Vehicle owners should know why inspectors can remove license plates from their cars. In 2021, traffic police officers have a similar right. If the driver violates certain rules, then this measure may be applied to him. As a result, the person is fined, their license plates are removed and their license may be revoked. To prevent this from happening, first of all, you need to know in what cases such punishment is applied. Every driver should not violate traffic rules in order to avoid problems with the traffic police.

Procedure for removing license plates

When removing a state registration plate, a protocol on an administrative offense is drawn up, where a note is made about the prohibition of use and a special protocol on the removal of state registration plates.
The license plate will be confiscated until the reasons for the prohibition of use are eliminated. In all cases, except for those provided for in Article 9.3 and Part 2 of Article 12.5, traffic is allowed to move to the place where the reasons for the prohibition of operation are eliminated within 24 hours from the date of drawing up the protocol (Part 2.1 of Article 27.13 of the Administrative Code).

The procedure for transferring state registration plates to the relevant departments of the State Traffic Safety Inspectorate, storing and returning state registration plates is established by Order of the Ministry of Internal Affairs of the Russian Federation dated March 19, 2004 No. 187 “On the implementation of Decree of the Government of the Russian Federation dated December 18, 2003 No. 759.” In accordance with the order, confiscated state signs are transferred to the traffic police department at the place where the offense was detected. An entry about this is made in the register of state registration plates accepted for storage. The register must reflect: the state registration plate, the date and reason for removal, information about the owner of the vehicle, information about the employee who accepted the state registration plates for storage, the date of return or transfer of the state registration plates to the place of registration of the vehicle, a mark on the disposal of the state registration plate registration plate (if there was one).

If the seizure of the state sign occurred on the territory of the constituent entity of Russia where the vehicle is registered, the numbers are transferred to the traffic police department at the place where the vehicle is registered. If the seizure occurred on the territory of another subject of the Russian Federation, then the numbers are transferred to the traffic police department at the place where the offense was detected, with subsequent transfer to the traffic police department at the place where the vehicle is registered. In this case, the owner of the vehicle or his representative may submit a petition so that the license plates and the protocol on the administrative offense are not transferred. In this case, the period within which the owner of the vehicle undertakes to correct the reasons for the prohibition of operation is indicated. If the reasons are not corrected on time, the state registration plates and the protocol are transferred to the unit at the place where the vehicle is registered.

If state registration plates are seized from a vehicle registered in another state, they are stored until the reason for the prohibition of operation is eliminated in the traffic police department at the place where the offense was detected. After the reasons for prohibiting the operation of the vehicle are corrected, the state registration plates are returned to the owner, which is recorded in the protocol.

New rules for registering cars with gas equipment

Many vehicle owners consider it more rational to use gas rather than gasoline as fuel. This is economically justified, since the cost of liquid fuel is constantly growing; with gas, things are not so bad.

Everyone knows that cars do not leave the assembly line with ready-made gas equipment. Car enthusiasts have to make changes to the fuel system themselves.

The legislation does not prevent such actions, but they must be previously agreed with the traffic police. Otherwise, the violator will be awarded a fine of 500 rubles .

These agreements occur as follows:

  1. Preliminary technical examination - occurs before installation of equipment in order to ensure the safety, feasibility and real possibility of making such changes.
  2. Safety check is the final control point of the examination, when the work done and the compliance of the results with the technical regulations are assessed. At the end of the assessment, a corresponding certificate is issued.

Previously installed gas equipment must be registered again in 2021. To do this, there is no need to remove all parts not provided for by the design (as was the case before), just visit a specialized laboratory for an expert assessment and give the resulting conclusion to the traffic police.

Legislative innovations for trucks

In 2021, any truck in Russia must be equipped with a tachograph.

This is special equipment that records important movement indicators:

  • speed;
  • route;
  • break times;
  • driver's work duration.

Vehicles that an organization or individual entrepreneur uses in their commercial activities must be equipped with a tachograph. This is stated in the Federal Law “On Road Safety”, Article 20, Part 1.

