In what cases is it required

PTS was introduced to streamline the admission of vehicles for use and to minimize fraudulent activities with vehicles.

The procedure for filling out, issuing and restoring PTS is regulated by Order of the Ministry of Internal Affairs No. 496.

In accordance with this Order, vehicle passports are issued to:

  • customs authorities if the car is imported into the Russian Federation;
  • manufacturers, if the transport is manufactured by Russian companies;
  • State traffic inspectorate, upon receipt of duplicates of PTS.

In what cases are duplicates issued? The document is subject to restoration by the traffic police if:

  • The title has been lost by the owner of the vehicle;
  • the document is stolen by intruders;
  • The car's passport is impossible to read. The PTS’s unsuitability for reading can be caused by any reasons, for example, the owner of the document was caught in heavy rain, as a result of which the PTS got wet;
  • the document does not have enough free columns to indicate the owner’s details when changing ownership of movable property;
  • after recycling the car, but provided that the vehicle was written off solely on paper (that is, the car was not actually scrapped).

In other cases, for example, when the car owner’s residential address changes, the PTS cannot be replaced. A special mark is placed in the document, which indicates a change in registration data.

Reasons for obtaining a new document

As mentioned above, a transport passport is required when registering or deregistering a car. If the owner of the vehicle does not intend to carry out registration actions with the car, then the restoration of the document can wait.

However, it is worth understanding that every year the amount of state duty increases by a fairly significant amount.

The vehicle license must be replaced or restored in the following cases:

  • when the space where information about the owner of the vehicle should be entered has run out;
  • absence of the original document (loss, theft, etc.);
  • improper condition of the vehicle passport (marks, blotters, etc.), which renders the document unreadable.

Many car owners put their vehicle passport in one folder with the rest of their driving documents. Thus, when documents for a car are stolen, the passport also disappears.

Is it possible to restore a PTS without the owner?

To restore the PTS, that is, to obtain a duplicate document in the event of one of the previously mentioned cases, you must contact the traffic police department located in the region of residence of the owner of the vehicle and provide a number of documents confirming certain factors related to the procedure being performed (detailed list documents will be presented below).

PTS restoration can be carried out by:

  • the owner of the car indicated in the title;
  • a representative of the owner of the car, acting on the basis of a written power of attorney issued by the owner.

If the owner of the vehicle is a private person, then the power of attorney must be certified by a notary (general power of attorney).

Such a power of attorney allows you not only to restore the title, but also to perform other actions with the specified vehicle (issue compulsory motor insurance, receive insurance payments, enter into sales agreements, represent the owner in the traffic police, court and other authorities). A general power of attorney is usually issued for a period of three years.

If the owner of the vehicle is a legal entity, then the power of attorney to restore the title is issued by the head of the company.

A power of attorney from the manager does not require notarization. Unlike a general power of attorney, such a document, as a rule, is issued for the performance of one operation (in this case, obtaining a duplicate PTS) and ends immediately after the representative completes the specified procedure.

You can draw up a power of attorney yourself or with the help of car lawyers. The document must contain the following information:

  • date and place of drawing up the power of attorney;
  • details of the principal. If the principal is an individual, then the full name, date of birth, residential address and passport details are indicated. If the principal is a legal entity, then the document reflects: the full name and address of the company, details of the organization, full name of the manager and details of the document on the appointment of the specified manager;
  • Representative details. Indicate: full name, date of birth, residential address and civil passport details;
  • characteristics of the car for the actions with which the power of attorney is issued. It is enough to indicate the make, model, year of manufacture, VIN number, chassis and body numbers, details (series, number and date of issue) of the certificate of registration of the car with the traffic police;
  • a list of actions that a representative can perform under this power of attorney;
  • validity period of the power of attorney;
  • signature of the principal. If a document is issued by a legal entity, then the document must also have the signature of a representative.

Restoring PTS through the Gosuslugi portal

Restoring PTS through the State Services portal will take much less time than when submitting documents through the MFC. On the portal, in the section regarding vehicle registration, you can find forms for writing an electronic application and correct them online.

After filling out the application, scans of the required papers should be attached to the application, as well as confirm the correctness of the entered data. As soon as the application is signed using a qualified key, it will automatically be sent to the selected (from the drop-down list by region) vehicle registration department.

The applicant will be notified of the date of receipt of the duplicate in a message sent to the email address specified in his personal account.

Submitting documents through State Services is convenient for those citizens who are far from the place where the car is registered (for example, in another city or region) and cannot spare time to stand in long lines. But it should be noted that the document can only be obtained at the place of permanent registration of the vehicle, although this particular action will only take a few minutes.

