russian banks. You just need to deposit the required amount through an ATM or go to the cashier. If you are registered in online banking, you can pay the fine without leaving your home.
Fines issued by the traffic police must be paid within 60 days. Delay may result in administrative penalties and additional charges.
How to challenge a fine
If the driver is confident of his innocence, he can appeal the decision of the traffic police within 10 days. To avoid such situations, experts advise purchasing personal video recorders. In this case, you can use your footage as evidence of innocence.
How to appeal decisions of traffic police officers:
- if you disagree with the claims and fines presented, you must send a complaint to the relevant authorities, attaching evidence refuting the fact of the offense;
- the application is submitted to the official who made the decision;
- The traffic police officer sends the application to the court.
Security cameras sometimes malfunction. At the moment a violation is recorded, the driver does not always actually break the law. Sometimes video surveillance systems record speeds that cannot be real - 250-320 km/h.
Fines, licenses and scooters: what will change in traffic rules in 2021
So, the amendments cause a double feeling. If you have enough money, you can violate them; the new code does not contain any harsh sanctions. Even deprivation of rights in Russia is not serious: for one and a half to three years, which will fly by unnoticed. For comparison, in the USA and some other Western countries, touching the steering wheel may be prohibited for life.
If the amendments come into force, violating drivers will have to fork out, but not that much. Alas, we have not seen any decisive measures against those who like to ride “under anesthesia.” Although in neighboring Belarus, Ukraine and Kazakhstan they deal with such racers much harsher than here.
The punishment practically coincides with what is charged to the person driving the vehicle by the traffic police (exceeding up to 60 km/h). If you exceed 60 km/h, the sanctions will be softer than if the car is stopped by a traffic police officer. No matter how much the speed limit is violated, the driver will not be deprived of his license, he will simply receive a decision on a fine of 5,000 rubles. – both for the first time and for subsequent times.

According to the deputies who submitted the initiative for consideration, the current speed limit creates a threat to traffic safety. You can prove the validity of this statement using the following example. Let's take the 40 km/h limit that applies in front of pedestrian crossings located near educational institutions. Let's add to them the permissible 20 km/h and the camera error of 2-4 km/h. From here we get a vehicle moving at an unsafe speed of 64 km/h on a road where a child may suddenly be on. On the other hand, there is no reason to assume that a speed of 54 km/h will cause less harm to a potential victim of an accident. European experience shows that in order to reduce the number of incidents, a fine should be introduced for any speeding within the city beyond 50 km/h.
Objectively speaking, the new law is another easy way to replenish the budget, because the speed clause is one of the most violated traffic rules.
The state believes that reducing the fine will guarantee its payment. Indeed, when it comes to small amounts, it is easier to give them away - both physically and psychologically. Therefore, since 2016, there has been a law on the basis of which you can pay a fine within 20 days and receive a 50% discount. Moreover, it does not matter whether it was obtained on the basis of an inspector’s decision or recordings from speed cameras.
How much will the violator pay?
The traffic police fines for speeding are established by law as follows.
- For speeding by 40 km - a fine of 500 rubles.
- For speeding by 60 km - a fine of 1 to 1.5 thousand rubles.
- For speeding by 80 km - a fine of 2 to 2.5 thousand rubles.
- The fine for speeding by more than 80 km/h is 5 thousand rubles.
- The fine for repeated speeding is from 2 to 2.5 thousand rubles. A financial penalty is applied only if the second time the driver exceeds the limit by no more than 60 km/h. If the excess turns out to be more significant, then completely different measures will be taken against the driver.
Note that a repeat offense is one that was committed within 1 year from the date of the first, similar offense.
Many motorists are interested in what kind of speeding is not subject to a fine. If the driver exceeds the permissible maximum by less than 20 km/h, this is not considered an offense, which means you will not have to pay. The inspector, of course, can stop the reckless driver, but he has no right to demand money - he is only allowed to issue a verbal warning.
If a motorist has, for example, exceeded the speed limit by 30 km, the fine for this will be 500 rubles - the same as for 40 km. The scale of excess is measured in intervals - that is, 500 rubles are obligated to pay all those who exceeded the limit by an amount from 21 km/h to 40 km/h inclusive.
It is worth noting that motorists have the opportunity to receive a 50% discount on fines for excess. This discount is given to the most prompt and responsible violators who bother to pay within 20 days of receiving the order. The discount is provided only if, after applying it, the remaining amount of the fine exceeds 500 rubles - therefore, a driver who exceeded the speed limit by 40 km/h or less will not be able to take advantage of it.