There are some exceptions to this situation:

  • special equipment;
  • funeral service vehicles;
  • mobile laboratories;
  • military transport;
  • operational search vehicles;
  • agricultural machinery;
  • armored vehicles;
  • houses on wheels.

The disobeying car owner will be required to pay a fine for not having a tachograph. For individuals, the amount will be equal to 1–3 thousand rubles , and for an official it will increase to 5–10 thousand rubles (Article 11.23 of the Administrative Code of the Russian Federation).

Innovations for legal entities

The only difference when registering a car as a legal entity is not the amount of the fee (it remains the same as for an individual), but the need to make all payments in cash.

The entrepreneur transfers funds from his official bank account registered with the Federal Tax Service. This requires certain papers, the execution of which is mandatory when registering a vehicle.

If a company, organization, or individual entrepreneur has several cars on its balance sheet, then each one must be registered.

Payment is made separately for each procedure, by bank transfer.

Transport tax

An annual cash collection from all car owners is mandatory throughout the Russian Federation, as established by the federal legislation of the country.

In 2021, there are no changes or adjustments affecting the payment procedure, tax amount or deadlines:

  1. Individuals must still pay the contribution to the state budget by December 1 of the following year.
  2. As for legal entities and organizations, they need to be ready by February 1, that is, a month after the end of the reporting period. In addition, they are required to make an advance payment for the next year along with this payment.
  3. Cars listed as stolen are exempt from transport tax.
  4. Severely damaged vehicles sent by the owner for long-term repairs do not have any benefits; deductions for them to the treasury are also strictly obligatory.

Based on the results of all of the above, we can safely say that the state is still trying for the people. The procedure for registering cars has been simplified.

Gas equipment cannot be dismantled (subject to all usual technical conditions); an electronic procedure for registering a vehicle is available.

These innovations greatly simplify the life of a car enthusiast, especially with regard to the abolition of re-registration of license plates after purchasing a used car or after moving to another city.

How much do number transactions cost?

Rare and expensive numbers

All tariffs for actions performed with license plates when removing or registering a car are fixed. The approximate cost of the procedure for saving license plates and placing them on a new car with registration is 7,700 rubles, and it consists of the following points:

  • issue of duplicate license plates – 2000 rubles;
  • change in the passport of an old vehicle – 350 rubles;
  • issuance of a new car registration certificate – 500 rubles;
  • issuance of license plates – 2000 rubles;
  • changes in the passport of a new car – 350 rubles;
  • issuance of a registration certificate for a new car – 500 rubles;
  • issuance of license plates for a purchased car – 2000 rubles.

For comparison: if you decide to get and install new license plates on your purchased car, it will cost 2,850 rubles, and if you leave the same plates, you will save 2,000 rubles. So decide for yourself whether you should leave the license plates when deregistering your car or whether you are willing to overpay for new license plates.

What is the fine for driving without license plates?

Unreadable numbers. The numbers must be clean and easy to read - so that numbers and letters are visible from 20 meters away. Otherwise, the driver may be fined 500 rubles.

Installation of numbers in violation of state standards. Almost all vehicles and trailers must have numbers. According to GOST, they stand exactly in the center of the car at the back and front, or offset to the left. For fastening, use bolts with white heads or frames, and nothing should block the inscriptions. The sign must not be covered or additional holes drilled into it.

For errors with fastening they are fined 500 rubles, for installation in the wrong place - 5 thousand rubles or deprived of rights for 1-3 months.

Driving with modified numbers. This is considered a sign where a letter or number has been sealed, the plate has been turned over to face the body, and it has been covered with a curtain, paper or cardboard, leaves or snow. The modified sign differs from the dirty sign in that it became unreadable not because of the weather, but because of deliberate actions. The fine for this violation is 5 thousand rubles or deprivation of rights for 1-3 months.