What do you need from the documents?

If the title is lost, how can I restore it without the owner of the car? At the first stage, it is necessary to prepare a number of documents that will be required when applying to the traffic police to obtain a duplicate PTS.

Such documents include:

  • passport of the representative who restores the title by proxy from the owner of the movable property;
  • vehicle registration certificate. The document is issued by the State Traffic Inspectorate after the vehicle is registered;

  • contract of sale and purchase, gift, certificate of inheritance, and so on, that is, a document on the basis of which ownership of movable property arose;

Recovery procedure

PTS restoration is carried out in several stages:

  • collection of documents;
  • submitting a written application to the traffic police. The application can be filled out independently at the traffic police department (a sample is on the stand, and the form is issued by an employee of the organization) or online through the government services website (a form is provided that must be filled out);
  • provision of a vehicle for inspection. An inspection, during which all numbered units and the individual number (VIN) are reconciled, is carried out in cases of loss, theft or restoration after disposal. In other situations, an inspection is not required;
  • document verification by a traffic police inspector. During the inspection, not only the submitted documents and inspection results are verified, but also the specified data is checked against the traffic police database;
  • issuance of a duplicate PTS.

Documentation

In any city you can restore the documentation in question. To do this, you need to contact the traffic police department. They visit exactly the authority that registered the car. In this case, you should apply after collecting documentation.

The list includes:

  1. A document through which the identity of the applicant is established. In addition, a copy is attached.
  2. An explanation needs to be made regarding the loss.
  3. Statement. There are certain rules that the document must comply with. The form can be obtained from the traffic police department.
  4. STS. If this document is lost along with the PTS, then a separate application for its restoration is written. When the owner dies, restoration is carried out in a different order.
  5. OSAGO policy.
  6. Acts by which the rights to the car are confirmed.

The owner of the car or his legal representative can receive a duplicate PTS, but in some situations it is also possible to restore the document under the purchase and sale agreement.

In this situation, the traffic police submits:

  • resolution on the collection of movable property;
  • an act confirming the seizure procedure;
  • document confirming the appointment of the auction;
  • a document indicating the purchase of a car at auction.

In other situations, restoration of a car’s passport may be denied, but the new car owner always has the opportunity to go to court.

Speaking about whether it is possible to restore a PTS without an owner, first of all it is necessary to point out the basic concepts on this topic.
The specified document is interpreted as a passport regarding the vehicle. This act reflects some data regarding the car. The list includes:

If everything is in order with your documents, a duplicate will be issued to you within 1-2 hours; on average, this is how long it takes MREO employees to verify the data and issue a title on a new form. Sometimes, in case of heavy workload, MREO employees may ask you to return for a duplicate in a few days.

In what cases is it required

If the document remains at the applicant’s disposal, but is no longer suitable for use (due to damage or lack of free lines), the previous PTS is attached to the package of papers.

Refusal to issue a duplicate is a fairly rare occurrence. The reason for this may be operational information or guidance that the car:

  • is stolen;
  • is involved in an accident and fled the scene;
  • was used to commit an illegal act.

In this case, the applicant needs to contact the head of the MREO with a written request, in which he must indicate his desire to receive a reasoned answer regarding the legality of the actions of officials.

The letter must be sent no later than six months from the date of receipt of the official refusal. If the appeal does not bring a satisfactory result, but the car owner is confident in the legality of his demand, then he can appeal the actions of government officials in court.

These documents, in the absence of all others or in addition to them, are not significant. This evidence is not accepted by registrars, therefore, it is impossible to restore the PTS from it.

The process of restoring a vehicle passport is regulated by paragraph 10 of the Order of the Ministry of Internal Affairs dated August 7, 2013, number 605.

This document stipulates the time allotted for the production and issuance of a duplicate by employees of the responsible institution (State Automobile Inspectorate), which is no more than one hour.

In practice, the process takes longer due to the workload of the department staff and the car owner's requests on a first-come, first-served basis.

It is possible to restore the title under the purchase and sale agreement. If this document is available, the paper discussed above is required, namely a notarized general power of attorney in the name of the applicant.

In addition to this, a photocopy of the car owner’s civil passport certified by a notary is also required.

Along with these documents, the applicant must also have:

  • your own ID, including a passport or driver’s license;
  • purchase and sale agreement.

The applicant is required to draw up an explanatory note in which he must set out how the rights were lost. If there is a suspicion that a document has been stolen, this should be indicated in plain text.