Installing other people's numbers. All types of counterfeit signs are prohibited:

  • made by handicraft method;
  • with a change in license plates, for example, replacing a symbol;
  • non-corresponding PTS, for example, from someone else’s car.

For installing such license plates, the driver will be fined 2,500 rubles, the one who released the car onto the company employee’s line will be fined 15-20 thousand, and the company itself will be fined 400-500 thousand rubles.

If a driver is caught with such signs on the road, they will be additionally deprived of their license for a period of six months to a year.

Driving without license plates in a new car. A new car can be driven without license plates for up to 10 days, but on the 11th day a fine for lack of registration is already possible - from 500 to 800 rubles. If you are stopped for such a violation again within a year, the fine will be higher—5,000 rubles or deprivation of your license.

Driving with lost license plates. If a car does not have license plates, or even one of two license plates, you cannot drive it. You need to contact the traffic police and restore state signs. For this you will be fined 5,000 rubles.

If there is no frame


Car owners who are not satisfied with the frames attach the numbers to the bumper with screws or rivets.
In the first case, to remove the sign it is enough to use a screwdriver. If the screw has become stuck and will not come off, it is better to immediately treat it with WD-40, wait 5 minutes and try again.

Rivets and self-tapping screws with licked heads are carefully drilled out. It is not recommended to use a grinder, as there is a high probability of damaging the surface of the sign during work.

Drilling is carried out while protecting your eyes with goggles.

Illegal installation of flashing lights, incorrect headlights or color schemes.

So, I would like to immediately note that Article 12.4 of the Administrative Code does not deal with driving a vehicle, but with the illegal installation of devices, devices and color schemes.

Those. a prohibition of operation can be imposed not only on a moving vehicle, but also on a stationary vehicle. Located, for example, in a parking lot.

1. How did the license plates end up being wanted?

There may be several reasons for this.

Reason 1. Human factor

The most common and most harmless option of all.

The numbers ended up in the database due to a simple mistake by operators who enter information into various traffic police databases. Ask the inspector to clarify the information, and perhaps at this stage the situation will be resolved in your favor, saving you a lot of effort and time.

Reason 2. Serious. Someone actually committed a crime using a copy of your license plates.

From time to time, clients come to us who receive other people's fines from CCTV cameras on the roads.

Some violators, not wanting to pay for their violations out of their own pockets, do not simply cover part of the number with a piece of paper or leave it dirty - they change one or more digits.

Of course, the camera cannot recognize the deception, and the fine comes to the unsuspecting owner of the real license plates (who, sometimes, even has a car of a different make and color than the one in the photo at the time of the traffic violation).

Here the situation is similar, but the consequences are much more serious. Your numbers can be used not only when committing an administrative offense, but also when committing a crime. Robbery, kidnapping, murder... And this is just the beginning of the list of what criminals can do by using - consciously or not - a duplicate of your license plate.

In this difficult situation, those who have recorded confirmation of the location of their car (for example, recordings from surveillance cameras, a parking ticket, witness testimony, or even a protocol on committing an administrative offense at the same time on the other side of the city) will be able to get out with the least losses. The rest will have to work hard to prove that they are not related to the numbers that witnesses remembered and which may have been caught on camera.

Reason 3. Fraud: double car

When buying a car, you could become a victim of a seller who decided to sell two (or maybe more) identical cars at once, one of which was stolen.

The scheme is simple, but not everyone will suspect a trick.

1) The criminal advertises the sale of his car.

2) Another car is stolen, as similar as possible to the one featured in the ad (year of manufacture, color, model, etc.).

3) The seller interrupts the identification numbers on the stolen car and puts a license plate from his own “legal” car on it.

4) After this, the stolen car with the wrong license plates is handed over to the buyer. As a rule, the purchase and sale agreement already bears the signature of the seller (in fact, not made by him). The second option is that instead of the owner, a figurehead comes to the transaction under the guise of him.

5) After the buyer has the car and the money has been received, the seller immediately contacts the traffic police and states that the license plates have been removed from his car. Having received new ones, he calmly sells the second, truly his car, leaving the buyer at the mercy of the first traffic police post.

Unfortunately, it is impossible to completely insure yourself against this risk. It happens that the person from whom you bought the car did not know anything about it and was the second or even third owner after the thief.

Such a scheme is difficult for an ordinary buyer to identify: notice broken numbers, see inconsistencies in the seller’s story and the condition of the car, and so on. Fortunately, to check the purity of the transaction, you can turn to professionals who will check the car for hidden defects and compare them with the story about the car.

It wouldn’t hurt to check it yourself, including using online services. Some of the most popular are listed below:

Reason 4. The police increase detection rates even before a crime is committed.

You may well fall victim to unsuccessful photoshop or an attempt to hide real license plates when selling cars through classifieds sites.

Someone posts a photo of a car with the same license plates as yours. This becomes known to the police when victims or simply vigilant buyers find out, contact the police and the license plates are put on the wanted list.

As a result, the traffic police officer, having stopped your car, will find the license plate in the database of wanted numbers and will detain you until the circumstances are fully clarified.

In this case, the license plates are confiscated as part of the pre-investigation check and must be returned only after its completion (but it is not known exactly when this will happen).

Reason 5. A car with “history”

As in the third example, skimping on pre-sale inspections often leads to the most disastrous consequences.

One of our clients encountered a car being put on the wanted list and turned to us to recover damages from an unscrupulous seller. Before selling the car, he kept silent about pledging the car in favor of the bank and even signed an agreement where he guaranteed that there were no encumbrances on the car.

Our client took the seller’s word for it, and in vain. 3 months after registering the car, he was literally stopped halfway from work home by an inspector and notified that the car was wanted at the request of the bank, to which the seller had stopped paying the debt.

Unfortunately, the bank’s demands were absolutely legitimate, and payments from the fraudulent seller are meager and will continue for at least another three years until the debt is fully repaid.

Therefore, if you are not ready to lend to a fraudulent seller for an indefinite period at 6.25% per annum, do not neglect checking the car according to the Register of Notifications of Pledge of Movable Property (reestr-zalogov.ru/state/index).

What to do if license plates are confiscated?

Of course, you can’t just continue driving without license plates, otherwise you risk getting a fine of 5 thousand rubles or losing your right to drive a vehicle.

Therefore, below we present an algorithm of actions for those who find themselves in such a difficult situation.

2.1. First, you need to find out the reasons for the seizure of license plates.

If this is one of the articles of the Code of Administrative Offenses of the Russian Federation or subparagraph “g” of paragraph 12 of the Regulations on the State Road Safety Inspectorate of the Ministry of Internal Affairs of the Russian Federation (the provision on the possibility of confiscating license plates was removed from it back in September 2021!), then you can complain to the prosecutor’s office.

But if the reason for the seizure is stated in the protocol to be something else, then you can complain to the immediate head of the relevant traffic police department.

Important!

Traffic police officers do not have the right to confiscate license plates on the spot, but they can prohibit the operation of the vehicle as a whole until the discrepancies are eliminated, that is, until the number is removed from the database of wanted numbers or until a new license plate is installed.

2.2. Appeal the seizure to the prosecutor's office and the chief of the inspector who seized the license

In your complaints, refer to the abuse of power by a specific traffic police officer and to the fact that you bought the car absolutely legally and did not violate any norms. Ask them to check and return the license plates. By law, citizens' appeals are considered within one month, although in practice it may take longer.

2.3. If you are not satisfied with the answers to these complaints or they did not produce results, file a complaint with the court.

If appeals to the prosecutor's office and the boss are written in any form (the main thing is to make it clear to whom, from whom and on what issue the complaint was filed), appeals to the court require compliance with a much larger number of formalities. Therefore, we advise you to consult a lawyer before submitting such a document (otherwise you may lose 2-3 weeks while the court considers whether to accept your documents for production).
